AN ORDINA -NCE AMENDING SECTION 6 OF ORDINANCE NO. 6972 BY REQUIRING LIABILITY INSURANCE IN CERTAIN SPECIFIED AMOUNTS ACCORDING TO THE CA{ PACITY OF THE VEHICLEi REQUIRING THAT AN ENDOR- SEMENT BE ATTACHED TO EACH POLICY REQUIRING THAT THE POLICY OF INSURANCE BE FILED viITH THE CITY COLLECTOR; A u`D FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That Section 6 of Ordinance No. 6972, passed April 8, 1946, be and the sane is hereby amended to read as follows; No permit shall be issued to any person, firm, or corporation to operate or permit the operation of any motor - driven vehicle engaged in the business of or operated as a common carrier over the streets of the City of Little Rock, until and unless there has been filed in the office of the City Collector a Public Lia- bility and Property Damage insurance policy issued by a company licensed to trans- act business within the State of Arkansas with the following endorsement therein: ENDORSEMENT In consideration of the premium stated in the policy to which this endor- sement is attached, the Company hereby waives a description of the motor vehicles to be insured hereunder, and agrees to pay any final judgment for personal injury, Including death resulting therefrom and or damage to property of others (excluding injury to or death of the insured's employees while engaged in the course of their employment, and loss of or('damage to property of the insured and property transpor- ted by the insured, designated as cargo) caused by any and all motor vehicles opera- ted by the assured whether listed in the original schedule of motor vehicles filed with the original application or whether to be an additional, substitute or emergency vehicle operated under any certificate, license, or permit by any order or rules of the Arkansas Public Service Commission within the limits of the schedules hereinafter set out, and further agrees that upon its failure to pay such final judgment, such judgment creditor may maintain an action in any court of competent jurisdiction to compel such payment. Nothing contained in the policy or any endorsement thereon, nor the violation of any of the provisions thereof, by the assured, shall relieve the company from the liability hereunder or from the payment of such judgment. The liability of the company shall be the damages sustained to persons or property within the limits of the schedule set out below, except that the insured may file a policy with the limits of the liability greater than the minimum as set out in the schedule. - 2 - The liability of the company on each motor vehicle for the following limits shall be a continuing one notwithstanding any recovery hereunder. SCHEDULE OF MINIMUM LIMITS On each motor vehicle used in the transportation of persons, having a seating capacity of twelve passengers or less, not to exceed; $5,000.00 for bodily injuries to or death of one person. $10,000.00 for bodily injuries to or death of all persons injured or killed in any one accident (subject to a maximum of $5,000.00 for bodily injury to or death of one person.) X1,000.00 for loss or damage in any one accident to property of others. On each motor vehicle used in the transportation of persons, having a seating capacity of thirteen to twenty passengers, inclusive, not to exceed; 45,000.00 for bodily injuries to or death of one person. $20,000.00 for bodily injuries to or death of all parsons injured or killed in any one accident (subject to a maximum of $5,000.00 for bodily injury ma to or death of one person.) $1,000.00 for loss or damage in any one accident to property of others. On each motor vehicle used in the transportation of passengers, having a passenger capacity of twenty -one to thirty, includi -ve, not to exceed: 05,000.00 for bodily injuries to or death of one person. 00,000.00 for bodily injuries to or death of all persons, injured or killed in any one accident (subject to a maximum of $5,000.00 for bodily injury to or death of one person.) $1,000.00 for loss or damage in any one accident to property of others. On each motor vehicle used in the transportation of passengers, having a passenger capacity of thirty -one passengers or over, not to exceed: $5,000.00 for bodily injuries to cr death of one person. 440,000.00 for bodily injuries to or death of all persons injured or killed in any one accident (subject to a maximum of 45,000.00 for bodily injury to or death of one person). $1,000.00 for loss or damage in any one accident to property of others. The policy to which this endorsement is attached shall not expire, nor shall cancellation take effect until after THIRTY (30) DAYS notice in writing, by the Company, small have first been given to said City Collector, and THIRTY (30) DAYS notice to commence to run from the date notice is actually received by the City Collector. - 3 - SECTION 2. The provisions of this ordinance do not apply to taxicabs, the insurance certificates of which are required to be filed with the Commissioner of State Revenues pursuant to the provisions of Act No. 385 of the Acts of Arkansas. for 1949. SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed, and unless the provisions of this ordinance are placed into effect imnwdiately the safety of the citizens of the City of Little Rock, Arkansas, will be adversely affected, therefore an em- rgenoy is hereby declared to exist and this ordinance will be in effect from and after its passage and approval.
