I AN ORDINANCE VESTI17 G CONTROL, POSSESSION AND CHARGE OF j THE LITTLE ROCK MUNICIPAL AIRPORT FACILITIES AND RELATED PROPERTY IN THE LITTLE ROCK AIRPORT COIv iISSION, TRANSFER- RING AIRPORT FUNDS HELD IN THE CITY CLERK'S OFFICE TO THE AIRPORT COMMISSION, DESIGNATING THE AIRPORT COMMISSION AS THE PARTY IN SUCCESSION TO ANY COIv`'RACTS NOW IN FORCE BETWEEN THE CITY OF LITTLE ROCK AND THIRD PARTIES, AND DESIGNATING THE AIRPORT COMMISSION AS THE BODY TO RECEIVE FUNDS DUE OR GRANTS MADE BY THE AGENCIES OF FEDERAL OR STATE GOVERNMENTS WHICH ARE NOW DUE OR MAY BE GRANTED IN. THE FUTURE, AND FOR OTHER PURPOSES. VVIEREAS)by Act 53 of the Arkansan Legislature of 1949, cities of the first class are granted the power to set up airport commissions for the purpose of conducting the business of municipal air?orts, and WHEREAS,on i4ovember 7, 1950, the electorate of the City 8511 of Little Rock passed Initiated Ordinance No.f setting up the Little Rock Municipal Airport Commission, and WHEREAS � said Commission has been duly set up pursuant to the provisions of said Ordinance, and WHEREAS under Act 53 of the Acts of .Arkansas of 1949. . the Mayor and City Council are required to execute such instruments and enact such measures as may be necessary to vest complete charge of said municipally owned airport, and its related properties and facilities, in the Commissioners heretofore appointed, and T "TFH;'REAS j at the present time there is in the hands of the City Clerk of Little Rock a fund in the sum of One Hundred and Ten Thousand, Eight Hundred and Eighty -Nine Dollars and Fifty -One Cents ($110,889.51) known as the Airport Improvement Fund, and WHEREASP the City of Little Rock has previously entered into contracts with third parties for the benefit of and the operation and improvement of said airport, and WHEREAS there are due for the benefit of said airport certain funds which have been designated, granted or allowed as owed to the City of Little Rock, Arkansas, for the benefit of said municipal airport, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That complete control, possession and charge -2- of the Little Rock Municipal Airport facilities and related properties, be and the same are hereby vested in the Little Rock Airport Commission. I' SECTION 2. That the Municipal Airport Improvement Fund 1 j now in the hands of the City Clerk of Little Rock, amounting to the sum of One Hundred and Ten Thousand, Eight Hundred and Eighty - Nine Dollars and Fifty -One Cents ($110,889.51), shall be trans- ferred and turned over to the Little Rock.Airport Commission by the City Clerk upon their receinting him for said funds. I SECTION 3. The Airport Commission is hereby designated as the party in succession to all contracts entered into for the benefit of the Little Rock Municipal Airport by the City of Little Rock. SECTION 4. The Airport Commission is further designated as the party in succession to any and all funds, both Federal and State, which have heretofore or may hereafter be granted to the City of Little Rock, Arkansas, for the pur -nose of improving the Little Rock Municipal Airport. SECTION 5. The Airport Commission is further designated as the party in succession to the City of Little Rock to receive any and all liquidated damages to the airport which have been here- tofore agreed upon by the City of Little Rock and other parties. SECTION 6. The Airport Commission is further designated as the party in succession -to any and all rights of action which the City of Little Rock, Arkansas, may have acquired in operation of said airport. SECTION 7. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 8. This ordinance shall be in full force and effect from and after January 15, 1951.
