AN ORDINANCE TO AMEND ORDINANCE N0. 8061 TO PRESCRIBE PENALTIES
FOR DRUNKEN DRIVING AS PROVIDED BY STATE STATUTES, AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. Section 2 of Ordinance No. 8064 is hereby
amended to read as follows:
"Section 2. Every person who is convicted of a
violation of this Ordinance shall be punished as follows:
(1) Upon the first conviction such person shall be
punished by a fine in a sum not exceeding One Hundred Dollars
($100.00) and shall serve one day in the City Jail.
(2) Upon each subsequent conviction for the violation
of this Ordinance such person shall be subject to a fine of not less
than One Hundred Dollars ($100.00) nor more than One Thousand Dollars
j ($1,000.00) and imprisonment in the City Jail for not less than five
(5) nor more than thirty (30) days.and revocation of the offender's
driverts license for a period of one year."
SECTION 2. The jail sentences provided for by this Ordinance
shall be mandatory and no court shall have authority to suspend any
Jail sentence imposed for violations of this Ordinance.
SECTION 3. All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4. WHEREAS, it is imperative for the safety of
pedestrians and other users of our streets to maintain strict enforce-
meat of all of the traffic and criminal laws designed to protect the
public; and
fr IMIMA3`, at the present time our statutes do not provide
adequate punishment for violators of the traffic code pertaining to
drunken driving, and this Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is
declared to exist and this Ordinance shall be in full force and effect
from and after its passage.
