HomeMy WebLinkAbout8668ORDINANCE NO. 8668 AN ORDINANCE AMENDING SECTION 81 -C OF ORDINANCE NO. 5876 COVERING TRAILERS USED IN HAULING UNPROCESSED FOREST PRODUCTS, AND FOR OTHER PURPOSES. WHEREAS Section 4 of 75 -724 of the Statutes of Arkansas and Section 81 -C of Ordinance No. 5876 pertaining 'to brakes on trailers and semi - trailers contain identical language except for jurisdiction, and WHEREAS said Statute and Ordinance are ambiguous to such an extent as to b e incapable of interpretation and proper enforcement, and WHEREAS the provisions should be clarified in order to provide adequate safety for the public in connection with the operation of such trailers and semi - trailers within the city limits; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That Section 81 -0 of Ordinance No- 5876 be amended to read as follows: All trailers and semi- trailers operated upon the streets of Little Rock shall be equipped with service brakes on all wheels of all such vehicles;provided, "however, that semi- trailers weighing while empty 1500 pounds or less shall not be required to have such brakes, and provided further that semi- trailers of all weights while used exclusively in hauling unprocessed forest products shall be prohibited from driving in excess of fifteen (15) miles per hour in the City and such semi - trailers while operated at such reduced speed shall not be required to have such brakes. Nothing in this ordinance shall in any way relieve any operator of any such motor vehicle from maintaining adequate brakes at all times t9 stop such vehicles, whether loaded or empty, within the misimum distance now provided by law. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Unless the provisions of -2- this ordinance are put into effect iimnediately, the public peace, health and safety of the citizens of Little Rock will be adversely affected. Therefore, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval. sS31h =- fay 7 1951.
