HomeMy WebLinkAbout8727ORDINANCE NO. 8727 AN ORDINANCE P'?OVIDI?\1r FOR T1-T GRANT NG OF AN EASEMENT TO SEWER IMPROVEItENT DISTRICT NO. 59 ACROSS CERTAIN PROPERTY OF 71TE CITY OF LITTLE ROCK, ARKANSAS FOR THE PURPOSE OF LAYING AN OUTFALL SEWER LINE TO THE ARKANSAS RIVER, DECLARING AN EMERGENCY AND OTHER PURPOSES WHEREAS, Sewer Improvement District No. 59 of Pulaski County, Arkansas is a duly organized and existing suburban sewer district, organized for the purpose of providing sewage disposal to a number of residents of Pulaski County and the City of Little Rock, Arkansas, and is in the process of laying an o,ztfall sewer line across various tracts of land to the Arkansas River, and WHEREAS, the City of Little Rock, Arkansas is the owner of certain land South of the Arkansas River in'the S11;41- SE4 of Section 19, Township 2 north, Range 12 ?Nest, Pulaski County, Ark- ansas and through which land it is necessary for the sewer line to cross to reach the Arkansas River,and WHEREAS, the completion of this sewer line will benefit the health and property of a number of residents of Pulaski County and the City of Little Rock, Arkansas. BE IT ORDAINED by the City Council of Little Rock, Arkansas: Section 1. The Council herby finds and declares that there is an immediate need for the improvement and that a number of residents of Pulaski County and the City of Little Rock, Arkansas will be benefited by said improvement and that the granting of an easement across the property of the City of Little Rock will mater- ially save in the cost of this improvement and facilitate its construction. Section 2. The Mayor and City Clerk be and the same are hereby authorized to execute an easement deed to Sewer Improvement District No. 59 of Pulaski County, Arkansas, granting a ten foot easement across that part of the SW-,I SET, Section 19, Township 2 North, Range 12 West, Pulaski County, Arkansas which lies South of the Arkansas River; commencing at a point on the South line of the Slit SE of Section 19 and running Northwesterly across said land to the Arkansas River. Section 3. All ordinances or Darts of ordinances in con- flict herewith are he --eby repealed. Section 4. It is he.,eby ascertained and declared that there is immediate need, in order to protect the health and pro- perty of many inhabitants of the City and County, for the improve- ment; therefore, an emergency exists and this ordinance is necessary for the pct of the wibthoutpdelay fromtandnaftefreits passage• take effect and PASSED: August 27, 1951 ,approved: Acting Mayor Attest C �ty Clerk
