HomeMy WebLinkAbout9004+� Y ORDINANCE NO. 900 A ORDINANCE RELEASING, VACATING AND ABANDONING CERTAIN STREETS AND PORTIONS OF STREETS IN TN=R1AL FALHK`;�AND ALLEYS ADDITION, ANNEX NO. 1, TO THE CITY OF LITTLE ROCK, WHICH STREETS ARE SURROUNDED BY PROPERTY OWNED BY THE LITTLE ROCK MUNICIPAL AIRPORT COMMISSION, SO THAT THERE MAY BE AN EXTENSION OF THE NE /SW RUNWAY TO PROVIDE. LENGTH OF RUNWAY REQUIRED FOR THE NATIONAL GUARD SQUADRON, SAID STREETS TO BE RELEASED, ABANDONED AND CLOSED. WHEREAS, a petition was duly filed with the City of Little Rock, Arkansas, on September 8, , 1952, asking the City Council to release, vacate and abandon all those portions and alleys of the streets/designated on the plat of the Industrial Park Addition, annex No. 1, to the City of Little Rock, now appearing of record in Plat Book 3, page 32, in the office of the Recorder and alleys of Pulaski County, said streets /being described as follows; 1. Lawson Street lying south of East 10th Street and north of the south line of Lot No. 2, Block 76 of Industrial Park Addition, Annex No. 1. 2. River Street south of East 10th Street and north of East 12th Street between Blocks 59 and 60 of Industrial Park Addition, Annex No. 1. 3. East 12th Street between Blocks 59, 60 and 81 of Industrial Park Addition, Annex No. 1. 4. East 14th Street between Blocks 80 and 81 of Industrial park Addition, Annex No. 1. 5. East 15th Street between Blocks 76 and 81 of Industrial Park Addition, Annex No. 1. 6. The alley lying through Blocks 60, 80 and 81, from East 10th Street south to East 15th Street in Industrial park Addition, Annex No. 1, and the alley lying east of Blocks 80 and 81 in Industrial Park Addition, Annex No. 1. 7. East 10th Street from the east line of River Street eastward between Blocks 57 of Industrial Park Addition and 59 of Industrial Park Addition, Annex No. 1. 8. The extension of East 10th Street eastward on a bearing of S 890 57t from the east boundary of Industrial Park Addition, Annex No. 1, a distance of 893 feet, to the point of beginning of a 10 deg'ri,eurve to the right and continuing along the curve a distance' X71 feet measured along the center line of said East -2- 10th Street extension, the right -of -way width of said street being -.60 feet. 9. East 26th Street, also known as Roosevelt Road extension, from a point in the center of existing paved surface, being 407 feet south and 1716.86 feet east of the NW corner of Section 13, Township 1 North, Range 12 West, which point is the west right -of -way line of the Missouri Facific Railroad, east- ward a distance of 1875 feet; and WHEREAS. after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascer- and alleys, twined that the streets /or portions thereof, hereinbefore described, have heretofore been dedicated to the public use as and alleys street herein described;have not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting and alleys upon the portion of the streets to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such streets and alleys; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK; ARKANSAS: SECTION 1. That the City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the following and alleys streets/designated as follows: 1. Lawson Street lying south of East 10th Street and north of the south line of Lot No. 2, Block 76 of Industrial Park Addi- tion, Annex No. 1. 2. River Street south of East 10th Street and north of East 12th Street between Blocks 59 and 60 of Industrial Park Addition, Annex No. 1. 3. East 12th Street between Blocks 59, 60 and 81 of Industrial Park Addition, Annex No. 1. 4. East 14th Street between Blocks 80 and 81 of Industrial Park Addition, Annex No. 1. 5. East 15th Street between Blocks 76 and 81 of Industrial Park Addition, Annex No. 1. r n , U. 6. The alley lying through Blocks 60, 80 and 81 from East 10th Street south to East 15th Street in Industrial Park Addition, Annex No. 1, and the alley lying east of Blocks 80 and 81 in Industrial Park Addition, Annex No. 1. 7. East 10th Street from the east line of River Street east- ward between Blocks 57 of Industrial Park Addition and 59 of Industrial Park Addition, Annex No. 1. 8. The extension of East 10th Street eastward on a bearing of S 890 57t from the east boundary of Industrial Park Addition, Annex No. 1, a distance of 893 feet, to the point of beginning of a 10 degree curve to the right and continuing along the curve a distance of 871 feet measured along the center line of said East 10th Street extension, the right -of -way width of said street being 60 feet. 9. East 26th Street, also known as Roosevelt Road extension, from a point in the center of existing paved surface, being 407 feet south and 1716.86 feet east of the NW corner of Section 13, Township 1 North, Range 12 West, which point is the west right -of -way line of the Missouri Pacific Railroad, eastward a distance of 1875 feet, be and they are hereby abandoned, vacated and released. SECTION 2. A gopy of the ordinance, duly certified by the City Clerk, shall be filed in the office of 'the Recorder of ti-e County and recorded in the deed records of the County. SECTION 3. The determination, f inding and ordinance herein passed shall be conclusive unless attacked by bringing suit within thirty days hereafter, from the passage date of this ordinance. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are.hereby repealed, and it being necessary for the National Guard to obtain the use of this runway as soon as possible due to the national war emergency existing at this time in -- -- Iforea, an emergency is hereby declared and this ordinance shall be in full force and effect from and after its passage and approval.
