ORDINANCE NO. 9005
AN ORDINANCE GRANTING A LEASE TO ROSE THEATER, INC.,
QN..A CERTAIN PARCEL OF LAND OWNED BY THE CITY OF
LITTLE ROCK AND LOCATED CONTIGUOUS TO ROOSEVELT
• ROAD AND 285 FEET WEST OF BARBER AVENUE, IN THE CITY
OF LITTLE ROCK;-AUTHORIZING AND DIRECTING THE MAYOR
AND CITY CLERK TO EXECUTE A LEASE AGREEMENT ON THIS
PARCEL; DIRECTING THAT THE ANNUAL RENT CONTAINED IN
THE LEASE SHALL BE THREE HUNDRED ($300.00) DOLLARS,
WHICH SHALL BE PAID INTO THE GENERAL FUND OF THE
CITY OF LITTLE ROCK; DIRECTING OTHER PROVISIONS WHICH
SHALL BE CONTAINED IN THE LEASE; AND FOR OTHER PUR -
POSES .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. A lease is granted to Rose Theater, Inc.,
on a certain parcel of real property owned by the City of Little
Rock, located contiguous to Roosevelt Road and 285 feet West of
Barber Avenue, and more particularly described as follows:
Be inning at the Northeast (NE) corner of Lot One
(1�, Subdivision of Lot One (1), Block Four (�),
Watkins Addition, thence West along the North line
of said lot 285 feet for a point of beginning;
thence West along the North line of said lot as
projected a distance of 285 feet; thence North to
the South line of Roosevelt Road; thence East a-
long the South line of Roosevelt Road 285 feet;
thence South to the point of beginning.
SECTION 2. The Mayor and City Clerk are authorized
and directed to sign and execute on behalf of the City of Little
Rock, a lease of the above described property to Rose Theater,
Inc. The leaze shall include all the provisions contained in
this Ordinance.
SECTION 3. The annual rent provided in said lease
shall be Three Hundred ($300.00) Dollars, which shall be paid in
advance each year by Rose Theater, Inc., to the Collector of the
City of Little Rock, and credited to the General Fund of the
City of Little Rock.

SECTION 'T. If Rose Theater, Inc., is in default of
any of the provisions of the lease for ninety (90) days, the
lease may be cancelled at the option of the City of Little Rock.
SECTION 5. The term of the lease shall be Five (5)
years, and it may be extended upon the same provisions for an
additional term of Five (5) years at the option of Rose Theater,
Inc.
SECTION 6. The property herein described is to be used
for a driveway for entering and leaving adjacent property, and
for such other purposes as Rose Theater, Inc., gay desire, as
provided herein. If the use thereof as a driveway shall hereafter
be prohibited by law or ordinance, Rose Theater, Inc., may at
its option cancel the lease.
SECTION 7. Rose Theater, Inc., shall not obstruct any
natural drains existing on the property described herein, but
I' it is permitted to construct suitable passages over same.
SECTION 8. Upon the expiration of the lease, Rose
Theater, Inc., is to have the right to remove all improvernen is
which may be erected on said property, and it is to return the
property to the City of Little Rock in a clean and presentable
condition, provided however, that no buildings will be erected on
said property.
SECTION 9. All ordinances and parts of ordinances in
conflict herewith are repealed.
SECTION 10. This ordinance s�'-_ all take effect and be
