AN ORDINANCE GRANTING A LEASE TO ROSE THEATER, INC.,
ON A CERTAIN PARCEL OF LAND OWNED BY THE CITY OF
LITTLE ROCK AND LOCATED CONTIGUOUS TO ROOSEVELT

AND CITY CLERK TO EXECUTE A LEASE AGREEMENT ON THIS
PARCEL; DIRECTING THAT THE ANNUAL RENT CONTAINED IN
THE LEASE SHALL BE THREE HUNDRED (300.00) DOLLARS ,
WHICH SMALL BE PAID INTO THE GENERAL FUND OF THE
CITY OF LITTLE ROCK ;, DIRECTING OTHER PROVISIONS WHICH
SHALL BE CONTAINED IN THE LEASE; AND FOR OTHER PUR-
POSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. A lease is granted to Rose Theater, Inc.,
on a certain parcel of real property owned by the City of
Little Rock, situated in Pulaski County, Arkansas, and
located contiguous-to Roosevelt Road 285 Feet West of
Barber Avenue, and more particularly described as follows:
Beginning at the intersection of the West line of
Barber Avenue and the North line of Twenty Sixth
(26th) Street which is a street shown on the plat of
Watkins Addition to the City of Little Rock, said
plat being recorded in Mortgage Book AB 1-at page 84,
thence West 285 feet along the North line of said
Twenty Sixth (26th) Street for a point of beginning,
thence West along the North line of said Twenty Sixth
(26th) Street 285 feet to the Southwest (SW) corner of
the Southeast (SE J) Quarter of Section Eleven (11),
Township One (1) North, Range Twelve (12) West- thence
North to the South line of Roosevelt Road; thence Bast

South to the point of beginning.
SECTION 2. The Mayor and City Clerk are au-
thorised and directed to sign and execute on behalf of the
City of Little Rock, a lease of the above described property
to Rose Theater, Inc. The lease shall include all the
provisions contained in this Ordinance.

SECTION 3. The annual rent provided in said lease
shall be Three Hundred ($300.00) Dollars, which shall be

paid in advance -each year by Rose Theater, Inc., to the
Collector of the City of Little Rock, and credited to the
y .,. Geleral Fund of the City of Little Rook.

SECTION 4. If Rose Theater, Inc., is in default
of any of the provisions of the lease for ninety (90) days,
the lease may be cancelled at the option of the City of
Little Rock.
SECTION 5. The term of the lease shall be Five (5)
years, and it may be extended upon the same provisions for
an additional term of Five (5) years at the option of
Rose Theater, Inc.
SECTION 6. The property herein described is to
be used for a driveway for entering and leaving adjacent
property, and for such other purposes as Rose Theater, Inc.,
may desire, as provided herein. If the use thereof as a
driveway shall hereafter be prohibited by law or ordinance,
Rose Theater, Inc., may at its option cancel the lease.
SECTION 7. Rose Theater, Inc., shall not obstruct
any natural drains existing on the property -described herein,
but it is permitted to construct suitable passages over same.
SECTION 8. Upon the expiration of the lease,
Rose Theater, Inc., is to have the right to remove all
improvements which may be erected on said property, and
it is to return the property to the City of Little Rock
in a clean and presentable condition, provided however,
that no buildings will be erected on said property.

SECTION 9. All ordinances and parts of ordinances
in conflict herewith are repealed.
SECTION 10. This ordinance shall take effect
and be in force from and after its passage.
