THOMPSON, TRUSTEE, IISSOURI PACIFIC RAILROAD COMPANY, DEBTOR, HIS SUCCESSORS A %'D ASSIGNS, RIGHTS OF WAY ACROSS CERTAIN AVENUES, STREETS AND ALLEYS IN GRANITE PARK ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, AND IN RATTERREEtS ROCK ISLAND SHOPS ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LIT`T'LE ROCK: Section 1. Guy A. Thompson, Trustee, Missouri Pacific Railroad Company, Debtor, his successors and assigns, are hereby authorized to construct, maintain and operate spur tracks across Ohio Avenue, Kentucky Avenue, Tennessee Avenue, (Mississippi Avenue, Alabama Avenue, Georgia Avenue, Virginia Avenue, 35th Street, 36th Street, 37th Street, 38th Street, and all alleys between said avenues and streets, all situated in Granite Park Addition to the City of Little Rock, Arkansas; and across John Street, Allen Street, Hanger Street, College Street, 39th Street and all alleys between said streets, all situated in Ratterreets Rock Island Shops Addition to the City of Little Rock, Arkansas; said rights of way to be 40 feet in width across said streets and alleys situated in Ratterreets Rock Island Shops Addition to the City of Little Rock, and to be 15 feet in width across said avenues, streets and alleys situated in Granite Park Addition to the City of Little Rock, y r�xlarly described and set forte ��n �ats�3 i'acifie - Railroad Map, File No. 29 -60 -3, dated -9�a- tobox -29. I-952, which is attached hereto and made a part hereof, as though set-out and described herein in full, and identified as ix A.,,. Section 2. Said Trustee, his successors or assigns, shall main- tain said tracks so that the top of the rails shall be on a level with the grade of the street as now or hereafter established and shall be built and maintained so as not to interfere with any waterway or flow of same, and the City shall have the right to alter said grade at its pleasure without responsibility to the Trustee, his successors or assigns. The Trustee, his successors or assigns, shall also maintain Page Two the surface of the streets between the rails of said tracks and on said rights of way of the same materials of which said streets are now, or hereafter may be, constructed at said points. Section 3. The use of said tracks shall be in such manner as to not interfere with the usual traffic along said avenues, streets and alleys. Section 4. For this grant, the said Trustee, his successors or assigns, shall pay to the City of Little Rock the sum of Twenty -five (.�25.00) Dollars per annum, payable annually in advance. Section 5. This grant shall be and remain in force and effect for a period of fifty (50) years from and after the date of the acceptance of this Ordinance for the Trustee of the Missouri Pacific Railroad Company, Debtor, provided the same is accepted within ninety (90) days after its passage.
