HomeMy WebLinkAbout9126ORDINANCE NO. 9126 AN ORDINANCE TO PROVIDE FOR INSPECTION FEES OF PRIVATELY KEPT COWS AND GOATS, RETAIL AND WHOLESALE RAW DAIRIES AND MILK PLANTS; TO REPEAL ORDINANCES NO. 4017, 4585, 4857 AND 7359, AND FOR 011MR PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SEC'T.LON 1. Ordinances No. 4017, 4585, 4857 and 7359 are hereby repealed in their entirety. SECTION 2. Every person required to obtain a permit from the City Collector of the City of Little Rock under the provisions of Ordinances No. 2811 and 3861 shall pay to the City Collector a premise inspection fee of Two Dollars and Fifty Cents ($2.50) not later than the 10th of June of each and every year thereafter. SECTION 3. Every person operating a retail raw milk dairy under the jurisdiction of the City of Little Rock shall pay to the City Collector of the City of Little Rock an inspection fee equivalent to the sum of One Dollar ($1.00) per head of all adult cattle in the herd at the time the permit is issued, and shall pay a like amount on the 10th day of June on each and every year thereafter, provided, however, that in no instance stall the amount paid be less than Twenty -Five Dollars ($25.00) per annum. SECTION 4. Every person or firm or corporation selling milk to or producing milk for pasteurizing, homogenizing, bottling, or other plants where milk is prepared for sale to the consumer within the City of Little Rock shall pay an inspection fee to the City of Little Rock in the sum of One and One -Half Cents (1QyC) for each 100 pounds of milk sold or produced by such person, firm or corporation to or for such pasteurizing, homogenizing, bottling or other plants. Such plants purchasing or receiving milk shall collect from the seller or the producer of the milk the above - stated inspec- tion fee of One and One -Half Cents for each 100 pounds of milk from the person, firm or corporation selling or producing the milk to or for such pasteurizing, homogenizing, bottling or other plants. The purchaser shall keep an accurate record of same and remit such money R . I -2- or moneys to the City Collector of the City of Little Rock not later. than the 10th day of each month after the effective date of ;this ordinance. The permit heretofore issued by the City of Little Rock to any pasteurizing, homogenizing, bottling or other plants within the inspection jurisdiction of the City of Little Rock which fails or neglects to make such collections and remit same to the City Collector of the City of Little Rock as herein provided, shall be revoked by operation of law, and such person, firm or corporation shall be prohibited from carrying on or doing business in the City of Little pock. In no event shall the amount paid by any producer be less than Five Dollars ($5.00) per year. SECTION 5. Every person, firm or corporation operat- ing a milk plant or place where milk or milk products are pasteurized, homogenized, mixed, condensed or bottled, or other- wise prepared for sale to the consumer shall pay to the City Collector each month on or before the 10th day of each month for the preceding calendar month an inspection fee of Two Cents (2¢) on each one hundred (100) pounds of milk received, and shall pay Two Cents (2�) on each 100 pounds of recombined milk, skim milk or other milk product manufactured for bottling purposes. The fee to be paid for sweet cream shall be Twenty Cents (20�) for each 100 pounds of cream received by the plant to be used for bottling purposes, provided, no fee shall be paid on milk products used in the manufacture of ice -cream mix. Such person, firm or corporation shall on or before the 10th day of the month file with the City Health Officer, on a form furnished by him, a statement of the number of pounds of milk, milk products and cream received during the preceding month and the classified usage of the milk and sweet cream according to the provisions of Ordinances No. 7023 and 7221 setting up classified usage. SECTION 6. In no event shall the inspection fee charged to any plant or place where milk or milk products are pasteurized, condensed or bottled be less than One Hundred Dollars ($100.00) per annum. SECTION 7. All fees herein provided for shall be paid -3- to the City Collector and shall be used wholly for the expense of carrying out the provisions of this ordinance and other ordinances pertaining to milk inspection and control. The fees provided in Sections 4 and 5 shall be based on the actual net weight of all the milk and milk products received. The original weight sheets and all other records pertain- ing to the amount of milk and /or milk products produced, received or manufactured shall be made a vailable to the City Health Officer and /or the City Collector for the determination of this fee. All milk and milk products shall be purchased by weight; the purchase of milk, cream and milk products by measure is prohibited. SECTION 8. It shall be the duty of the City Collector to notify the Health Officer of any person who fails, neglects or refuses to pay the above fees within the specified time; and the Health Officer is hereby directed and empowered to withdraw all inspection service from any establishment until such fees are paid in full and to prohibit such persons from distributing, buying, selling or otherwise operating a plant handling milk or milk products in the City of Little Rock. SECTION 9. Any person, firm or corporation violating the provisions of this ordinance, upon conviction thereof, shall- be fined not less than Twenty -Five Dollars ($25.00) nor more than One Hundred Dollars ($100.00) and each day of such violation shall constitute a separate offense. SEC TI ON 10. All ordinances and parts of ordinances in conflict herewith are hereby repealed, and since it is necessary to the health, welfare and safety of the citizens of Little Rock that the inspections provided for herein begin as promptly as possible and that revenue be provided for paying inspectors, an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage and approval.
