AN ORDINANCE VACATING AND ABANDONING THE NORTH FIVE FEET
AND THE SOUTH FIVE FEET OF "A" STREET BETWEEN ROSE STREET
AND WALNUT STREET IN.-THE.-CITY OF LITTLE ROCK, ARKANSAS;
AND FOR OTHER PURPOSES
WHEREAS, a petition was duly filed with the City Council
of the City of Little Rock, Arkansas, on the 25th day of May, 1953,
asking the City Council to vacate and abandon those portions of
"A" Street designated as follows:
and,
(1) The North five (5) feet of "A" Street, lying
immediately South of Block 5, Glendale Addition
to the City of Little Rock, bounded on the East
by Rose Street and bounded on the West by Walnut
Street, being designated as Water Street on the
Plat of Glendale Addition to the City of Little
Rock, as the same appears of record in Book 1,
Pale 5, of the Plat Records in the office of the
Circuit Clerk and Ex- officio Recorder of Pulaski
County, Arkansas, Rose Street and Walnut Street
being designated as Cedar Street and Pine Street,
respectively, on said Plat.
(2) The South five (5) feet of "A" Street, lying
immediately North of Block 8, Glendale Addition
to the City of Little Rock, as the same appears
of record in Book 1, Page 5, of the Plat Records
in the office of the Circuit Clerk and Ex- officio
Recorder of Pulaski County, Arkansas, said Street
being designated as Water Street on said Plat; said
strip being bounded on the East by Rose Street and
bounded on the West by Walnut Street and lying
immediately North of Blankinship's Resubdivision
of Block 8, Glendale Addition to the City of Little
Rock, as the same appears of record in Book 1, Page
278, of the Plat Records in the office of the Circuit
Clerk and Ex- officio Recorder of Pulaski County,
Arkansas;
WHEREAS, after due notices as required by law, the Council
has, at the time and place mentioned in the notice, heard all per-
sons desiring to be heard on the question and has ascertained that
the portions of the street, hereinabove described, have heretofore
been dedicated to the public use as a street herein described; have
not been actually used by the public generally for a period of at
least five years subsequent to the filing of said plats and /or a
period of at least five years prior to May 25, 1953; that all the
owners of the property abutting upon the portions of the street
to be vacated have filed with the Council their written consent
to such abandonment; and that public interest and welfare will not
be adversely affected by the abandonment of such portions of said
street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to those portions of "A"
Street designated as follows:
(1) The North five (5) feet of "A" Street, lying
immediately South of Block 5, Glendale Addition
to the City of Little Rock, bounded on the East
by Rose Street and bounded on the West by Walnut
Street, being designated as Water Street on the
Plat of Glendale Addition to the City of Little
Rock, as the same appears of record in Book 1,
Page 5, of the Plat Records in the office of the
Circuit Clerk and Ex- officio Recorder of Pulaski
County, Arkansas, Rose Street and Walnut Street
being designated as Cedar Street and Pine Streea
respectively, on said Plat.
(2) The South five (5) feet of "A" Street, lying
immediately North of Block 8, Glendale Addition
to the City of Little Rock, as the same appears
of record in Book 1, Page 5, of the Plat Records
in the office of the Circuit Clerk and Ex- officio
Recorder of Pulaski County, Arkansas, said Street
being designated as Water Street on said Plat; said
strip being bounded on the East by Rose Street and
bounded on the West by Walnut Street and lying
immediately North of Blankinship's Resubdivision
of Block 8, Glendale Addition to the City of Little
Rock, as the same appears of record in Book 1, Page
278, of the Plat Records in the office of the Circuit
Clerk and Ex- officio Recorder of Pulaski County,
Arkansas.
Section 2. A copy of this ordinance duly certified by
the City Clerk of the City of Little Rock, Arkansas, shall be filed
in the office of the Recorder of Pulaski County, Arkansas, and
recorded in the Deed Records of said County.
Section 3. This ordinance shall take effect and be in
force from and after its passage.
