AN ORDINANCE TO VACATE AND ABANDON A PORTION
OF EAST 16th STREET AND PORTIONS OF AN UNNAMED
STREET, THE LATTER RUNNING NORTH AND SOUTH
THROUGH BLOCK 15, DODGE ADDITION TO THE CITY
OF LITTLE ROCK, ARKANSAS, AND BETWEEN EAST 16th
STREET AND EAST 17th STREET, AND FOR OTHER PURPOSES.
WHEREAS, a petition was duly filed with the City Council of the
City of Little Rock, Arkansas, on the 23rd day of July, 1953) asking the City
Council to vacate and abandon a portion of East 16th Street and portions of
an unnamed street, the latter running north and south through Block 15, Dodge
Addition to the City of Little Rock, Arkansas, and lying within the following
description:
and
Begin at the northwest corner of Lot A, Block 15, Dodge
Addition thence run north across E. 16th Street to the north line
of East 16th Street, thence west along said north line to the
southwest corner of Lot 7, Block 10, Dodge Addition, thence
southeasterly to a point 30 feet due west of the northwest corner
of Lot A of said Block 15, thence east 30 feet to the point of
beginning, and
The East 30 feet and the West 10 feet of an unnamed street
which runs north and south through Block 15, Dodge Addition to
the City of Little Rock from the south line of East 16th Street
to the north line of East 17th Street;
WHEREAS, after due notice as required by law the Council has at the
time and place mentioned in the notice heard all persons desiring to be heard on
the question and has ascertained that the portion of East 16th Street and the
portions of the said unnamed street above described have heretofore been dedi-
cated to the public use and have not been used by the public generally for a
period of over five years subsequent to the filing of the plats and have not been
actually used by the public as a street or alley for the five-year period im-
mediately prior to the filing of the aforesaid petition and are not now so used;
that all of the owners of the property abutting upon said streets and upon the
portions of said streets to be vacated have joined in said petition and have
thereby filed with the Council their written consent to such abandonment and that
the public interest and welfare will not be adversely affected by the abandonment
of such portions of streets;
and
WHEREAS, with said petition there has been filed a photostatic copy
of the replat of Block 15 of Dodge Addition, recorded in Plat Book 1, at page
276, which shows the aforesaid unnamed street, and a photostatic copy of the
plat of Dodge Addition, recorded in Plat Book AB, at page 225, which shows East
16th Street, and has also filed an engineerts drawing showing the exact portions
of said unnamed street and of East 16th Street to be closed;
and
WHEREAS, the Council finds that with the dedication and replat of
Block 15, Dodge Addition, there is a statement to the effect that the street
hereinabove referred to as an "unnamed street" should be called Dodge Street,
but that on no plat or map has it been so designated, and that on all maps
of the City the street immediately east of and adjoining Block 15 has been
designated as Dodge Street; the Council further finds that it is proper in this
ordinance to refer to the street in question as an "unnamed street ".
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:

SECTION 1. The City of Little Rock, Arkansas, hereby releases,
vacates, and abandons all its rights together with the rights of the public
generally in and to the following portions of the following streets, to wit:
Begin at the northwest corner of Lot A, Block 15, Dodge
Addition, thence run north across E.16th Street to the north line
of East 16th Street, thence west along said north line to the
southwest corner of Lot 71 Block 10, Dodge Addition, thence south-
easterly to a point 30 feet due west of the northwest corner of
Lot A of said Block 15, thence east 30 feet to the point of begin-
ning, and
The East 30 feet and the West 10 feet of an unnamed street
which runs north and south through Block 15, Dodge Addition to the
City of Little Rock from the south line of East 16th Street to the
north line of East 17th Street.
The above described portions of said unnamed street are shown on the
repl.a.t of Block 15 of Dodge Addition to the City of Little Rock, recorded in
Plat Book 1, at page 276, of the Records of Pulaski County, Arkansas, and the
above described portion of East 16th Street is shown on the plat of Dodge Addition
to the City of Little Rock, recorded in Book AB, at page 225, of the Records of
Pulaski County, Arkansas, on file in the office of the Recorder of Pulaski County.
SECTION 2. A copy of this Ordinance, duly certified by the City
Clerk, shall be filed in the office of the Recorder of Pulaski County and
recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in force from
and after its passage.
