HomeMy WebLinkAbout9530ORDINANCE NO. 9530 AN ORDINANCE VACATING AND ABANDONING THE ALLEY RUNNING THROUGH BLOCK ONE, PATRICK POWERS ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, a petition was duly filed with the City Council of the City of Little Rock, Arkansas on the 19th day of March, 1954 requesting the City Council to vacate and abandon the alley sixteen feet wide running through Block One, Patrick Powers Addition to the City of Little Rock, Arkansas, and being abutted on the East by Lots One to Six, inclusive, and on the West by Lots Seven to Twelve, inclusive, of said Block, the alley appearing on the plat of Patrick Powers Addition to the City of Little Rock, Arkansas, now appeartof record in the office of the Recorder of Pulaski County, Arkansas; and WHEREAS, after due notice as required by law the City Council has, on the day and at the place mentioned in the notice; heard all persons desiring to be heard on the question and has ascertained that the alley hereinabove described has heretofore been dedicated to the public use as An alley but has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat and for a period of at least five years immediately preceding the filing of the petition and the date of the passage of this ordinance; that the owners of all of the property abutting upon the alley to be vacated have filed with the City Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas hereby releases, vacates and abandons all its righ14 together with the rights of the public generally, in and to the alley designated as follows: The alley sixteen feet wide, running North and South through the center of Block One, Patrick Powers Addition to the City of Little Rock, Pulaski County, Arkansas, being abutted on the East bylLot.a One to Six, inclusive, and on the West by Lots Seven to Twelve, inclusive, of said Block, the alley appearing on the plat of Patrick Powers Addition in the office of the Recorder of Pulaski County, Arkansas. SECTION 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of the County and recorded in the Deed Records of Pulaski County, Arkansas. SECTION 3. This ordinance shall take effect and be in force from and after its passage. PASSED; April 26, 1954 ATT s City Clerk. APPROVE Mayor.
