HomeMy WebLinkAbout9651ORDINANCE NO. 9651 AN ORDINANCE RELATING TO THE ACQUISITION, CLEARANCE AND REDEVELOPMENT OF THAT BLIGHTED AREA IN THE CITY OF LITTLE ROCK, ARKANSAS. DESCRIBED IN THE GRANITE MOUNTAIN REDEVELOPMENT PLAN, PROJECT UR ARK 1 -2, PROJECT NO. 2, BY THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK, ARKANSAS; APPROVING THE REDEVELOPMENT PLAN THEJi AND FOR OTHER PURPOSES. r e ,g S, under the provisions of Title I of the Housing Act of- as amended prior to August 2, 1951., the Housing and Home Finance Administrator is authorized to provide financial assistance to local public agencies for undertaking and carrying out slum clearance and urban redevelopment projects; and WHEREAS, it is provided in such Act that contracts for finan- cial aid thereunder shall require that the redevelopment plan for the respective project areas be approved by the governing body of the locality in which the project is situated and that such approval include findings by the governing body that (1) the financial aid to be provided in the contract is necessary to enable the land within the project area to be redeveloped in accordance with the redevelopment plan; (2) the redevelopment plans for the redevelop- ment areas in the locality will afford maximum opportunity, consis- tent with the sound needs of the locality as a whole, for the redevelopment of such areas by private enterprise; and (3) the redevelopment plan conforms to a general plan for the :,;,development of the locality as a whole; and WHEREAS, the Housing Authority of the City of Little Rock, Arkansas (herein called the "Local Public Agency ") has applied for financial assistance under such Act with the United States of America, acting by and through the Housing and Home Finance Admin- istrator, pursuant to which Federal funds are provided for the slum clearance and urban redevelopment project (herein called the - 2 - "Project ") _identified as "Granite Mountain Redevelopment Project, No. UR ARK 1 -2, Project No. 2" and encompassing the following des- cribed blighted area: "Beginning at the southeast corner of Section 14, T -1 -N, R -12 -W, thence north 880 51' 30" west, 986 feet.to a point; thence north 10 08' 30" east, 758 feet to a point; thence north 810 04' 30" east, 182.8 feet to a point; thence north 620 54' 30" east, 338.2 feet to a point; thence north 380 12' 30" east, 112.8 feet to a point; thence north 9° 53' 30" east, 300.9 feet to a point; thence south 890 16' 30" east, 228.8 feet to a point; thence north 10 45' 30" east, 260.2 feet to a point; thence south 890 04' east, 992.8 feet to a point; thence north 00 48' east 80 feet to a point; thence south 890 04' east, 700 feet to a point, thence south 00 48' west, 2,606.7 feet more or less to a point on the south line of U. S. Highway No. 65; thence north 790 17' west along the south right -of -way line of U. S. Highway No. 65, 697.7 feet to a point; thence continue along the right -of -way line north 740 55' west, 100.0 feet to a point; thence continue along the right -of -way line north 540 46' west, 100.0 feet to a point; thence continue along the right -of- way line north 340 06' west, 100.0 feet to a point; thence continue along the right -of -way line north 180 08' west, 70.1 feet to a point; thence north 140 55' west along the west right -of -way line of U.S. Highway No. 65, 603.8 feet to a point on the south line of Section 132 T -1 -N, R -12 -W; thence north 890 12' west along the south line of Section 13, 429.6 feet to the point of beginning, - 3 - in the City of Little Rock, County of Pulaski, State of Arkansas, (herein called the "Locality "); and WHEREAS, the Local Public Agency proposes to apply for addi- tional financial assistance under such Act and to enter into an additional contract or contracts with the Housing and Home Finance Administrator making available additional financial assistance for the Project; and WHEREAS, there has been prepared and referred to the City Council of the Locality (herein called the "Governing Body ") for review and approval a redevelopment plan, with supporting data, for the Project area, identified as "The Redevelopment Plan, Project No. UR ARK 1 -2, Granite Mountain ", as approved by Resolution of the Local Public Agency and duly certified by the executive officer thereof on the 22nd day of September, 1954; and WHEREAS, said Local Public Agency has certified that pursuant to public notice duly given by publication in the Arkansas Democrat on the 8th and 15th days of September, 1954, and in the Arkansas Gazette on the 9th and 16th days of September, 1954, it held a public hearing on the proposed undertaking and Redevelopment Plan at the City Council Chambers, City Hall, Little Rock, Arkansas on the 22nd day of September, 1954, at 8:00 o'clock p. m. at a special meeting of said Local Public Agency duly convened for such purpose and heard all persons appearing at such public hearing who desired to be heard and gave full consideration to the matters and things presented at such public hearing; and WHEREAS, this Council having duly considered said Redevelopment Plan and supporting data and being fully advised in the premises hereby determines that the findings, determinations and action herein made, taken and authorized are in the public interest and for the protection of the health, safety, morals and welfare of this community, and all in accordance with the Charter of the City of Little Rock, Act 212 of the General Assembly of the State of Arkansas of 1945, and Act 298 of the General Assembly of the State - 4 - of Arkansas of 1937, as amended; and WHEREAS, there has heretofore been presented to and approved by the Governing Body a redevelopment plan for the Dunbar Redevel- opment Project, No. UR ARK 1 -1, Central Area, as modified; and WHEREAS, a general plan has been prepared and is recognized and used as a guide for the general development of the Locality as a whole; and WHEREAS, the Planning Commission of the City of Little Rock, Arkansas, which is the duly designated and acting official planning body for the Locality, has submitted to the Governing Body its report and recommendations respecting the redevelopment plan for the Project Area and has certified that said redevelopment plan conforms to the said general plan for the Locality as a whole, and the Governing Body has duly considered said report, recommendations and certification of the planning body; and WHEREAS, said redevelopment plan for the Project area pre- scribes certain land uses for the Project area and will require, among other things, changes in zoning, the vacation and removal of streets, alleys, easements and other public ways, the establishment of new street patterns, and other public action; and WHEREAS, it is necessary that the Governing Body take appro- priate official action respecting the redevelopment plan for the Project, in conformity with the contract or contracts for finan- cial assistance between the Local Public Agency and the Housing and Home Finance Administrator: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That it is hereby found and determined that said Project area in said Locality as described in said redevelopment plan and as set forth herein in a blighted area as defined by Act No. 212 of the Acts of the General Assembly of the State of - 5 - Arkansas for the year 19+5; that the slum conditions existing therein are detrimental to the safety, health, morals and welfare of the inhabitants of said Locality; that said Project area should be acquired by said Local Public Agency and such conditions eliminated and said redevelopment plan carried out in the public interest. SECTION 2. That the redevelopment plan for the Project afore- mentioned, having been duly reviewed and considered, is hereby approved. SECTION 3. That it is hereby found and determined (a) that such redevelopment plan for the Project area conforms to said general plan of the Locality; (b) that said redevelopment plan in all applicable particulars fully and satisfactorily (1) indicates its relationship to definite local objectives as to appropriate land uses and improved traffic, public transportation, public utilities, recreational and community facilities and other public improvements, (2) indicates proposed land uses and building require- ments in said Redevelopment Area, and (3) indicates the method for the temporary relocation of persons living in said Redevelopment Area and the method of providing decent, safe and sanitary dwell- ings substantially equal in number to the number of sub - standard dwellings to be cleared from said Redevelopment Area at rents within the financial reach of the income groups to be displaced from such sub - standard dwellings. SECTION 4. That it is hereby found and determined that the financial aid provided and to be provided pursuant to said contract or contracts for financial assistance pertaining to the Project is necessary to enable the land in the Project area to be redeveloped in accordance with the redevelopment plan for the Project area. SECTION 5. That it is hereby found and determined that the above - mentioned redevelopment plans for the redevelopment areas in the Locality will afford maximum opportunity, consistent with the sound needs of the Locality as a whole, for the redevelopment of such areas by private enterprise. SECTION 6. That in order to implement and facilitate the effectuation of the redevelopment plan hereby approved it is found and determined that certain official action must be taken by this body with reference, among other things, to changes in zoning, the vacation and removal of streets, alleys, easements and other public ways, the establishment of new street patterns, and other public actions, and, accordingly, this body hereby: (a) pledges its co- operation in helping to carry out such redevelopment plan; (b) requests the various officials, departments, boards and agencies of the Locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with said redevelopment plan; and (c) stands ready to consider and take appro- priate action upon proposals and measures designed to effectuate said redevelopment plan. SECTION 7. That additional financial assistance under the provisions of Title I of the Housing Act of 1949, as amended prior to August 2, 1954, is necessary to enable the land in the Project area to be redeveloped in accordance with the redevelopment plan for the Project area and, accordingly, the filing by the Local Public Agency of an application or applications for such financial assistance under Title I of the Housing Act of 1949, as amended prior to August 2, 19540 is hereby approved. SECTION 8. That it is hereby found and determined that there are slum conditions existing in the blighted area hereinabove des- cribed which are detrimental to the safety, health, morals and welfare of the inhabitants of the Locality; and this Ordinance being necessary for the immediate preservation of the public peace, health, I� - 7 - morals, safety and welfare, an emergency is therefore declared to exist and said Ordinance shall be in full force and effect immed- iately upon its passage and approval.
