ORDINANCE NO. 9718
AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY ATTOR-
NEY OF THE CITY OF LITTLE ROCK, ARKANSAS TO INSTITUTE
PROCEEDINGS TO CONDEMN LOTS 3 AND 4, BLOCK 76, INDUS-
TRIAL PARK ADDITION, ANNEX NO. 1, TO THE CITY OF
LITTLE ROCK, ARKANSAS, FOR PUBLIC USE BY THE LITTLE
ROCK MUNICIPAL AIRPORT COMMISSION IN THE CONSTRUCTION,
EKTENSION,.AND PROPER OPERATION OF THE LITTLE ROCK
MUNICIPAL AIRPORT; AND FOR OTHER PURPOSES.
WHEREAS, the Little Rock Municipal Airport Commission by
resolution has duly declared, and the City Council of the City
of Little Rock, Arkansas hereby finds that acquisition by the
City of Little Rock, Arkansas of Lots Three (3) and Four (4),
Block Seventy -Six (76), INDUSTRIAL PARK ADDITION, Annex No. 1,
to the City of Little Rock, Arkansas is in the public interest
and necessary for public use in the construction, extension,
and proper operation of a Municipal Airport for the City of
Little Rock, Arkansas; and
WHEREAS, said City, through the Little Rock Municipal
Airport Commission, has endeavored to acquire said lands by
negotiations with the owners thereof but has been unable to do
so; and
WHEREAS, said Airport Commission has ample funds on hand
with which to acquire said lands in the name of said City;.
Now, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the City Attorney of the City of Little
Rock, Arkansas be and he is hereby authorized and directed to
institute appropriate proceedings to condemn in the name of
the City of Little Rock, Arkansas for public use in the con-
struction, extension, and proper operation of a Municipal Air-
port for the City of Little Rock, Arkansas Lots Three (3) and
Four (4), Block Seventy -Six (76), INDUSTRIAL PARK ADDITION,
Annex No. 1, to the City of Little Rock, Arkansas.
SECTION 2. That the City Attorney's Office is further
directed to secure a court order allowing the City to take
immediate possession of the aforesaid property upon its post-
ing bond in an amount to be determined by the Court. The City
Attorney's Office is further authorized to have posted in behalf

of the City a bond in the amount determined by the Court pending
determination of the condemnation proceedings.
SECTION 3. That all ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION 4. That it is hereby found and declared to be a
fact that acquisition of said lands by the City of Little Rock,
Arkaxaas is immediately necessary in order to eliminate exist-
ing hazards to aircraft and the public. An emergency is there-
fore declared to exist and this measure being necessary for
preservation of the public peace, health and safety, shall be-
come effective immediately upon its passage and approval.
