HomeMy WebLinkAbout9793ORDINANCE NO. 9793 AN ORDINANCE APPROVING REVISED RATE SCHEDULE N0, 4 OF THE LITTLE ROCK MUNICIPAL WATER 4ORKS OF THE CITY OF LITTLE ROCK; FIXING THE EFT�CTIVE DATE OF THE SC=ULE; AND FOR OTHER PURPOSES. 1P91EREAS, the Board of Commissioners of the Little Rock Municipal Water Works of the City of Little Rock, Arkansas, proposes to make improvements to the waten%rorks system of the City of Little Rock, which improvements will be financed by the issuance of Water Revenue Bonds within eighteen (18) months of the effective date of this Ordinance; and V&DMEAS, said Board of Commissioners has advised the City Council that a rate revision to produce $700,000.00 additional annual revenue is needed in order to finance the construction of the proposed improvements and provide for the proper operation and maintenance of the waterworks system; and W EMS, the City Council finds that the rates now being collected are sufficient only to meet the rate requirements of Section 8 of Act 131 of the Acts of the General Assembly of the State of Arkansas for the year 1933, as amended, but does not produce sufficient revenue to finance the proposed improvements to the waterworks system; and WHEREAS, the City Council finds that the sums to be realized from -the rate schedule hereinafter established in this Ordinance,.are necessary to lr ovide funds for the proper operation and maintenance of the waterworks system in accordar_ce with the foregoing law of the State of Arkansas, and for the purposes aforesaid, and the distribution of said charges among the various classes of consumers is fair, just and reasonable and is non - discriminatory among the various individual consumers in each classification; and WFItcF.,AS, Ordinance No. 9765 of the City Council of the City of Little Rock, Arkansas, enacted by the City Council on February 14, 1955, fixed the same schedule of rates as hereinafter set out, said rates to become effective on all bill- ings on the 1st day of April, 1955; and WHEREAS, the City Council at the time of enactment of said Ordinance had no authority to prescribe a schedule of rates for non - resident consumers, but does now have said power by virtue of the authority delegated by the Legislattre of the State of Arkansas in Act 321 of the Acts of the General Assembly of the State of Arkansas for the year 1955, Which became law on the 21st day of March, 1955• NOW, T: -MEFORE, BE IT ORDAINM BY TIC CITY COUNCIL OF THE CITY OF LIT'T'LE ROCK, ARKANSAS: SECTION 1. The following schedule of rates is hereby established: F s EXHIBIT »Art REVISED RATE SCHEDULE N0. 4 OF THE LITTLE ROCK MUNICIPAL WATER WORKS APPLICATION. This schedule is applicable* to all water and water service supplied by the Little Rock Municipal Water Works from and after the effective date hereof. *This schedule does not apply to special service contracts. METER MEASUREMENT. All water and water service supplied by the Little Rock Municipal Water Works shall be measured through meters, except that used from Fire Hydrants for the prevention and extinguishment of fires, and that reasonably necessary for flushing of streets and sewers, testing of fire hydrants, and practice of city firemen. RATES: RESIDENT CONSUMERS METERED SERVICE Subject to the meter minima and penalties hereinafter set out, the follow- ing rates shall apply to all measured water service, for customers residing within the Corporate Limits of the City of Little Rock. Per 100 Cubic Feet For the first 3,300 cubic feet per month, or less 32 cents For the next 30,000 cubic feet per month, or any part thereof 28 cents For the next 90,000 cubic feet per month, or any part thereof 20 cents For the excess of any quantity over 123,300 cubic feet per month 11 cents NOTE: -- One cubic foot of water is equivalent to 72 gallons weighing 622-' pounds avoirdupois. All water used by the City of Little Rock and not included in the water furnished under the Public Fire Service Clause hereof shall be metered and paid for at the rate of 6. 75¢ per hundred cubic feet, and shall not be subject to the meter minima. Meter 158.95 PUBLIC FIRE SERVICE The City of Little Rock shall pay to the Little Rock Municipal Water Works for the privilege of taking water from fire hydrants for the prevention and extinguish- ment of fires, and that reasonably necessary for the flushing of streets, and sewers, testing fire hydrants, and the practice of City firemen, a fire hydrant rental of $23.33 per hydrant per year. NON — RESIDENT CONSUMERS Subject to the meter minima and penalties hereinafter set out, the following rates shall apply to all measured water service for non — resident consumers. For the excess of any quantity over 123000 cubic Per 100 Cubic Feet For the first 3,300 cubic feet per month, 622 or less 40 cents For the next 30,000 cubic feet per month, or any part thereof 35 cents For the next 90,000 cubic feet per month, The minimum monthly bill shall be or any part thereof 25 cents For the excess of any quantity over 123000 cubic feet per month 11 cents NOTE: --One cubic foot of water is equivalent to 72 ballons weiLhi.ng 622 pounds avoirdupois. X37.50 per year PAYMENT. BILLING All bills shall be computed and rendered monthly. Payments for private fire service are to be made in equal semi - annual installments in advance on the first day of January and July. All annual rates for public fire service shall be payable in twelve monthly installments by the City of Little Rock on or before the t: ^rentieth (20th) day of each month for service furnished the preceding month. P'.�'�TALTY AND DISCONTINUANCE OF SERVICE Vffiere water bills are not paid before the twentieth (20th) day following the original date of billing, a ten per cent (10%) penalty shall be added to the original bill. If the bills are not paid within thirty days from rendition, service shall be disconnected from the grater system. ..FF:7CTIVE DATE OF SCFM-,ULE. This schedule shall becone effective on all billings on the first day of April, 1955. SECTIOPI 2. All ordinances, parts of ordinances, establishing rate schedules for water or vrater service, supplied or to be supplied, by the City of Little Rock through its municipal water works system, be and the same are hereby repealed, set aside and held for naught. SECTION 3. If arZr portion of this ordinance is for any reason held to be unconstitutional or iriralid, such holding shall not affect the validity r of the remaining portions of the ordinance. SECTIC?J 4. It is found to be a fact that the Proper operation, maint- enance and impro- cement of the municipal waterworks system of the City of Little Rock is being seriously hampered and delayed because of inadequate rates and that an adequate and healthful water supply for the City of Little Rock is thereby endangered, thus threatening the health and irTelfare of all consumers of said waterviorks system, and an emergency is thereby created and is hereby declared, and this Ordinance, being necessary for the i=ediate preservation of the public welfare, peace, health and safety, shall be in full force and effect from-and after its passage and approval.
