HomeMy WebLinkAbout9806ORDINANCE No 9806 AN ORDINANCE TO ABANDON AND VACATE A PORTION OF THE ALLEY IN BLOCK 41j BRAGGIS SECOND ADDITION TO THE CITY OF LITTLE ROCS, ARKANSAS. Whereas, a petition was filed with the City Council of the City of Little Rock, Arkansas on the 24 day of March , 1955, asking the City Council to vacate abd abandon the hereinafter described portion of the alley in Block 411 Bragg's Second Addition to the City of Little Rock, now appearing of record in Plat 2.9 1496:44, in the office of the Recorder of Pulaski C'ei*k, Arkansas, Whereas, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring,to be heard on the question and has ascertained that the portion of the Vtay hereinbefore mentioned has heretofore been dedicated to the public use as.an alley herein described but has not actually beea� at least used by the public for a period of/tive years prior to the filing of the petition ; - that the owner of the property abutting upon the portion of the alley to be vacated C- c� has filed with the Council his Written consent to such abandonment; and that the public ra interest and welfare will not be adversely affected by the abandonment on the alley. NOW, THEREFORE, be it ORDAINED by the City Council of the City of Little Rock., i ,. Arkansas: SECTION 1. The City of Little Rock hereby releases, vacates, and abandons all of its rights together with the rights of the public generally, except the rights and needs of public utilities to ingress and egress to maintain and use present utility lines located therein and thereon, in and to the alley designated as follows: That portion of the alley 20 feet in width running north and south in that part of Block 414 Braggts Second Addition to the City of Litttle Rock, lying north of East Rooevelt Roadv SECTION 2. A copy of this ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the deed records of the County. SECTION 3.
