HomeMy WebLinkAbout9991ORDINANCE NO. 9991 AN ORDINANCE RELATING TO THE ACQUISITION, CLEARANCE AND REDEVELOPMENT OF THAT BLIGHTED AREA IN THE CITY OF LITTLE ROCK, ARKANSAS DESCRIBED IN THE PHILANDER SMITH REDEVELOPMENT PLAN, PROJECT ARK R -1, BY THE HOUSING AUTHORITY OF THE CITY OF LITTLE ROCK, ARKANSAS; APPROVING THE REDEVELOPMENT PLAN THEREFOR; AND FOR OTHER PURPOSES. WHEREAS, under the provisions of Title I of the Housing Act of 1949, as amended by the Housing Act of 1954, the Housing and Home Finance Administrator is authorized to provide financial assistance to local public agencies for undertaking and carrying out slum clearance and urban redevelopment projects; and WHEREAS, it is provided in such Act that contracts for financial aid thereunder shall require that the Redevelopment Plan for the respective project areas be approved by the governing body of the locality in which the project is situated and that such approval include findings by the governing body that (1) the financial aid to be provided in the contract is necessary to enable the land within the project area to be redeveloped in accordance with the Redevelopment Plan; (2) the Redevelopment Plans for the redevelopment areas in the locality will afford maximum opportunity, consistent with the sound needs of the locality as a whole and in the public interest for the redevelopment of such areas; and (3) the Redevelopment Plan conforms to a general plan for the develop- ment of the locality as a whole; and WHEREAS, the Housing Authority of the City of Little Rock, Arkansas (herein called the "Local Public Agency ") has applied for financial assistance under such Act and has entered into a contract with the United States of America., acting by and through the Housing and Home Finance Administrator, pursuant to which Federal funds are provided for the slum clearance and urban redevelopment project (herein called the "Project ") identified as "Philander Smith Redevelopment Project, No. ARK R -1" and encompassing the fol- lowing described blighted area: - 2 - Beginning at the northeast corner of the intersection of West Eleventh (11th) and Gaines Streets, thence south two blocks along the east side of Gaines Street to the southeast corner of the intersection of West Thirteenth (13th) and Gaines Streets, thence west one block along the south side of West Thirteenth (13th) Street to the southwest corner of the intersection of West Thirteenth (13th) and State Streets, thence north 1 block along the west side of State Street to the southwest corner of the intersection of West Twelfth (12th) and State Streets, thence west along the south side of West Twelfth (12th)Street a distance of 160 feet, thence north along the west side of the alley in Block 231, Original City of Little Rock, to the north side of West Eleventh (11th) Street, thence east one and one -half (12) blocks along the north side of West Eleventh (11th) Street to the northeast corner of the intersection of West Eleventh (11th) and Gaines Streets, the point of beginning, in the City of Little Rock, County of Pulaski, State of Arkansas, (herein called the "Locality "); and WHEREAS, the Local Public Agency proposes to apply for additional financial assistance under such Act and to enter into an additional contract or contracts with the Housing and Home Finance Administrator making available additional financial assis- tance for the Project; and WHEREAS, there has been prepared and referred to the City Council of the Locality (herein called the "Governing Body ") for review and approval a Redevelopment Plan, with supporting data, for the Project Area, identified as "The Redevelopment Plan, Project No. ARK R -1, Philander Smith ", as approved by Resolution of the Local Public Agency and duly certified by the executive officer thereof on the 7th day of December, 1955; and WHEREAS, said Local Public Agency has certified that pur- suant to public notice duly given by publication in the Arkansas Democrat on the 27th day of November, 1955, and in the Arkansas Gazette on the 27th day of November, 1955 and the 4th day of Decem- ber, 1955, it held a public hearing on the proposed undertaking and Redevelopment Plan at the City Council Chambers, City Hall, Little - 3 - Rock, Arkansas on the 7th day of December, 1955 at 8:00 o'clock p.m. at a special meeting of said Local Public Agency duly convened for such purpose and heard all persons appearing at such public hearing who desired to be heard and gave full consideration to the matters and things presented at such public hearing; and WHEREAS, this Council having duly considered said Redevel- opment Plan and supporting data and being fully advised in the premises hereby determines that the findings, determinations and action herein made, taken and authorized are in the public interest and for the protection of the health, safety, morals and welfare of this community, and all in accordance with the Charter of the City of Little Rock, Act 212 of the General Assembly of the State of Arkansas of 1945, and Act 298 of the General Assembly of the State of Arkansas of 1937, as amended; and WHEREAS, there has heretofore been presented to and approved by the Governing Body a Redevelopment Plan for the Dunbar Redevelopment Project, No. UR ARK 1 -1, Central Area, as modified; and a Redevelopment Plan for the Granite Mountain Redevelopment Project, No. UR ARK 1 -2; and WHEREAS, a general plan has been prepared and is recog- nized and used as a guide for the general development of the Locality as a whole; and WHEREAS, the Planning Commission of the City of Little Rock, Arkansas, which is the duly designated and acting official planning body for the Locality, has submitted to the Governing Body its report and recommendations respecting the Redevelopment Plan for the Project Area and has certified that said Redevelopment Plan conforms to the said general plan for the Locality as a whole, and the Governing Body has duly considered said report, recommendations and certification of the planning body; and WHEREAS, said Redevelopment Plan for the Project Area prescribes certain land uses for the Project Area and will require, among other things, changes in zoning and other public action; and 6 / � - 3 - Rock, Arkansas on the 7th day of December, 1955 at 8:00 o'clock p.m. at a special meeting of said Local Public Agency duly convened for such purpose and heard all persons appearing at such public hearing who desired to be heard and gave full consideration to the matters and things presented at such public hearing; and WHEREAS, this Council having duly considered said Redevel- opment Plan and supporting data and being fully advised in the premises hereby determines that the findings, determinations and action herein made, taken and authorized are in the public interest and for the protection of the health, safety, morals and welfare of this community, and all in accordance with the Charter of the City of Little Rock, Act 212 of the General Assembly of the State of Arkansas of 1945, and Act 298 of the General Assembly of the State of Arkansas of 1937, as amended; and WHEREAS, said Redevelopment Plan for the Project Area prescribes certain land uses for the Project Area and will require, among other things, changes in zoning and other public action; and - 4 - WHEREAS, it is necessary that the Governing Body take appropriate official action respecting the Redevelopment Plan for the Project, in conformity with the contract or contracts for fin- ancial assistance between the Local Public Agency and the Housing and Home Finance Administrator: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That it is hereby found and determined that said Project Area in said Locality as described in said Redevelop- ment Plan and as set forth herein in a blighted area as defined by Act No. 212 of the Acts of the General Assembly of the State of Arkansas for the year 19+5; that the slum conditions existing there- in are detrimental to the safety, health, morals and welfare of the inhabitants of said Locality; that said Project Area should be acquired by said Local Public Agency and such conditions eliminated and said Redevelopment Plan carried out in the public interest. SECTION 2. That the Redevelopment Plan for the Project aforementioned, having been duly reviewed and considered, is hereby approved. SECTION 3. That it is hereby found and determined (a) that such Redevelopment Plan for the Project Area conforms to said general plan of the Locality; (b) that said Redevelopment Plan in all applicable particulars fully and satisfactorily (1) indicates its relationship to definite local objectives as to appropriate land uses and improved traffic, public transportation, public utilities, recreational and community facilities and other public improvements, (2) indicates proposed land uses and building requirements in said Redevelopment Area, and (3) indicates the method for the temporary relocation of persons living in said Redevelopment Area and the method of providing decent, safe and sanitary dwellings substan- tially equal in number to the number of sub - standard dwellings to be cleared from said Redevelopment Area at rents within the finan- cial reach of the income groups to be displaced from such sub- standard dwellings. - 5 - SECTION 4. That it is hereby found and determined that the financial aid provided and to be provided pursuant to said contract or contracts for financial assistance pertaining to the Project is necessary to enable the land in the Project Area to be redeveloped in accordance with the Redevelopment Plan for the Pro- ject Area. SECTION 5. That it is hereby found and determined that the above - mentioned Redevelopment Plans for the Redevelopment Areas in the Locality will afford maximum opportunity, consistent with the sound needs of the Locality as a whole and in the public inter- est for the redevelopment of such areas. SECTION 6. That in order to implement and facilitate the effectuation of the Redevelopment Plan hereby approved it is found and determined that certain official action must be taken by this body with reference, among other things, to changes in zoning and other public actions, and, accordingly, this body hereby: (a) pledges its cooperation in helping to carry out such Redevelopment Plan; (b) requests the various officials, departments, boards and agencies of the Locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with said Redevelopment Plan; and (c) stands ready to consider and take appropriate action upon proposals and measures designed to effectu- ate said Redevelopment Plan. SECTION 7. That additional financial assistance under the provisions of Title I of Housing Act of 1949, as amended by the Housing Act of 1954, is necessary to enable the land in the Project Area to be redeveloped in accordance with the Redevelopment Plan for the Project Area and, accordingly, the filing by the Local Public Agency of an application or applications for such financial assist- ance under Title I of Housing Act of 1949, as amended by the Housing Act of 1954, is hereby approved. - 6 - SECTION 8. That it is hereby found and determined that there are slum conditions existing in the blighted area hereinabove described which are detrimental to the safety, health, morals and welfare of the inhabitants of the Locality; and this Ordinance being necessary for the immediate preservation of the public peace, health, morals, safety and welfare, an emergency is therefore declared to exist and this Ordinance shall be in full force and effect immed- iately upon its passage and approval.
