HomeMy WebLinkAbout9957i ORDINANCE NO. 9957 AN ORDINANCE ORDERING THE REMOVAL AND RAZING OF THE HOUSE AT 2718 MARSHALL STREET, SAID PROPERTY DESCRIBED AS LOT 8, BLOCK 20, BRADDOCKtS BOULEVARD ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUN'T'Y, ARKANSAS; DIRECTING THE CITY ATTORNEY TO TAME SUCH ACTION AS IS NECESSARY TO ACCOMPLISH THE RESULTS DESIRED BY THIS ORDINANCE; DECLARING AN EMERGENCY; AND FOR OTHER PUR- POSES. WHEREAS, the aforesaid property is owned by Frederick Lomong Young, an incompetent adult who is a patient at the Arkansas State Hospital for Nervous Diseases; and WHEREAS, the guardian of his estate and person is Mrs. Frances Whiley, of 1215 West 4th Street, Little Rock, Arkansas, at present on a visit at 40 -722 sway, N.E., Minneapolis, Minne- sota; and WHEREAS, on two different occasions the Little Rock Fire Department has given the.guardian notice that this house should be torn down or repaired; and WHEREAS, the guardian is advised the cost of bringing it up for repair purposes is X4,000.00; and WHEREAS, the guardian has further been advised that the Court does not have the power on her petition to raze said prop- erty; and WHEREAS, said property in its present condition is danger- ous to the health, welfare and safety of the surrounding property and residents thereof. NOW, 'THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the property at 2718 Marshall Street, described as Lot 8, Block 20, Braddock's Boulevard Addition to the City of Little Rock, Pulaski County, Arkansas constitutes a fire, health and safety hazard to the residents of the sur- rounding property. SECTION 2. That since the property is owned by Frederick Lomong Young, an incompetent, who cannot tear it down and that his guardian cannot be given power to tear it down by the Court, the only way it can be removed is for the City of Little Rock to take action against said property for a Court order removing it. .i,'1>- -2- SECTION 3. That the City Attorney is hereby directed to institute such legal proceedings against said property and persons as may be necessary in order to enforce the provisions of this ordinance, and to remedy the dangerous condition of this house located at 2718 Marshall Street by obtaining a Court order directing that the City raze such structure for the safety and welfare of the residents of the City of Little Rock. SECTION 4. That all ordinances and parts of ordinances in conflict herewith are hereby repealed; that an emergency is hereby declared to exist by reason of the danger of said property to the surrounding property and residents of the City of Little Rock, and this ordinance shall be in full force and effect from and after its passage and approval.
