ORDINANCE NO. 9878
An Ordinance granting power to the Mayor and City Clerk of the
City of Little Rock, Arkansas in the name of and for and on behalf
of said City to lease certain land for use in disposal of garbage.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. That the Mayor and City Clerk of the City of Little Rock
be and they are hereby authorized and directed in the name of and
for and in behalf of said City to enter into a lease agreement with
J. D. �althour, trustee, in form as follows:

THIS AGREEMENT entered into by and between J. D. 11althour,
Trustee, hereinafter called Lessor, and The City of Little Rock,
Arkansas, by its duly authorized officers, hereinafter called
Lessee,
WITNESSETH:
That, in consideration of the performance by the Lessee of
its undertakings, as hereinafter expressed, the Lessor hereby
leases and demises to the Lessee for a period of Eighteen (18)
Months from the date hereof the following described land lying
in the County of Pulaski and State of Arkansas, to -wit:
Part of the North Half of the Southwest quarter of
Section 33, Township 2 North, Range 12 West, in the
City of Little Rock, in Pulaski County, Arkansas, more
particularly described as follows, to -wit:
Beginning at a stone in the center of the Southwest
Quarter of said Section; thence running 1aest 1.14 chains;
thence North 53 degrees .rest 11.63 chains; thence East
24.04 chains; thence South 24 degrees East 3.21 chains;
thence South 4.09 chains; thence `pest 15.86 chains to
the point of beginning, containing 15 acres; except a
tract 125 feet square in the Southeast corner of said
tract, heretofore conveyed to Capital City eater Company,
by Warranty Deed dated August 23, 1915, and recorded in
Deed Record 1201 at Page 317, of the records of Pulaski
County, Arkansas, and except the following described
tract, to -wit:
Beginning at a point 921.9 feet East and 125 feet North
of the Southwest corner of the NEB S 4, Section 33, Town-
ship 2 North, Range 12 West; thence Northerly 308.1 feet
to a point; thence Southeasterly 205 feet to a point;
thence Southerly 145.1 feet to a point; thence Westerly
125 feet to the point of beginning, containing 0.649
acres, more or less, subject to all easements and rights -
of -way over or across the said leased premises.
It is understood that said tract will be used by t1m Lessee
for the disposal of garbage by burying the same daily as it is
delivered thereon and the said Lessee undertakes to clear said
tract of all brush and to keep the leased premises in presentable
and sanitary condition, without offensive smoke, odors or appear -
ance, to distribute the garbage so that the tract will be kept
level and cover up all garbage as it is deposited thereon and
at the termination of the period of this lease the Lessee agrees
to surrender said premises to the Lessor in a clean and sanitary
condition.
The Lessee will take possession of said tract and will
assume all responsibility for its use and all liability to third
parties for any injury or damage to person or property resulting
from said use."
and to execute the same and upon its execution it is ordained that the
City of Little Rock take charge of the premises described in said
lease and assume the obligations thereof.
SECTION 2.. This ordinance shall take effect and be in force from and after
its passage.
