AN ORDINANCE TO ABANDON AND VACATE A PORTION
OF WEST 31st STREET LYING BETWEEN BLOCK 14 and
THE REPLAT OF A PART OF BLOCK 9, C.O. BRACK'S
ADD1T ION TO THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was filed with the City Council of the City
of Little Rock, Arkansas on the 23rd day of May, 1955, asking the City
Council to abandon and vacate the hereinafter described portion of
Weet -31st Street lying between Block 14 and the R.eilli tt of a Part
of Block 90 C. 0. Brack +s Addition to the City of Little Rock,
Arkansas, which plats appear in Plat Book 1, page 166 and in Deed
Book 510, page 586, respectively, in the office of the Circuit Clerk
and ex officio Recorder for Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Council has
at the time and place mentioned in the notice, heard all persons desiring
to be heard on the question and has ascertained that the portion of
!Vest 31st Street hereinafter mentioned has been heretofore dedicated
to the public use as a street herein described but has not actually been
used by the public for a period of at least five years prior to the
filing of the petition; that the owners of the property abutting upon
the portion of the street to be vacated have filed with the Council
their written consent to such abandonment, and that the public interest
and welfare will not be adversely affected by the abandonment of that
portion of said street.
, NOW,THEREFORE, be it ORDAINED b7 the City Council of the City
of Little Rock, Arkansas;
SECT ION 1. The City of Little Rock hereby releases, vacates,
and abandons all of its rights together with the rights of the public
generally., except the rights and needs of public utilities to ingress
and egress to maintain and use present utility lines located therein
and thereon and to the portion of Test 31st Street designated as follows;
West 31st Street from the east property line of
Taylor Street east for approximately 140 feet to
the west property line of an alley platted through
Block 14 and the Replat of a Part of Block 9, C. 0.
Brack's Addition to the City of Little Rock, Arkansas.
