HomeMy WebLinkAbout10019- .--14.4 10r.'r-" ORDINANCE NO. 10,019 AN ORDINANCE ORDERING THE REMOVAL AND RAZING OF THE TWO -STORY SERVANTiS QUARTERS AND GARAGE IN REAR OF 1320 LINCOLN STREET, SAID PROPERTY DESCRIBED AS LOTS 2 AND 3, BLOCK 359, ORIGINAL CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS; DIRECTING THE CITY ATTORNEY TO TAKE SUCH ACTION AS IS NECESSARY TO ACCOMPLISH THE RESULTS DESIRED BY THIS ORDINANCE; DECLARING AN EMER- GENCY; AND FOR OTHER PURPOSES. WHEREAS, the aforesaid property is owned by Marguerite Miller Fones, an incompetent adult, under guardianship of the Union National Bank; and WHEREAS, on several occasions the Little Rock Fire Department has given the guardian notice that this two -story servantfs quarters and garage should be torn down or repaired; and WHEREAS, the guardian has further been advised that the Court does not have the power on its petition to raze said property; and WHEREAS, said property in its present condition is dangerous to the health, welfare and safety of the surrounding property and residents thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the two -story servantts quarters and garage in rear of 1320 Lincoln Street, located on Lots 2 and 3, Block 359, Original City of Little Rock, Pulaski County, Arkansas, is in a run -down and dilapidated condition; and constitutes a fire, health and safety hazard to the residents of the surrounding property. SECTION 2. That since the property is owned by Marguerite Miller Fones, an incompetent, who cannot tear it down; and that her guardian cannot be given power to tear it down by the Court, the only way it can be removed is for the City of Little Rock to take action against said property through a Court order removing it. SECTION 3. That the City Attorney is hereby directed to in- stitute such legal proceedings against said property and persons as may be necessary in order to enforce the provisions of this ordinance, and to remedy the dangerous condition of this two -story servant's quarters and garage in rear of 1320 Lincoln Street by obtaining a Court order directing that the City raze such structure -2- for the safety and welfare of the residents of the City of Little Rock. SECTION 4. That all ordinances and parts of ordinances in conflict herewith are hereby repealed; that an emergency is hereby declared to exist by reason of the danger of said property to the surrounding property and residents of the City of Little Rock; and -this ordinance shall be in full force and effect from and after its passage and approval.
