AN ORDINANCE VACATING AND ABANDONING WEST THIRTY -THIRD STREEST, RUNNING EAST AIM WEST, BE-
MEN THE EAST HALF (E2) OF BLOCKS THIRTY -SIX _( .56) AND THIRTY -SEVEN (37), OF BRADDOCK'S
BOULEVARD ADDITIO71 TO THE CITY OF LITTLE ROCK, ARKUSAS .
WHEREAS, a petition was duly filed wit'z the City Council of the City of Little Rock,
Arkansas, on the 8th day of June, 1956, asking the City Council to vacate and abandon all
that portion of the street designated on the plat of Braddock's Boulevard Addition to said
City, now appearing of record in Deed Record Book No. 35, at page 596, in the office of the
Recorder of Pulaski County, Arkansas, said street being more particularly described as
follows, to -wit:
Beginning at the Southwest corner of Lot Seven (7), Block Thirty -six
(36), of Braddook's Boulevard Addition to the City of Little Rook,
Arkansas; run thence East along the South line thereof 140 feet to the
Southeast corner thereof; thence South to the Northeast corner of Lot
Twelve (12), Block Thirty -seven (37) of said Addition; thence Nest along
the North line of said lot 140 feet to the northwest Corner thereof;
thence North to the point of beginning.
7- MREAS, after due notice as required by law, the council has, at the time and place
mentioned in the notice, heard all persons desiring to be heard on the question and has
ascertained that the street, or the portion thereof, hereinbefore described, has hereto-
fore been dedicated to the public use as a street herein described; has not been actual-
ly used by the public generally for a period of at least five (5) years subsequent to the
filing of the plat; that all of the awners of the property abutting upon the portion of
the street to be vacated have filed with the Lounoil their written consent to such abandon-
ment; and that public interest and welfare will not be adversely affected by the abandon-
ment of such street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARWTSAS r
SECTIO 11 1. The City o° Little Rock, Arkansas, hereby releases, vacates and abandons
all its rights, together with the rights of the public generally, except the rights and
needs of public utilities, for ingress and egress to maintain any existing utility lines
in said area and except the ri,�ts and needs of the City of Little Rook for ingress and
egress to control drainage in said area, in and to the street designated, as follows:
The dedicated street known as West Thirty -third Street, running east and went,
between the East half (E2) of Blocks Thirty -six (36) and Thirty -seven
(37), of Braddook's Boulevard Additian to the City of Little Rook, Ark-
ansas, as shown by the Plat and Bill of Assurance in Deed Record Book
No. 35, at page 596, in the office of the Recorder of Pulaski County,
Arkansas.
SECTION 2. A copy of the ordinance, duly certified by the City Clerk, shall be
filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the
deed records of the said County.
SECTION 39 This ordinance shall take effect and be in force from and after its
pas sage .
