3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A CONTRACT WITH SCOTT CONSTRUCTION EQUIPMENT
6 COMPANY FOR THE PURCHASE OF A WILDCAT COMPOST TURNER
7 FOR THE PUBLIC WORKS DEPARTMENT; AND FOR OTHER PURPOSES.
9 WHEREAS, the City of Little Rock may dispense with the requirement of
10 competitive bidding in exceptional situations where such procedure is not feasible, and
11 WHEREAS, the Solid Waste Division of the Public Works Department must
12 replace the City's compost turner which was recently destroyed by lightning, and
13 WHEREAS, it has been determined that there are only four companies that
14 manufacture a 16" compost turner required for the compost operation and only one
15 company located in Arkansas that sells and provides warranty repairs for this
16 equipment,
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
18 OF THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors finds that competitive bidding should be
20 dispensed with in the purchase of a Wildcat Compost Turner, as an exceptional
21 situation exists and competitive bidding is impractical and infeasible.
22 Section 2. The City Manager is hereby authorized to dispense with competitive
23 bidding and to enter into a contract with Scott Construction Equipment Company for
24 the purchase of a Wildcat Compost Turner for the amount of Two Hundred Nine
25 Thousand, Five Hundred Thirty -Five Dollars ($209,535.00), for the Public Works
26 Department, Solid Waste Division.

I Section 3. Severability. In the event any title, section, paragraph, item, sentence,
2 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
3 unconstitutional, such declaration or adjudication shall not affect the remaining
4 portions of the ordinance which shall remain in full force and effect as if the portion so
5 declared or adjudged invalid or unconstitutional was not originally a part of the
6 ordinance.
7 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are
8 in conflict with any provision of this ordinance are hereby repealed to the extent of such
9 conflict.
