ORDINANCE NO. 10,335
AN ORDINANCE TO CLOSE A PORTION OF AN ALLEY IN BLOCK 19, PULASKI
HEIGHTS ADDITION TO THE CITY OF LITTLE ROCK, ABUTTING IMMEDIATELY
WEST OF LOTS 1 AND 2.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK:
Whereas, a petition was duly filed with the City Council of
the City of Little Rock, Arkansas, on the 11th day of October,
1956, asking the City Council to vacate and abandon all that
portion of the alley designated on the plat of Pulaski Heights
Addition to the City of Little Rock, Arkansas, now appearing of
record in Plat Book , page 2 13 , in the office of the
Recorder of Pulaski County, which lies between Lots 1 and 2 and
Lots 11 and 12 of Block 19 of the Pulaski Heights Addition.
Whereas, after due notices as required by law, the Council
has, at the time and place mentioned in the notice, heard all
persons desiring to be heard on the question and has ascertained
that the alley or the portion thereof hereinbefore described, has
heretofore been dedicated to the public use as an alley herein
described; has not been actually used by the public generally for
a period of at least five years subsequent to the filing of the
plat; that all the owners of the property abutting upon the por-
tion of the alley to be vacated have filed with the Council their
written consent to such abandonment; and that public interest and
welfare will not be adversely affected by the abandonment of such
alley.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby releases,
vacates, and abandons all its rights, together with the rights of
the public generally, except for the rights and needs of public
utilities including the Little Rock Municipal Waterworks for in-
gress and egress to maintain any existing utility lines, including
water lines in said area and except for the rights and needs of
the City of Little Rock for ingress and egress to control drain-
age in said area, in and to the alley designated as follows:
A portion of the alley in Block 19, Pulaski
Heights Addition to the City of Little Rock,
Arkansas, being 20 feet wide and 100 feet long
and lying between Lots 1 and 2 and Lots 11 and
12 of said block.
SECTION 2. A copy of the ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder of the
county and recorded in the deed records of the county.
SECTION 3. This ordinance shall take effect and be in force
from and after its passage.
