AN ORDINANCE GRANTING TO THE SEVENTH AND MAIN REALTY COMPANY
AND /OR THE LESSEES OF LOTS FIVE AND SIX, BLOCK SIX, ORIGINAL
CITY OF LITTLE ROCK, ARKANSAS, THEIR HEIRS AND ASSIGNS, FOR A
PERIOD OF NINETY NINE YEARS FROM THE FIRST DAY OF JANUARY,
1957, FOR AN ANNUAL RENTAL OF ONE DOLLAR ($1.00), THE RIGHT TO
EXCAVATE AND USE THE SPACE UNDERNEATH THE SIDEWALK ALONG AND
ADJACENT TO THE SHIEST SIDE OF SAID LOTS, ALONG AND ADJACENT TO
THE SOUTH SIDE OF SAID LOT SIX FOR A DISTANCE OF APPROXIMATELY
ONE HUNDRED SIX FEET AND THE AREA BENEATH THE SIDEWALK AT THE
SOUTHWEST CORNER OF SAID LOT SIX EXTENDING TWELVE FEET FROM THE
LINES OF SAID LOTS BUT IN NO EVENT BEYOND THE INTERIOR CURB LINE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. That the Seventh and Main Realty Company and /or
lessees of Lots Five (5) and Six (6), Block Six (6), Original City of
Little Rock, Arkansas, their heirs and assigns, be and they are hereby
granted the right to excavate and use the space underneath the sidewalk
along and adjacent to the west side of said lots and extending twelve (12)
feet west of the west line of said lots, the area beneath the sidewalk
adjacent to the southwest corner of said Lot Six (6) to the interior curb
line and the area along the south side of said Lot Six (6) extending twelve
(12)feet south from the south line of said lot for a distance not exceeding
One Hundred Four (104) feet beginning at the west line of said lot and run-
ning toward the east and to construct and maintain therein foundations,
footings, structures and a basement to any building which may hereafter be
erected on said property, providing that the City of Little Rock reserves
unto itself the right to continue to use any of said area which is presently
being utilized for the purpose of laying and maintaining utility pipes and
conduits. The City further retains the right to require the removal of
such improvements from said tract for any public purpose without cost and
said costs, if there should be any, shall be borne by the individual or
company which lay claim or maintain said tract.
SECTION 2. The Seventh and Main Realty Company and /or the Lessees
of Lots Five (5) and Six (6), Block Six (6), Original City of Little Rock,
Arkansas, their heirs and assigns, be, and they are hereby granted the
right to construct and maintain ventilating grills level with the surface
of the alley along the east side of the east property line of said lots.
SECTION 3. The Board of Public Affairs of the City of Little
Rock, Arkansas, be,and it is hereby authorized and directed to enter into
and keep a lease agreement for the use of the above mentioned area for a
period of Ninety Nine (99) years from the First day of January, 1957, at
the annual yearly rental of One Dollar ($1.00), which may be paid in
advance at the election of the Seventh and Main Realty Company and /or
the Lessees of said Lots.
SECTION 4. That all ordinances and parts of ordinances in
conflict herewith are hereby repealed only insofar as they affect this
ordinance.
