HomeMy WebLinkAbout10673ORDINANCE NO. 10,673 AN ORDINANCE VACATING AND ABANDONING THAT PORTION OF MILTON AVENUE LYING NORTH OF BLACK 20 AND SOUTH OF BLACKS 18 AND 19, AND THAT PORTION OF FRAY STREET LYING EAST OF BLOCK 18 AND WEST OF BLACK 19, OF THE C. 0. BRACK'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, a Petition was duly filed with the City Council of the City of Little Rock, Arkansas on the 14th day of October, 1957, requesting the City Council to vacate and abandon that portion of Milton Avenue lying North of Block 20 and South of Blocks 18 and 19, of the C. 0. Brack's Addition to the City of Little Rock, Pulaski County, Arkansas, bounded on the Northeast by a straight line drawn from the Northeast corner of Lot 1, Block 20, of the aforesaid Addition to the East corner of Block 19, of said Addition, and bounded on the West by a straight line drawn from the Northwest corner of Lot 12 of said Block 20 to the Southern most corner of Lot 2, Block 18 of-said Addition, as replatted; and that portion of Fray Street lying East of Block 18 and West of Block 19 of said Addition, bounded on the North by a straight line extending from the Northwest corner of Block 19 to the Northeast corner of Lot 1, Block 18 of said Addition, and bounded on the South by a straight line drawn from the Southwest corner of said Block 19 to the Southeast corner of Lot 2 of said Block 18, (the whole of said portions of Milton Avenue and Fray Street being outlined by red lines on the photo- stat of the plat of said Addition, which is attached to the Peti- tion and marked "Exhibit A ".); and WHEREAS, after due notice as required by law, the Council has, on the day and at the place mentioned in the notice, heard all pfirsons desiring to be heard on the question, and has ascer- tained that the streets, hereinabove described, have heretofore been dedicated to the public use as streets, have not been J -2- actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat, and for a period of at least five (5) years immediately preceding the fil- ing of the Petition and the date of the passage of this ordi- nance; that the sole owners of the property abutting upon said streets to be vacated have filed with the Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such streets. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas hereby re- leases, vacates and abandons all of its rights, together with the rights of the public generally, except the rights and needs of public utilities, for ingress and egress to maintain any existing utility lines in said area, and except the rights and needs of the City of Little Rock for ingress and egress to con- trol drainage in said area, in and to the streets designated as follows: That portion of Milton Avenue lying North of Block 20 and South of Blocks 18 and 19, of the C. 0. Brack's Addition to the City of Little Rock, Pulaski County, Arkansas, bounded on the Northeast by a straight line drawn from the Northeast corner of Lot 1, Block 20, of the aforesaid Addition to the East corner of Block 19, of said Addition, and bounded on the West by a straight line drawn from the Northwest corner of Lot 12 of said Block 20 to the Southern most corner of Lot 2, Block 18 of said Addition, as replatted;-and That portion of Fray Street lying East of Block 18 and West of Block 19 of said Addition, bounded on the North by a straight line extending from the Northwest corner of -3- Block 19 to the Northeast corner of Lot 1, Block 18 of said Addition, and bounded on the South by a straight line drawn from the Southwest corner of said Block 19 to the Southeast corner of Lot 2 of said Block 18, (the whole of said portions of Milton Avenue and Fray Street being out- lined by red lines on the photostat of the plat of said Addition, which is attached to the Petition and marked "Exhibit A ".) SECTION 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of the County and recorded in the Deed Records of the County. SECTION 3.
