HomeMy WebLinkAbout10648ORDINANCE NO. 10 AN ORDINANCE AUTHORIZING AND DIRECTIVG -THE MAYOR AND THE CITY CLERK TO EXECUTE A DEED GRANTING AN EAMENT TO THE ARKANSAS STATE HIGHWAY COMMISSION FOR THE CONSTRUCTION -AND MAINTENANCE OF AN OVERHEAD PEDESTRIAN CROSSING ON THE LITTLE ROCK RIVERFRONT DRIVE, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Mayor -and the City Clerk are hereby authorized and directed to execute an easement deed an the Littic Rock Riverfront Drive, granting a perpetual easement to the Arkansas State Highway Commission for the purpose of constructing and maintaining an overhead pedestrian crossing over the Little Rock Riverfront Drive, more particularly described hwewinditer. That said easement deed shall read as follows, to -wit: EASEMENT DEED [AVOW ALL MEN BY THESE PRESENTS: WHEREAS, the City of Little Rock, Arkansas, acting by and through its Mayor and City Clerk pursuant to the authority and directions contained in Ordinance No. duly passed by the City Council of the City of 5 Little Rock, Arkansas, on the day of desires to grant an easement to the Arkansas State Highway Commission for the purpose of constructing an overhead pedestrian crossing over LaHarpe Boulevard at the foot of Louisiana Street, known as State Job No. 6429, Little Rock Riverfront Drive, FAP U- 524(1), subsequent lands being herein- after more particularly described. NOW THEREFORE, the City of Little -Rock, Arkansas, pursuant to the authority and directions contained in Ordinance No. " duly passed by the City Council of the City of Little Rock, Arkansas on the day of 195,_, approved by the Mayor of the City of Little Rock, Arkansas, on the day of , 19 , for and in consideration of the recitals hereof and of the mutual benefits to accrue to the parties hereto,,odoes hereby grant, convey,.sell and quitclaim unto the Arkansas State Highway 'CommisafOn, and to its successors and assigns forever, a perpetual easement for the purpose of the operation, a"struction and maintenance of an overhead pedestrian crossing on, over, beneath, and across the following lands situated in,the City of Little Rock, County of Pulaski, State of Arkansas, to -wit: „.. . 41. Commencing at the intersection of the west line of Louisiana Street and the south line of Water Street, City of Little Rock, Arkansas, thence along the north- ward extension of the west line of Louisiana Street a distance of 101.2 feet to the north line of the right -of- way of the Missouri Pacific Railroad and the point of beginning, thence continue along the northward extension of the west line of Louisiana Street a distance of 12 feet, thence on a deflection angle to the left of 930 30' a distance of 38 feet, thence on a deflection angle to the right of', ,,900 00' a distance of 6 feet, thence on a deflection angle to the right of 900 00' a distance of 53 feet, thence on a deflection angle to the right of 900 00' to the north line of the right -of -way of the Missouri Pacific Railroad, thence westwardly along the north line of the right -of -way of the Missouri Pacific Railroad to the point of beginning. TO HAVE AND TO HOLD the same unto the said Arkansas State Highway Commission, its successors and assigns forever, with all appurtenances thereunto belonging.
