AN ORDINANCE AUTHORIZING THE CONSTRUCTION, USE, OCCUPANCY
AND MAINTENANCE OF AN- OVERHEAD STRUCTURE ACROSS THE
ALLEY INTERSECTING BLOCK 5., ORIGINAL CITY OF LITTLE
ROCK CONNECTING THE-BANKING HOUSE OF WORTHEN BANK
AND. RUST COWANY WITH A PARKING DECK STRUCTURE TO
BE-CONSTRUCTED ON LOTS 10, 11 AND 12, BLOCK 5,
ORIGINAL CITY OF LITTLE ROCK.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF

,°� Section 1. Worthen Bank and Trust Company (a banking
corporation under the laws of Arkansas), its successors and
0, assigns, is authorized to construct, use, occupy and main-
tain an overhead structure, crossing the alley intersecting
Block 5, Original City of Little Rock, connecting the bank -
ing house of said bank with a parking deck structure to be
constructed by Little Rock Parking, Inc., an Arkansas cor-
poration, on Lots 10, 11 and 12, Block 5, Original City of
Little Rock.
Section 2. Such overhead structure may be two stories
in height, having two floors and a roof; and it shall be
constructed in accordance with plans which were filed by
Worthen Bank and Trust Company in the office of the City
Engineer of the City of Little Rock on the 2nd day of June,
1958.
Section 3. In connection with the construction of said
overhead structure, Worthen Bank and Trust Company (at its
expense) may alter the grade of the alley intersecting
Block 5, between Fourth and Fifth Streets, Original City of
Little Rock, to the extent reflected by the plans filed by

said bank with the City Engineer as aforesaid. Such
alteration of the alley grade shall be effected under
the supervision of the City Engineer and in a manner
meeting his approval, and the concrete paving of the alley
shall be restored in a manner meeting the approval of the
City Engineer; and said overhead structure, for its entire
width, shall have a clearance, above the grade of said alley
as thus altered, of not less than 13 feet and 6 inches.
Signs showing the clearance above the surface of the alley,
as altered, shall be continuously maintained on both sides
of the overhead structure. Units of air - conditioning equip-
ment may be placed upon the roof of said overhead structure.
Section 4. It has been found, and is hereby declared,
that the overhead structure authorized in this ordinance
will constitute an adjunct of a parking deck facility, now
under construction, which is needful and important from the
standpoint of the public welfare$ and that the postponement
of the effective date of this ordinance will cause delay in
the construction of such parking deck facility. Therefore,
an emergency is hereby declared to exist, and, this ordinance
being necessary for the preservation of the public welfare,
peace, health and safety, shall take effect and be in force
from and after the date of its passage.
