AN ORDINANCE RELEASING, VACATING, AND ABANDONING ALL
RIGHTS OF THE CITY AND THIR PUBLIC GENERALLY IN AND TO
THE PORTIONS OF WEST 12Th STREET RUNNING EAST AND
WEST FROM IZARD TO STATE STREETS, AND THE INTERSECTING
ALLEY IN BLOCK 231 RUNNING NORTH AND SOUTH FROM 11TH
TO 12TH STREETS; AND WEST 12TH STREET RUNNING FAST AND
WEST BETWEEN STATE AND GAINES STREETS, AND THE INTER -
SECTING ALLEYS BETWEEN GAINES AND STATE STREETS FROM
11TH TO 13TH STREETS IN B1=S 222 & 2239
ORIGINAL CITY OF LI`T`TLE ROCK. ARKANSAS
WHEREAS, a petition was dUly filed with the Board of
Directors of the City of Little stock, Arkansas, on the 216t
day of April, 1958, asking the Board of Directors to vacate
and abandon portions of the streets and alleys designated
on the plat of the City of Little Rock, Arkansas, now appearing
in the Bagley Map, in the office of the Recorder of Pulaski
County, more particularly described as follows:
West 12th Street running East and West between Izard
and State Streets lying between Blocks 231 and 232,
Original City of Little Rock, Arkansas.
West 12th Street running East and West between State
Street and Gaines Street lying between Blocks 222 and
223, Original City of Little Rock, Arkansas.
An alley between Izard and State Street intersecting
12th Street of Block 2312 Original City of Little
Rock, Arkansas.
An alley between State Street and Gaines Street inter-
secting Blocks 222 & 223 of the City of Little Rock,
Arkansas.
WHEREAS, after due notice as required by law, the Board
of Directors of the City of Little Rock, Arkansas, has at the
time and at the place mentioned in the notice heard all persons
desiring to be heard on the question, and has ascertained that
the portions of the streets and alleys hereinabove described
have been heretofore dedicated to the public use; that the
portions of the streets and alleys to be vacated are to be
devoted to use for educational purposes; that the petitioner
Philander Smith College, an educational corporation of the

City of Little Rock, Arkansas, is the owner of the property
abutting upon the Portions of the streets and alleys to be
vacated, and that yublic interest and welfare will be benefited
by the ab. -mdoxnwt of such streets and alleys;
NOW, TiJEMOREO BE IT ORDAINED BY Tiff. BOARD OF DIRECTORS
OF THE CITY OF LITTLE DOCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas_, hereby
releases, vacates, and abandons,subject to the reservations
set .forth in Section 2 hereof, all its rights together with
the rights of the public generally in and to the streets and
alleys designated as follows:
From the east line of Isard on 12th running east to
the west line of State on 12th, and the east line
of State on 12th running east to the west line of
Gaines on 12th Street; and
l'ke alley between Iaard and State Streets running
from 11th to 12th, and the alley running between
State and Gaines Streets running from llth to
13th, all in the City of Little Roex, Arkansas.
SECrj*N 2. There is hereby reserved unto all utility
companies now operating under franchise from the City of Little
Rock and unto their successors and assigns and unto the City
of Little Rock, the Little Rock Municipal Waterworks and
the Little Rock Sanitary Sewer Commission, all of the rights,
privileges, authority, easements and land space and space
they now bold on or occupy upon, underneath and above that
part of 12th Street which is now dedicated to the public use
and used as a public way between Izard and Gaines Streets and
the alleys in Blocks 222, 223 and 231 of the Original City of
Little Rock, notwithstanding the form, manner or procedure
under which such rights, privileges, authority and spaces
were acquired by said utility companies and the City of Little
Rock. Said reservations shall include, but not be limited, to

the rights of the City of Little Rock for ingress and egress
to coutral drainage in said area.
SECTION 3. A copy of this ordinance duly certified
by the City CISA shall be filed in the office of the Recorder
of the County and recorded in the deed records of the County.
SSMON 4. This ordinance shall take effect and be in
force from and after its passage.
