AN ORDINANCE TO CONTROL Ct) , INSTALLATION
AND ERECTION OF TELEVISION AND RADIO TOWERS IN THE
CITY OF LITTLE ROCK, ARKANSAS; PROVIDING A PERMIT
AND A PERMIT FEE THEREFOR; AND FOR OTHER PURPOSES.

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. From and after the passage and approval of
this ordinance no person, firm or corporation shall construct,
erect or install any television or radio tower in the City of
co Little Rock, Arkansas, without first obtaining a permit tbare-

ro be granted pursuant to the provisions contained herein.

SECTION 2. All television and radio towers constructed

'a in the City of Little Rock, Arkansas, shall be erected in strict

accordance with the manufacturer's specifications for erections,
or in the event that there are no manufacturer's specifications
for erection of said television and radio towers, they shall be
erected in accordance with plans and specifications prepared
by a registered professional engineer. Said manufacturer's
specifications or plans and specifications prepared by said
registered professional engineer shall be filed with the office
of the City Engineer prior to the issuance of the permit for
the erection of said television and radio towers.
The word "tower" as used herein is defined as any mast,
support or other structure used for the support of a radio
or television antenna and includes the mast and the antenna
thereon.
SECTION 3. HEIGHT RESTRICTIONS.
a. Ground Mounted Towers
(1). No steel or other metal ground mounted tower
shall exceed seventy -five feet (751) in height above adjacent
ground.
(2) . No wood mounted tower shall exceed twenty
feet (201) in height above the adjacent ground.

b. Roof Mounted Towers
(1). No steel or other metal tower mounted on the
roof of any commercial or industrial building shall exceed
fifty feet (501) in height above the roof line of the building on
which the same is mounted.
(2). No steel or other metal tower mounted on the
roof of any residential building shall exceed twenty -five feet
(25') in height above the roof line of the building on which the
same is mounted.
(3). No wood roof mounted tower shall exceed twenty
feet (201) in height above the adjacent ground.
SECTION 4. Pte.
a. A building permit shall be required for the con-
struction of all television and radio towers except that no per-
mit shall be required for the erection of any television or radio
tower which is:
(1). Constructed of steel or other metal which is
less than twenty -five (25) feet in height above the adjacent
(2). Constructed of steel or other metal which is
less than fifteen feet (151) above the roof line of the building
on which the same shall be mounted.
(3). Constructed of wood, the construction of which
is permitted under the provisions hereof.
b. A permit fee will be charged for the erection of
television and radio towers according to the provision of Para-
graph 2, Section 7 of Ordinance No. 7899 and Ordinance No. 9033
at the rate provided therein.
SECTION 5, INSPECTIONS
No person shall pour or otherwise construct any foundation,
footing or pad for any radio or television tower for which a
permit is required without first notifying the Little Rock

Building Inspector and obtaining approval of the excavation
or ditch in which the said foundation, footing or pad is to
be poured or otherwise constructed.
The Little Rock Building Inspector shall inspect or cause
to be inspected all radio or television towers for which a
permit is required. Two (2) inspections shall be made which
shall be designated Foundation Excavation Inspection and Final
Inspection respectively.
Foundation Excavation Inspection shall be made by the
Little Rock Building Inspector within twenty -four (24) hours
after being notified by the permitee that the excavation or
ditch in which the foundation, footing or pad for-the support
of a television or radio tower is about to be pommred.
Final inspection shall be made by the Little Rock Building
Inspector upon completion of the construction, erection or
installation of any television or radio tower. The permitee
shall notify the Little Rock Building Inspector within twenty -
four (24) hours after the said completion.
SECTION 6. If guying is used on any tower all such guying
shall be within the limits of the property of the person erecting
such tower unless the written consent of the person upon whose
land such guying extends allowing the said guying to be anchored
upon his land is filed with the City Engineer.
SECTION 7. No provision of this ordinance shall be con-
strued so as to relieve any one constructing or erecting said
television or radio towers from complying with all other re-
quirement of the Building Code of the City of Little Rock,
Arkansas,
SECTION 8. No permit shall be issued for the erection of
a television or radio tower which would in any way constitute
a hazard to air travel as recommended or required by the Civil
Aeronautics Authority.

SECTION 9. Provided further, the Board of Directors may
by ordinance, duly passed, waive the height limitations provided
for herein as to towers erected for commercial use.
SECTION 100
All
ordinances and parts of ordinances
in
conflict herewith
are
hereby repealed and this ordinance
shall
be in full force and effect from and after its passage and
approval.
