AN ORDINANCE VACATING AND ABANDONING THAT PORTION OF WEST TWENTY -THIRD
STREET RUNNING EAST AND WEST BETWEEN SOUTH TAYLOR AND SOUTH FIIMORE STREETS
WHEREAS, a petition was duly filed with the Board of Directors of the City of
Little Rock on the 11th day of March, 1958, requesting the Board of Directors to
vacate and abandon that portion of West 23rd Street lying south of Lots 6 & 7 Block
44 and north of Lots 1 & 12 Block 45, Cherry & Cox's Addition, and bounded on the
ewt by South Taylor and on the West by South Filmore; and
WHEREAS, after due notice as required by law, the Board of Directors has, on
the day and at the place mentioned in the notice, heard all persons desiring to be
heard on the question, and has ascertained that the street, hereinabove described,
has heretofore been dedicated to the public use as a street, has not been actually
used by the public generally for a period of at least five (5) years subsequent to
the filing of the plat, and for a period of at least five (5) years immediately
preceding the filing of the petition and the date of the passage of this ordinance;
that the sole owners of the property abutting upon said street to be vacated have
filed with the Board of Directors their written consent to such abandonment; and that
the public interest and welfare will not be adversely affected by the abandonment of
such street.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas hereby releases, vacates and
abandons all of its rights, together with the rights of the public generally in that
portion of West 23rd Street lying North of Lots 1 & 12 Block 45 of Cherry & Cox's
Addition to the City of Little Rock, Pulaski County, Arkansas, bounded on the East
by South Taylor Street, lying South of Lots 6 & 7 of Block 44, Cherry & Cox's
Addition to the City of Little Rock, Pulaski County, Arkansas, and bounded on the
West by South Filmore Street. Excepting the following described strips of land:
(1) A strip of land being 12 feet in width extending through said street
and in line with the alley as platted to the north in Block 44, and in line with the
alley as platted to the south in Block 45, said strip to be a continuation of the
alley in Blocks 44 and 45, Cherry & Cox=s Addition.

(2) A strip of land running East and West in the East 1/2 of said street
to be reserved for a drainage and utility easement, this drainage and utility easement
is to be 20 feet in width the center of which would be the center line of said street.
(3) A strip of land being the North 28 feet of the West 1/2 of said street
to be reserved for a drainage and utility easement.
These strips of land are hereby reserved for the rights and needs of the
public for ingress and egress to maintain any existing utility and sewer lines and
the rights and needs of the City of Little Rock for ingress and egress to control
drainage in said area.
SECTION 2. A 9opy of this ordinance, duly certified by the City Clerk, shall
be filed in the office of the Recorder of the County and recorded in the Deed Records
of the County.
SECTION 3. This ordinance shall be in full force and effect from and after
its passage and approval.
