HomeMy WebLinkAbout10828ORDINANCE NO. 1q,828 AN ORDINANCE CLOSING, VACATING AND ABANDONING THE ALLEY, TWENTY FEET IN WIDTH, RUNNING NORTH AND SOUTH BETWEEN THE EAST LINE OF LOTS ONE (1) THROUGH SIX (6) AND THE WEST LINE OF LOTS SEVEN (7) THROUGH TWELVE (12), BLOCK TWENTY -FIVE (25), PULASKI HEIGHTS ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. WHEREAS, the petition of W. B. Hays, Alton B. Raney, Carl Neely, John P. Streepey, Barron Lange and Charles T. Meyer, Jr., as Trustees of the Pulaski Heights Methodist Church, and Edwina Lawson, who state that they are the owners of all of the real property abutting upon the following described alley: Beginning at the Southwest corner of Lot Seven (7), Block Twenty -five (25), PULASKI HEIGHTS ADDITION to the City of Little Rock, Arkansas, thence North 300 feet to the Northwest corner of Lot Twelve (12) of said Block Twenty -five; thence West 20 feet to the Northeast corner of Lot One (1) of said Block Twenty - five; thence South 300 feet to the Southeast corner of Lot Six (6) of said Block Twenty -five ; thence East 20 feet to the point of beginning; said alley being 20 feet in width and running North and South between the East Line of Lots One (1) through Six (6) and the West Line of Lots Seven (7) through Twelve (12) of said Block Twenty -five; said alley was dedicated as an alley in the Plat and Deed of Assurance of the "Subdivision of Blocks Twenty -three (23) to Fifty -one (51), inclusive, Pulaski Heights Addition" to the City of Little Rock, Pulaski County, Arkansas, which appears in Plat Book No. 1 at page 1 in the Office of the Recorder for Pulaski County, Arkansas. WHEREAS, said petition has been filed in the Office of the City Clerk of the City of Little Rock, Arkansas, for more than ten (10) days; and WHEREAS, the City Clerk gave notice of the filing of such petition by publication in a newspaper published in and having a general circulation in the City of Little Rock, Arkansas, as required by law; and said notice notified all the owners of real property abutting upon the above described alley and all other persons, firms and corporations to appear before the Board of Directors of the City of Little Rock, M Arkansas, at this regular meeting of said Board to show cause why said petition should not be granted and said alley forever closed, vacated and abandoned; and WHEREAS, the Board of Directors at the time and place mentioned in said notice heard all persons desiring to be heard upon said petition; and WHEREAS, the Board of Directors of the City of Little Rock find that it is necessary and desirable to use the land,upon which the above described alley is situated, to build a church building as an addition of the Pulaski Heights Methodist Church; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock hereby forever closes, releases, vacates and abandons the following described alley: Beginning at the Southwest corner of Lot Seven (7), Block Twenty -five (25), PULASKI HEIGHTS ADDITION to the City of Little Rock, Arkansas, thence North 300 feet to the Northwest corner of Lot Twelve (12) of said Block Twenty-five; thence West 20 feet to the Northeast corner of Lot One (1) of said Block Twenty - five; thence South 300 feet to the Southeast corner of Lot Six (6) of said Block Twenty -five; thence East 20 feet to the point of beginning; said alley being 20 feet in width and running North and South between the East Line of Lots One (1) through Six (6) and the West line of Lots Seven (7) through Twelve (12) of said Block Twenty -five; said alley was dedicated as an alley in the Plat and Deed of Assurance of the "Subdivision of Blocks Twenty -three (23) to Fifty -one (51), inclusive, Pulaski Heights Addition" to the City of Little Rock, Pulaski County, Arkansas, which appears in Plat Book No. 1 at page 1 in the Office of the Recorder for Pulaski County, Arkansas. Section 2. The rights of the City of Little Rock, the general public and the owners of abutting property to use the above described lands as an alley are forever canceled and barred; and the title to the lands, upon which the above described alley was situated,are forever free of the right of all persons to use said lands as an alley. - 2 - Section 3. It is necessary and desirable in the opinion of the Board of Directors of the City of Little Rock to use the land, which was formerly dedicated for the use of the public as the above described alley, to build a church building as an addition to the existing church building of the Pulaski Heights Methodist Church. Section 4. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder for Pulaski County, Arkansas, and recorded in the deed records of said County.
