ARKANSAS ORDINANCE NO. 10, 859 AN ORDINANCE VACATING THAT PORTION OF SU1,24ITT AVENUE LYING BETWEEN AND ADJACENT TO LOTS 6, 7 AND 8, BLOCK 3 AND LOTS 9, 10 AND 11, BLOCK 2, UNION DEPOT ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors, Little Rock, Ark -1 ansas on the 9th day of September , 1958 asking the Board of Directors to decl abandoned and to vacate that portion of Summitt Avenue lying between and adjacent to Lots 6, 7 and 8, Block 3 and Lots 9, 10 and 11, Block 2, Union Depot Addition to the City of Little Rock, Arkansas; WHEREAS, after due notice, as required by law, the Board of Directors has, at the time and the Dlace in said notice mentioned, heard all persons desiring to be heard on the question, and has ascertained that the portion of the street hereinbefore descrl bed, has heretofore been dedicated to the public use as a street; has not been actuallZ used by the public generally for a period of over five years subsequent to the filing of the plat, or at any other time; that all of the owners of the property abutting up- on the portion of the street to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will be adversely affected by the abandonment of such street; THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, SECTION 1. That the City of Little Rock, Arkansas, by and through its Board of Directors, hereby releases, vacates and abandons all of its rights together with the rights of the public generally in and to the street described as follows: That port of Summitt avenue lying between and adjacent to Lots 6, 7 and 8, Block 3 and Lots 9, 10 and 11, Block 2, Union Depot Addition to the City of Little Rock, Arkansas and as by annexed plat. All of said street shall from the center line thereof attach the respective abutting parcels of lots on each side of said street and become the roperty of the owners of these parcels of lots, now being owned as follows: Lots 7 and 8, Block 3 and Lot 11, Block 2, now owned by Oscar Lee Eakin and Dorothy L. 2 akin, and Lots 9 and 10, Block now owned by Raleigh R. Olinger and Hazel Olinger. SECTION 2. Upon receipt of recording fee from the petitioners, a copy of this ce duly certified by the City Clerk shall be filed in the office of the Recorder f Pulaski County and recorded in the deed records of this county.
