WHEREAS, in 2009, the City of Little Rock acquired the former Western Hills Golf Course which added 127 acres to the City's Parks System; and, WHEREAS, since acquisition of this park land, the Parks and Recreation Staff has met regularly with area neighborhoods to develop a master plan for park improvements; and, WHEREAS, passage of a subsequent tax measure has provided $1,000,000 over ten (10) years for use towards improvements for this park; and WHEREAS, an adjacent landowner has approached Parks staff with an offer to sell 6.03 acres on the western side of the park property for the amount of $100,000 but has accepted a $48,000 counter - offer; and, WHEREAS, an environmental assessment has been prepared with no hazards found, and a title search revealed a clear title for acquisition of the property by the City; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby authorizes the City Attorney to prepare the appropriate documents prepared to enable the City to acquire 6.03 acres on the western side of the former Western Hills Golf Course property. The Mayor is authorized to execute all documents necessary to close the transaction. Section 2. Funding for the purchase of this property is available from recent tax passage. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 4. Repealer.
