3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE AN EASEMENT ON BEHALF OF ENTERGY, INC., FOR THE
5 PLACEMENT OF EQUIPMENT IN MACARTHUR PARK; AND FOR
6 OTHER PURPOSES.

8 WHEREAS, as part of a street improvement project on McMath Avenue adjacent to MacArthur Park
9 Entergy, Inc., has been required to relocate certain facilities, and is placing these facilities underground;
10 WHEREAS, as the result of this project it is necessary for Entergy, Inc., to move its facilities from
11 the current right -of -way; and,
12 WHEREAS, the facilities will now be placed on property at the edge of MacArthur Park; and,
13 WHEREAS, pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2012), it is necessary for the
14 Board of Directors to adopt a resolution to authorize the Mayor and the City Clerk to execute all
15 necessary documents that deal with the grant of this easement;
16 NOW, THEREORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Mayor and City Clerk are authorized to execute agreements in substantially the same
19 form as those attached as Exhibit A to this Resolution to grant a permanent easement to Entergy, Inc., for
20 the property identified in the easement and more particularly described as follows:
21 A permanent utility easement located in a part of the Southwest quarter of
22 Section 2 and a part of the Northwest quarter of Section 11, Township 1 North
23 Range 12 West, Pulaski County, Arkansas, more particularly described as

Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
