AN ORDINANCE VACATING, ABANDONING, AND CLOSING
PORTIONS OF "C" STREET, ALSO KNOWN AS "J" STREET,
IN THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed by the Success Corporation
and others, with the Board of Directors of the City of Little Rock,
Arkansas, on the 15th day of October, 1958, asking the Board of
Directors of the City of Little Rock, Arkansas, to vacate, abandon,
and close certain portions of "C" Street, also known as "J" Street,
Success Addition to the City of Little Rock, Arkansas, located South
of and adjacent to Blocks 6, 7, and 8, of Success Addition to the
City of Little Rock, and North of and adjacent to Blocks, 9, 10, and
11 of the said Success Addition to the City of Little Rock, Arkansas,
and as more particularly described hereinafter; and
WHEREAS, after due notice as required by law, the Board of
Directors of the City of Little Rock, Arkansas has, at the time and
place mentioned in the notice, held a public hearing upon the question
of closing the said portions of "C" Street, also known as "J" Street,
hereinafter described; and
WHEREAS, Petitioners are the owners of all lands abutting upon
the said portions of "C" Street, also known as "J" Street, located
adjacent to and South of Blocks 6, 7, and 8, Success Addition, and
North of Blocks 9, 10, and 11, of Success Addition, have never been
physically opened and improved, and no street or road has ever been
constructed on the right -of -way therefor, and said Portions of "C" Street,
also known as "J" Street have not been actually used by the public as
a street or alley for a period of five years, and the portion of "C"
Street, also known as "J" Street, located adjacent to and South of
Blocks 6, 7, and 8, and adjacent to and North of Blocks 9, 10, and
11, Success Addition, is no longer needed for corporate purposes, or
for travel of any kind whatsoever;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby releases,
vacates, and abandons all its rights, together with the rights of the
public generally, but excepting any easements now in effect for utility
lines, in and to the said portions of *C* Street, also known as "J"
Street, designated as follows and upon the plat of Success Addition to
the City of Little Rock, Arkansas, of record with the Pulaski County,
Arkansas, Circuit Clerk and Recorder, a certified copy of which plat
is filed herein with the Little Rock City Clerk:
Those portions of "C" Street, also known as "J" Street,
Success Addition to Little Rock, Arkansas, adjacent to
and abutting on the South lines of Blocks 6, 7, and 8,
and the North boundaries of Blocks 9, 10, and 11, of the
said Success Addition to the City of Little Rock, more
particularly described as follows:
Beginning at the Northwest corner of Block 11, thence East
to the Northeast corner of said Block 11, thence North 40
feet to Southeast corner of Block 6, thence West to Southwest
corner of Block 6, thence South 40 feet to point of beginning;
Beginning at the Northwest corner of Block 10, thence East to
the North east corner of Block 109 thence North 40 feet to
Southeast corner of Block 7, thence West to Southwest corner
of Block 7, thence South 40 feet to point of beginning;
Beginning at the Northwest corner of Block 9, thence East to
the Northeast corner of Block 9, thence North 40 feet to
Southeast corner of Block 8, thence West to Southwest corner
of Block 8, thence South 40 feet to point of beginning.
SECTION 2. A copy of this Ordinance duly certified by the
Little Rock City Clerk shall be filed in the office of the Recorder
of Pulaski County, Arkansas, and recorded in the deed records of said
County.
