AN ORDINANCE REQUIRING OPERATORS OF STATIONARY BOILERS
AND /OR REFRIGERATION SYSTEMS TO BE LICENSED; CREATING
A BOARD OF EXAMINERS TO EXAMINE APPLICANTS FOR SUCH
LICENSE; FIXING THE LICENSE FEE THEREFOR; DECLARING AN
EMERGENCY; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
a, SECTION 1. It shall be unlawful for any person or persons

to operate any boiler at a pressure in excess of 15 PSIG steam
C) pressure or 30 PSIG water pressure, or any refrigerating machine
or system having a rated capacity in excess of 25 tons, or any
boiler regardless of pressure located in public buildings,

o hospitals, hotels, churches, theatres or any other place where

'o a license to do so. Boilers and refrigeration systems under

the jurisdiction of the U. S. Government and locomotive boilers
are exempt from the provisions of this ordinance.
Further, it shall be unlawful for any person or persons,
partnership, association, company or corporation, to knowingly
employ or keep in their employ for the purpose of operating any
boiler or refrigeration machine or system as covered by this
ordinance, any engineer or other person who has not been licensed
by the Board of Examiners of the City of Little Rock.
SECTION 2. The Board of Directors shall within thirty (30)
days after the passage of this ordinance appoint a Board of
Examiners, which shall consist of three members, one of whom
shall be an engineer, or a person who shall have had at least
ten years experience in the operation and /or maintenance of steam
boilers; and one member who shall have had at least five years
experience in the operation and /or maintenance of refrigeration
systems. Within thirty (30) days after the appointment, the
members of said Board of Examiners shall meet and organize by
the election of a chairman and secretary. The Chairman shall serve

for a term of three years; the secretary shall serve for a term
of two years; and the third member of said Board shall serve
for a term of one year.
SECTION 3. The Board of Examiners is hereby authorized and
empowered to promulgate and adopt such rules and regulations
as are necessary to carry out the provisions of this ordinance
and not in conflict with other ordinances or rules.
SECTION 4. The Board of Examiners upon sufficient proof
being presented may suspend or revoke the license of any licensee
for incompetency or untrustworthiness or willful violation or
neglect of any of the safety laws or rules relative to the boiler
and refrigeration systems, provided all such licensees shall be
entitled to a full and impartial hearing before said Board to show
cause why such license should not be revoked.
SECTION 5. To the extent permitted by this Ordinance where
the application of a rule would cause expense materially out of
proportion to the increase or safety obtained thereby, or would
be unreasonable under the facts of the particular case, and where
in the opinion of the Board of Examiners adequate safety is or
can be maintained in other ways, said Board of Examiners may, upon
adequate showing by the person affected, grant an exemption or modi-
fication of the rule complained of. This exemption or modification
shall be based on such requirements as will secure a reasonable
condition of safety provided such exemption or modification be
not in conflict with Ordinance or Law.
SECTION 6. Each applicant who shall present himself for
examination before the Board of Examiners shall pay a fee of
Five Dollars ($5.00) to the City Collector which shall be credited
to the General Revenue Fund of the City of Little Rock.
SECTION 7. Any person who has been granted a license by the
Board of Examiners may have same renewed at the beginning of each

calendar year by paying a renewal fee in the amount of Two and
50/100 Dollars ($2.50) to the City Collector, which sum shall
be credited to the General Revenue Fund of said City.
SECTION 8. The City of Little Rock shall, by its annual
budget, appropriate a sufficient sum of money necessary to
defray any and all expenses of the Board of Examiners in the
administration of the provisions of this ordinance.
SECTION 9. It shall be the duty of the Chief of Police to
give to the Board of Examiners full Police powers and render all
possible assistance to enforce the provisions of this ordinance.
For this purpose the Board of Examiners and the Police shall have
authority to enter upon any premises containing a boiler or re-
frigeration systems covered by this ordinance for the purpose of
ascertaining whether or not said boiler or refrigeration system
is being operated by licensed personnel.
SECTION 10. Any person violating provisions of this ordi-
nance shall be guilty of a misdemeanor, and upon conviction shall
be fined in any sum not less than Ten Dollars ($10.00) nor more
than Twenty -Five Dollars ($25.00), and each day such violation
shall continue shall constitute a separate offense.
SECTION 11. If any section or sections of this ordinance
shall be declared unconstitutional by any Court of this State,
that fact shall not affect the remaining sections of said ordi-
nance, and they shall continue in full force and effect.
SECTION 12. It has been determined that by screening and
licensing operators of stationary boilers and /or refrigeration
systems within the City of Little Rock that such systems can be
operated with a greater degree of safety to lives and property
and that the lack of such is detrimental to the public peace,
health and safety; now therefore, an emergency is hereby de-
clared to exist and this ordinance being necessary for the pre-

servation of public peace, health and safety shall be in full
force and effect from and after its passage and approval; and
all ordinances and parts of ordinances in conflict herewith are
hereby repealed.
