HomeMy WebLinkAbout10999ORDINANCE NO. 10,999 AN ORDINANCE DEFINING AIRPORT LIMOUSINE SERVICE; AUTHORIZING THE LITTLE ROCK AIRPORT COMMISSION TO CONTRACT FOR SUCH SERVICE; ESTABLISHING THE MINIMUM STANDARDS AND QUALIFICATIONS FOR SAID SERVICE; PROVIDING RATES FOR SAID SERVICE; CREATING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. "Airport Limousine Service" is hereby defined to be the furnishing of limousine service to the public between the Municipal Airport and any place within the City of Little Rock. Provided, however, that all trips by any vehicle employed in such service shall either originate or terminate at the Little Rock Municipal Airport Administra- tion Terminal. SECTION 2. Except as otherwise hereinafter provided, the Little Rock Municipal Airport Commission is hereby granted the sole and -excll�- sive control and jurisdiction over Airport Limousine Service as provided for by this ordinance. Said Commission is hereby authorized to contract for such Airport Limousine Service as in its opinion the public conven- ience and necessity demands. SECTION 3. Each vehicle in the Airport Limousine Service must have a weight of not less than 4400 lbs. curb weight including accessories and equipment; must be air conditioned; must be of uniform color; must be adequately marked with the words "Limousine Service;" must be num- bered; must be at least a five (5) passenger vehicle; and, must not be more than four (4) years old. SECTION 4, No person, firm or corporation shall be authorized to operate and furnish Airport Limousine Service unless and until such person, firm or corporation shall have furnished and filed with the Little Rock Municipal Airport Commission a policy of insurance written by a Company authorized to do business in the State of Arkansas, to be approved by the Commission, which policy shall bind the Company writing same to indemnify persons, firms or corporations suffering personal injury and /or property damage from the negligent or otherwise faulty operation of such limousine service. No policy shall be approved unless it is subject to the following minimum limits: Not less than $100,000.00 because of bodily injury to or death of any one (1) person in any one (1) accident and not less than DDO��� Q- 8 + `Ir - 2 a, $300,000.00 because of bodily injury to or death of two (2) or more persons in any one (1) accident, and not less than $10,000.00 because of injury to or destruction of property of any person, firm or corporation in any one (1) accident. SECTION 5. The rates which may be charged for limousine service shall be such as from time to time is fixed by the Board of Directors of the City of Little Rock. SECTION 6. The owners and /or operators of Limousine Service as provided for by this ordinance shall comply with any and all rules and regulations promulgated by the Little Rock Municipal Airport Commission in connection with the loading and unloading of passengers at the Muni- cipal Airport and the parking of limousine vehicles at said Airport when same are not in service. Further, the Little Rock Municipal Airport Commission is hereby authorized to promulgate such rules and regulations not inconsistent with the provisions of this ordinance as it deems necessary to provide the public with safe and adequate limousine service. SECTION 7. No person, firm or corporation shall operate a limousine service in this City except pursuant to the provisions of this ordinance. SECTION 8. No member of the Little Rock Municipal Airport Commission or its employees shall be interested either directly or indirectly in any contract let pursuant to the provisions of this ordinance. SECTION 9. It is hereby declared to be a misdemeanor for any per- son, firm or corporation to violate any of the provisions of this ordi- nance and such violations shall, on conviction, be punishable by a fine of not less than .tj5.00 and not more than $250.00 or imprisonment for not less than one day and not more than 30 days, or both fined and im- prisoned. SECTION 10. Ordinances numbered 6744, 6895, and 10,092, and all other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION ll. Transportation service between the Little Rock Munici- pal,A,irport and other points within the City of Little Rock is inadequate and creates a condition injurious to the public peace, health and safety of the citizens of Little Rock; and this ordinance will appreciably improve this condition; now therefore, an emergency is hereby declared - 3 - to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall be in full force and effect from and after its passage.
