AN ORDINANCE TO .AMEND ORDINANCE NO. 10,849, SAME BEING AN ORDINANCE
ESTABLISHING THE SUBDIVISION RULES AND REGIILA,TIONS OF THE LITTLE ROCK
PLANNING AREA, BY AMENDING THE DE+'INITION OF THE WORD "SUBDIVISION
DEFINITION ", OF SECTION 2, SUBSECTION 2.2.23 OF SAID ORDINANCE.
VHEREAS, the Little Rock Planning Commission has submitted to the
Board of Directors, a reco:arnended amendment to Section 2, of Ordinance
--No. 10,849, Subdivision Rules and Regulations, Little Rock, Arkansas.
WHEREAS, said recommendation was adopted after due notice and public
hearing as required by law; and
WHEREAS, the City of Little Rock is desirous of accepting said
recommendations;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION 1. Section 2, Subsection 2.2.23 of Ordinance No. 10,849, is
hereby amended to read as follows:
2.2.23 Subdivision. A "subdivision" shall include all divisions of a
tract or parcel of land into two or more lots, building sites, or other
divisions for the purpose, whether immediate or future, of sale, or building
development, and shall include all divisions of land involving the dedication
of a new street or a change in existing streets; provided, however, that
the following shall not be included within this definition nor be subject
to the Subdivision Rules and Regulations of this municipality: (1) The
combination or re- combination of portions of previously platted lots where
the total number of lots is not increased and the resultant lots are equal
to or exceed the standards or ordinances of the municipality, (2) the division
of land into parcels greater than five acres where no street right -of -way
dedication is involved; (3) the public acquisition by purchase or dedication
of parcels of land for the widening or opening of streets or other public
improvement s.
SECTION 2. All ordinances and parts of ordinances in conflict herewith,
are hereby- repealed and this ordinance shall be in full force and effect
from and after its passage and approval.
