ORDINANCE NO. 11,014
AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN REAL
PROPERTY SITUATED IN PULASKI COUNTY, ARKANSAS, IN
CONSIDERATION OF THE CONVEYANCE OF OTHER REAL PROPERTY
SITUATED IN PULASKI COUNTY, ARKANSAS, TO THE CITY OF
LITTLE ROCK, ARKANSAS, FOR THE USE AND BENEFIT OF THE
LITTLE ROCK MUNICIPAL WATER WORKS.
WHEREAS, the Board of Commissioners of the Little Rock
Municipal Water Works, by resolution duly enacted on the ae m,
day of November, 1959, has requested the Board of Directors of the
City of Little Rock to approve an exchange of real property and
said Board of Commissioners Leas determined that the exchange will
be fair and reasonable and to tae advantage of tine City;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the Mayor and City Clerk of Little Rock,
Arkansas, be, and they are hereby, authorized and directed to
execute a warranty deed on behalf of the City of Little Rock,
Arkansas, conveying to Pratt C. Remmel the following described real
property situated in Pulaski County, Arkansas, to -wit:
A part of the NEk of the SW� of Section 33, Township 2
North, Range 12 West, more particularly described as
commencing at the Southwest corner of tine NEk of the SWk
of said Section 33 and run thence East 921.9 feet to a
concrete monument; thence North 198.6 feet to the point
of beginning; trience North 234.5 feet; thence South 37
degrees 19 minutes East a distance of 177.3 feet; thence
South 49 degrees 00 minutes West a distance of 142.4
feet to the point of beginning, containing 0.289 acre,
more or less, subject to existing easements, if any;
said conveyance to be in consideration of the conveyance by J. D.
Walthour, Trustee, and Hettie Walthour, his wife, to the City of
Little Rock, Arkansas, for the use and benefit of the Little Rock
Municipal Water Works, of the following described real property
situated in Pulaski County, Arkansas, to -wit:

point of beginning; thence continuing East 84.7 feet to
a concrete monument; thence North 198.6 feet; thence
South 49 degrees 00 minutes West a distance of 112.2
feet; thence South 125 feet to the point of beginning,
containing 0.315 acre, more or less, subject to existing
easements, if any.
SECTION 2. That this ordinance shall take effect and be
in force from and after its passage.

EXCERPT FROM MINUTES OF REGULAR MEETING OF THE BOARD
OF COMMISSIONERS OF THE LITTLE ROCK MUNICIPAL WATER
WORKS HELD ON NOVEMBER a d tom. , 1959
The Board of Commissioners of the Little Rock Municipal
Water Works met in regular session at the office of the Little Rock
Municipal Water Works, Robinson Memorial Auditorium, Little Rock,
Arkansas, at 9:00 A.M. on the 21 a day of November, 1959. All
members of the Commission were present.
The following resolution was introduced and read and, pur-
suant to motion duly made and seconded, was unanimously adopted:
R E S O L U T I O N
WIjEREAS, the City of Little Rock, Arkansas, for the use
and benefit of the Little Rock Municipal Water Works, is tie owner
of the following described lands situated in Pulaski County,
Arkansas, to -wit:

A part of the NE4 of the SW4 of Section 33, Township 2
North, Range 12 West, more particularly described as
commencing at the Southwest corner of the NE4 of the SW4
of said Section 33 and run hence East 921.9 feet to a
concrete monument; thence North 198.6 feet to the point
of beginning; thence North 234.5 feet; thence South 37
degrees 19 minutes East a distance of 177.3 feet; thence
South 49 degrees 00 minutes West a distance of 142.4
feet to the point of beginning, containing 0.289 acre,

WIEREAS, J. D. Walthour, Trustee, is t ie owner of the
following described lands situated in Pulaski County, Arkansas, to-
wit:

commencing at the Southwest corner of the NE-14 of the SW4
of said Section 33 and run thence East 837.2 feet to the
point of beginning; thence continuing East 84.7 feet to
a concrete monument; thence North 198.6 feet; thence
South 49 degrees 00 minutes West a distance of 112.2
feet; thence South 125 feet to the point of beginning,
containing 0.315 acre, more or less, subject to existing
easements, if any;

WHEREAS, the said J. D. Walthour, Trustee, has proposed
to convey his aforesaid lands to the City of Little Rock, Arkansas,
for the use and benefit of the Little Rock Municipal Water Works,
in exchange for the conveyance of the aforesaid lands of the City
to Pratt C. Remmel; and
WHEREAS, the Board of Commissioners of the Little Rock
Municipal Water Works believes that said exchange would be to the
advantage of the City; that the lands to be received by the City
will be more suitable for waterworks purposes than the lands to be
conveyed by the City; and that each of the aforesaid tracts is of
approximately equal value; Now, Therefore,
BE IT RESOLVED by the Board of Commissioners of the
Little Rock Municipal Water Works that the Board of Directors of the
City of Little Rock, Arkansas, be requested to enact an ordinance
authorizing the aforesaid exchange and directing the Mayor and the
City Clerk of Little Rock, Arkansas, to execute a warranty deed for
the said City conveying the property first described above to Pratt
C. Remmel in consideration of the conveyance of the property last
described above by J. D. Walthour, Trustee, and Nettie Walthour,
his wife, to the City of Little Rock, Arkansas, for the use and
benefit of the Little Rock Municipal Water Works.
CERTIFICATE
I, Frank Lyon, Secretary - Treasurer of the Board of Commis-
sioners of the Little Rock Municipal Water Works, certify that I,
as such Secretary, have custody of the minutes and documents of the
Little Rock Municipal Water Works, and that the foregoing type-
written matter contains a true, complete and compared copy of the
extract of the original minutes of said meeting, insofar as they
relate to tae exchange of property described therein, as the same
appears in the minutes records on file with me as such Secretary.
