SECTION 1. The Missouri Pacific Railroad Company, a Missouri
corporation, its successors and /or assigns, is hereby granted an
easement over, a.nd is authorized to construct, maintain and operate,
at the expense of the said T,'Iissouri Pacific Railroad Company, its
successors and/ov assigns, a spur track across East 1,1ourth Street
and along the east ten feet of the sixty foot right of way of John
Street or Line Street as platted in Garlands addition Chancery
Court ,ecord gook Y at Page 37, from Last Fourth Street to Nast
Third Street in the City of Little Roca, Arkansas; said spur track
to be constructed at a location to be approved by the City engineer,

facilities with the 1issouri Pacific Railroad,
SECTION 2, Said Missouri Pacific Railroad Company, its
successors or assigns, shall maintain said track so that the top
of the rails shall be on a level with the grade of East Fourth
Street as now or hereafter established, and shall be built and main-
tained so as not to interfere with any water way or flow of same,
and the City shall have the right to alter said r;rade at its pleasure
without responsibility to the railroad, its successors or assigns.
The railroad, its successors or assigns, shall also maintain between
the rails of said track and two (2) feet on each side thereof pave -
ment of like character and material as is now.. or may be hereafter,
constructed at said point.
Sl.0'111I0N 3. The use of said track shall be so conducted as not
to interfere with the usual traffic along East r'ourth Street and
John Street or Line Street.

Sii,,CTIOd 4. 'or this grant the said iliissouri Pacific railroad
Company, its successors or assigns, shall ljay to the City the sum of
Twenty -five Dollars (25.00) per annum, payable annually in advance.
SECT LON 5. This !_rant shall be and remain in force and effect
for a period of ten (10) years from and after the gate of the
acceptance of this ordinance by the DUssouri Pacific Railroad Com-
pany, provided that same is accepted within ninety (90) days after
its passage.
SECTION 6. It has been found, and is hereby declared, that
the postponement of the effective date of this ordinance will cause
delay in the construction of said spur track, and said track is
needful and important from the standpoint of the public welfare. It
is, therefore, declared that an emergency exists, an(i the ordinance,
being necessary for the preservation of the public welfare, 1peace.,
health and safety, shall take effect and be in force from and after
the date of its passage and acce Dtance.
