HomeMy WebLinkAbout11052ORDINANCE NO. 1190,52 AN ORDINANCE DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION PROCEEDINGS AGAINST CERTAIN PARCELS OF REAL PROPERTY FRONTING ON BROADWAY STREET IN THE CITY OF LITTLE ROCK TO BE USED FOR THE PURPOSE OF WIDENING AND PAVING BROADWAY STREET; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Attorney is hereby ordered and directed to file in the proper courts proceedings for the condemnation of the following described parcels of real property situated in said City of Little Rock, Arkansas: I. Beginning at the NW corner of Lot No. 1, Block 4, E. W. Gibbs Addition to the City of Little Rock, Arkansas, thence south 49.42 feet, thence east 12 feet, thence north 49.42 feet, thence west 12 feet to the point of beginning; further described as the west 12 feet of Lot No. 1 and the west 12 feet of the north 25.5 feet of Lot No. 2 of said Block 4, E. W. Gibbs Addition. Said property is owned by Justin Lewis Daugherty and Minnie Daugherty, his wife. 2. Beginning at a point which is 49.42 feet south of the NW corner of Lot No. 1, Block 4, E. W. Gibbs Addition to the City of Little Rock, Arkansas, thence South 49.42 feet, thence East 12 feet, thence north 49.42 feet, thence west 12 feet to the point of beginning; further described as the west 12 feet of the south 24.5 feet of Lot No. 2 and the west 12 feet of the north one -half of Lot 3 of the said Block 4, E. W. Gibbs Addition. Said property is owned by Charles H. Andrews and Lois Andrews, his wife. 3. Beginning at the SW corner of Lot No. 4, Block 4, E. W. Gibbs Addition to the City of Little Rock, Arkansas, thence north 74.65 feet, thence east 12 feet, thence south 74.65 feet, thence west 12 feet to the point of beginning; further described as the west 12 feet of the south one -half of Lot No. 3 and the west 12 feet of Lot No. 4 of the said Block 4, E. W. Gibbs Addition. Said pro- perty is owned by James T. Rhyne and Martha Regina Rhyne Frazier. The properties hereinabove described are necessary to be utilized for the purpose of widening Broadway Street in the City of Little Rock, Arkansas. SECTION 2. The City Attorney is further directed to secure an Order of the court allowing the City to take immediate possession of the pro- perties described hereinabove upon its posting a bond in an amount to be determined by the Court. The City Attorney is authorized to have posted on behalf of the City a bond in the amount determined by the Court pending final determination of the condemnation proceedings. SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. GG%G -//0 � 1 _2_ SECTION 4. It has been found and determined that the safety of the citizens of the City of Little Rock are jeopardized by reason of the narrow width of Broadway Street and that the condemnation of these parcels of real property will enable the widening of said Street so as to reduce said traffic hazard; now therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of public peace, health and safety, shall be in full force and effect from and after its passage and approval.
