HomeMy WebLinkAbout11053ORDINANCE NO. 11., 0,53 AN ORDINANCE DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION PROCEEDINGS AGAINST CERTAIN PARCELS OF REAL PROPERTY FRONTING ON CANTRELL ROAD IN THE CITY OF LITTLE ROCK TO BE USED FOR THE PURPOSE OF WIDENING AND PAVING SAID CANTRELL ROAD; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Attorney is hereby ordered and directed to file in the proper courts proceedings for the condemnation of the following described parcels of real property situated in said City of Little Rock, Arkansas: 1. The North 4.25 feet of Lot 23, Block 3, McGehee's Addition to the City of Little Rock. Said property is owned by Van H. Weathersby and Isabel M. Weathersby, his wife. 2. The North 4.25 feet of Lot 12, Block 3, McGehee's Addition to the City of Little Rock. Said property is owned by Florence M. Gaunt. 3. The North 4.25 feet of Lot 11, Block 3, McGehee's Addition to the City of Little Rock. Said property is owned by Henry C. Stephan and Maude S. Stephan, his wife. 4. The North 4.25 feet of Lot 19, Block 2, McGehee's Addition to the City of Little Rock. Said property is owned by J. R. Duff and Minnie Duff, his wife. 5. The North 9 feet of Lot 58, Cliffewood Addition to the City of Little Rock, Arkansas. Said property is owned by Mrs. Mary B. Jeter. 6. The South 3.5 feet of Lot 7, Block 14, Mountain Park Addition to the City of Little Rock. Said property is owned by W. M. Freyaldenhoven and Virgie Lee Freyaldenhoven, his wife. The properties hereinabove described are necessary to be utilized for the purpose of widening Cantrell Road in the City of Little Rock, Arkansas. SECTION 2. The City Attorney is further directed to secure an Order of the court allowing the City to take immediate possession of the pro- perties described hereinabove upon its posting a bond in an amount to be determined by the court. The City Attorney is authorized to have posted on behalf of the City a bond in the amount determined by the Court pending final determination of the condemnation proceedings. SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. 01 s J -2- SECTION 4. It has been found and determined that the safety of the citizens of the City of Little Rock are jeopardized by reason of the narrow width of Cantrell Road and that the condemnation of these parcels of real property will enable the widening of said Cantrell Road so as to reduce said traffic hazard; now therefore, an emergency is hereby de- clared to exist and this ordinance being necessary for the preservation of public peace, health and safety, shall be in full force and effect from and after its passage and approval.
