HomeMy WebLinkAbout110574 V; ORDINANCE NO. 11,057 AN ORDINANCE ACCEPTING THE LOW BID OF JOHN LEE MORTON IN THE AMOUNT OF THIRTY FOUR THOUSAND, SIX HUNDRED TWENTY ONE AND 60/100 DOLLARS ($342621.60) FOR THE CONSTRUCTION OF A DOG POUND TO BE ERECTED UPON CITY PROPERTY; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT ON BEHALF OF THE CITY OF LITTLE ROCK WITH JOHN LEE MORTON FOR THE SAID CONSTRUCTION; APPROPRIATING CERTAIN FUNDS; REPEALING ORDINANCE NO. 11,046; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City of Little Rock by proper advertisement requested bids for the construction of a dog pound to be located near the Sanita- tion Department Shops upon property owned by the City; and WHEREAS, the bid of John Lee Morton of Thirty -Four Thousand, Six Hundred Twenty -One and 60/100 Dollars ($34,621.60) is the lowest bid submitted therefor; and WHEREAS, the City is desirous of awarding a contract for the construc- tion of said dog pound to John Lee Morton; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. A contract for the construction of the building for use as a dog pound by the City at a cost to the City of Thirty -Four Thousand, Six Hundred Twenty -One and 60/100 Dollars ($34,621.60) is hereby awarded to John Lee Morton as the lowest responsible bidder therefor. SECTION 2. The Mayor and City Clerk are hereby authorized and directed to execute a contract with John Lee Morton for the construction of the dog pound building in keeping Vith the Standards and Specifications approved in Resolution No. 2501 and pursuant to the Bid Proposal, which Agreement shall be in form and words as follows, the bid proposal and specifications being incorporated therein by reference in full as if set out word for word and paragraph for paragraph: 600-14 A,1 z I ., . . SECTION 3. There is hereby appropriated from unappropriated surplus the sum of Eleven Thousand, Seven Hundred and No /100 Dollars ($11,700.00) to Account No. 131 -8.1, for the purpose of adding to the existing funds in said account, sufficient sums to meet the obligation of the City here- under, and the City Manager and Director of Finance are hereby authorized and directed to execute the necessary warrants for payment of the sums due to John Lee Morton as and when they become due. SECTION 4. Ordinance No. 11,046 and all other ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 5. It has been found and determined that the immediate con- struction of a new dog pound building is essential and that the existing facilities are inadequate and subject to abatement at the hands of the now owner thereof, which places in jeopardy the health, safety and wel- fare of the citizens of this City; and, that by.the immediate erection of a new dog pound according to the plans and specifications herein pro- vided for, said hazardous condition will be corrected; now therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of public peace, health and safety shall be in full force and effect from and after its passage and approval. ACCEPTANCE AND FINAL PAYMENT Final payment shall be due IFTEEN days after substantial completion of the work provided the work be then fully completed and the contract fully performed. Upon receipt of written notice that the work is ready for final inspection and acceptance, the Architect shall promptly make such inspection, and when he finds the work acceptable under the Contract and the Contract fully performed he shall promptly issue a final certificate, over his own signature, stating that the work provided for in this Contract has been completed and is accepted by him under the terms and con- ditions thereof. and that the entire balance found to be due the Contractor, and noted in said final certificate, is due and payable. Before issuance of final certificate the Contractor shall submit evidence satisfactory to the Architect that all payrolls, material bills, and other indebtedness connected with the work have been paid. If after the work has been substantially completed, full completion thereof is materially delayed through no fault of the Contractor, and the Architect so certifies, the Owner shall, upon certificate of the Architect, and without terminating the Contract, make payment of the balance due for that portion of the work fully completed and accepted. Such payment shall be made under the terms and conditions governing final payment, except that it shall not constitute a waiver of claims. AGREEMENT BETWEEN CONTRACTOR AND OWNER.
