HomeMy WebLinkAbout11060s ORDINANCE NO. 11,060 AN ORDINANCE WAIVING IN A PARTICULAR AREA THE PROVISIONS OF ORDINANCE N0. 10,8082 SAME BEING AN ORDINANCE ESTABLISHING STANDARDS FOR STREETS AND OTHER IMPROVEM NTS; PROVIDING FOR CERTAIN FRANCHISES; DECLARING AN EMERGENCY;.AND FOR OTHER PURPOSES. WHEREAS, a certain portion of the E2 of the NE4, NE4, Section 1, Township 1 North, Range 13 West, Pulaski County, Arkansas, is being developed into a sizable shopping center with improved surface; and WHEREAS, a portion of B Street lying between University Avenue and the West line of the E2 of the said NE-411 NEW' is dedicated fifteen (15} feet in width; and WHEREAS, it is impractical and not in the best interest of the City of Little Reek, or of the public, to enforce all of the provisions of Ordinance No. 10,808 of the City of Little Rock, Arkansas; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby waives all street improvement requirements as promulgated and set forth in Ordinance No. 10,808 which are at variance with, or in conflict with, the street widths and paving specifications filed in the Office of the Director of Public Works by Real Properties, Inc. The City of Little Rock hereby specifically waives the provisions of Ordinance No. 10,808 as same affects the improvement of B Street between University Avenue and the West line of the E2 of the NE-i&- NE4, Section 1, Township 1 North, Range 13 West, Pulaski County, Arkansas. SECTION 2. The City of Little Rock hereby grants unto Real Properties, Inc., its successors and assigns, the right and license to construct and maintain for a term of 50 years from the passage of this Ordinance an overpass above B Street, according to the plans and specifications now on file in the Office of the Director of Public Works of the City of Little Rock, for pedestrian crossings in accordance with the construction standards set out in Ordinance No. 10,808 or such other Ordinances as may be appli- cable thereto. SECTION 3. The City of Little Rock hereby grants unto Real Properties, Inc., its successors and assigns, the right and license to lay beneath the above described portion of B Street, in addition to the customary utility service lines, a service tunnel beneath the portion of said B Street C3 -�/ -2- connecting the power plant to be constructed North of B Street with the main shopping center building area South of B Street for the purpose of carrying such air - conditioning, heating and wiring ducts and conduits as is necessary. SECTION 4. The City of Little Rock hereby closes temporarily that part of B Street between University Avenue and the West line of the E2 of the 'NE4a Section 1, Township 1 North, Range 13, West, Pulaski County, Arkansas, said Street to be reopened for public use upon completion of the grading and paving to be done by Real Properties, Inc.; said reopening to occur, in no event, later than October 1, 1960. SECTION 5. Whereas, the improving of B Street is an integral part of the plans and specifications for development of the E2 of the WE NE4, Section 1, Township 1 North, Range 13 West, Pulaski County, Arkansas; and Whereas, it is not possible for the City of Little Rock to improve said fifteen (15) foot dedicated right -of -way for public use; and Whereas, enforcement of Ordinance No. 10,808 will work an undue hardship upon the therefore, an emergency being necessary for the or beneficial to the pul health and safety shall passage and approval.
