BE, IT 0 BOAR* OF DIRECTORS OF LITTLE ROCK, ARKANSAS, AS FOLLOWS•. R. ART " - WORDS AND PHRASES DEFINED M Sec.' Defini ion of words and phrases. - The following words and phrases when used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them in this article. Subdivision 1. - Vehicles, Traffic, Etc., Defined Sec. 2. (A) Vehicle. - Every deftce in, upon, or by which any person or property is -or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks. (b) Motor vehicle which is self - propelled. (c) Commercial vehicle. - Every vehicle designed, maintained or used primarily for the transportation of property. (d) Authorized emergency vehicle. - Vehicles of the fire de- partment, police vehicles, and such ambulances and emergency vehicles of municipal departments or public service corporations as are designated or authorized by the Board of Directors of this City. Sec. 3. (a) Bicycle. - Every device propelled by human power upon which any person may ride, having two tandem wheels either of which is over 20 inches in diameter. (b) Motorcycle. - Every motor vehicle having a saddle for the use of the rider and designed to travel on not more than three wheels in con- tact with the ground, but excluding a tractor. Sec. 4. (a).Railroad. - A carrier of persons or property upon cars, operated upon stationary rails. Sec. 5. Traffic. - Pedestrians, vehicles, and other conveyances either singly or together while using any street for purposes of travel. Sec. 6. Right -of -way. - The privilege of the immediate use of the roadway. Sec. 7. (a) Stop. - When required means complete cessation of movement. (b) Stop, stopping or standing. When prohibited means any stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic- control sign or signal. (c) Park. - When prohibited means the standing of a vehicle, whether occupied or'bet, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading. Sec. 8. Offigi.al time standard. - Whenever certain hours are named herein they shall mean standard time or daylight - saving time as may be in current, use in this City. i 0,90 �� s Subdivision 11. - Person, Etc., Defined Sec. 9.(a) Person. - Every natural person, firm, copartnership association, or corporation. (b) Driver. - Every person who drives or is in actual physical control of a vehicle. (c) Pedestrian. - Any person afoot. Sec. 10. (a) Police Officer. - Every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. (b) Traffic division. - The traffic division of the police depart- ment of this city, or in the event a traffic division is not established, then said term whenever used herein shall be deemed to refer to the police department of this city. Subdivision 111. - Streets, Etc., Defined Sec. 11 (a) Street or highway. - The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. (b) Private road or driveway. - Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons. (c) Roadway. - That portion of a street or highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separate roadways the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways collectively. (d) Sidewalk. - That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. (e) Alley. - A way which affords only a secondary means of access to abutting property and which is less than twenty -five feet wide. Sec. 12. (a) Laned roadway. - A roadway which is divided into two or more clearly marked lanes for vehicular traffic. (b) Through highway. - Every street or highway or portion thereof at the entrances to which vehicular traffic from intersecting streets or highways is required by law to stop before entering or crossing the same and when stop signs are erected as provided in this ordinance. (c) Controlled- access highway. - Every highway, street, or roadway in respect to which owners or occupants of abutting property or lands and other persons have no legal right of access to or from the same, except at such points only and in such manner as may be determined by the public authority having jurisdiction over such highway, street, or roadway. Sec. 13. Intersection. - (a) The area embraced within the prolonga- tion or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at or approximately at right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict. (b) Where a highway includes two roadways (30) feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways (30) feet or more apart, then every crossing of two roadways of such highways shall be regarded as a separate intersection. 2 I 9 w Sec. 14. Cross walk - (a) That part of a roadway at an intersection included within the connections.of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the traversable roadway. (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface. Sec. 15. (a) Safety zone. - The area or space officially set apart within a roadway -for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone. (b) Curb loading zone. - A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. (c) Passenger curb loading zone. - A place adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers. (d) Freight curb loading zone. - A space adjacent to a curb for the exclusive use of vehicles during the loading or unloading of freight or passengers. Sec. 16. (a) Official traffic - control devices. - All signs, signals, markings, and devices not inconsistent with this ordinance placed or erected by authority of 'a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic. (b) Traffic - control signal. - Any device, whether manually, elec- trically, or mechanically operated, by which traffic is alternately directed to stop and to proceed. Sec. -17. (a) Business district. - The territory contiguous to and including a highway when within any 600.feet along such highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks or office buildings, railroad stations, and public buildings which occupy at least 300 feet of frontage on onie side or 300 feet collectively on both sides of the highway. (b) Residence district. - The territory contiguous to and including a highway not comprising a business district when the property on such highway for a distance of 300 feet or more is in the main improved with residences or residences and buildings in use for business. Sec. 18. Central business '(or traffic) district. - All streets and portions of streets within the area described as follows: All that area bounded by Cumberland Street on the east, Broadway on the west, Markham Street in the north and 8th Street on the south. ARTICLE 11. Administration and Enforcement Sec. 19. Police Administration. - The police department shall enforce the traffic regulations of this city and all of the state vehicle laws applicable to street traffic in this city, to make arrests for traffic violations, to investigate accidents and to co- operate with the Traffic Engineer and other officers of the city in the administration of..the traffic regulations and in developing ways and means to improve traffic conditions. 3 Sec. 20. Traffic Engineer. - The Traffic Engineer shall be a qualified engineer and shall be appointed by the City Manager. It shall be his duty to determine the installation and proper timing and main- tenance of traffic - control devices, to conduct engineering analysis of traffic accidents and to devise remedial measures, to conduct engineering investigation of traffic conditions, to plan the operation of traffic on the streets and highways of this city, and to cooperate with other city officials in the development of ways and means to improve traffic con - *ditions, and to carry out such additional powers and duties as may be imposed by ordinance. Sec. 21. Records of Traffic Violations. - The police department shall keep a record of all violations of the traffic ordinances of this city or of the state vehicle laws of which any person has been charged, together with a record of the final disposition of all such alleged offenses. Such record shall be so maintained as to show all types of violations and the total of each. All such records shall be kept for a period of at least five years. All forms of records of violations and notices of violations shall be serially numbered. For each month and year a written record shall be kept available to the public showing the disposal of all such forms. All such records and reports shall be public records. Sec. 22. Traffic Accident Studies. - Whenever the accidents at any particular location become numerous, the Police Department shall co- operate with the traffic engineer in conducting studies of such accidents and determining remedial measures. Sec. 23. Traffic Accident Reports. - The Police Department shall maintain a suitable system of filing traffic accident reports. Accident reports or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the use and information of the traffic engineer. Sec. 24. Drivers' Files to be Maintained. - The police department shall maintain a suitable record of all traffic accidents, warnings, arrests, convictions, and complaints reported for each driver, which shall be filed alphabetically under the name of the driver concerned. Said department shall study the cases of all the drivers charged with frequent or serious violations of the traffic laws or involved in frequent traffic accidents or any serious accident, and shall attempt to discover the reasons therefor, and shall take whatever steps are lawful and reasonable to prevent the same or to have the licenses of such persons suspended or revoked. Such records shall be kept for a period of five years. Sec. 25. Traffic Division to Submit Annual Traffic Safety Report. - The police department shall annually prepare a traffic report which shall be filed with the City Manager. Such report shall contain information on traffic matters including the following: (a) The number of traffic accidents, the number of persons killed, number of persons injured, and other pertinent traffic data. (b) The number of traffic accidents investigated and other pertinent data en -the safety activities of the police. (c) The plans and recommendations of the division for future traffic safety activities. JSec. 26. Emergency and Experimental Regulations. - The traffic engineer, is hereby empowered to make regulations necessary to make effective the provision& of the traffic ordinances of this city and to 4 r Sec. 20. Emergency and Experimental Regulations. - The traffic engineer, is hereby empowered to make regulations necessary to make effective the provision& of the traffic ordinances of this city and to 4 make and enforce temporary or experimental regulations to cover emergencies or special conditions. The traffic engineer may test traffic - control devices that are under actual conditions of traffic. Sec. 27. Authority of Police and Fire Department Officials. - It shall be the duty of the officers of the police department or such officers as are assigned by the Chief of Police to enforce all street traffic laws of this city and all of the state vehicle laws applicable to street traffic in this city. Officers of the Police department or such officers as are assigned by the Chief of Police are hereby authorized to direct all traffic by voice, hand, or signal in conformance with the traffic laws. Provided, however, that in the event of a fire or other emergency or to expedite traffic or to safe -guard pedestrians, officers of the Police Department may direct traffic as conditions may require, notwithstanding the provisions of the traffic regulations. Officers of the Fire Department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. Sec. 28. Obedience to Police and Fire Department Officials. - No person shall willfully fail or refuse to comply with any lawful order or direction of a police officer or fire department official. Sec. 29. Persons Propelling Pushcarts or Riding Animals to Obey Traffic Regulations. - Every person propelling any pushcart or riding an animal upon a roadway, and every person driving any animal -drawn vehicle, shall be subject to the provisions of the Ordinance in so far as applicable. Sec. 30. Use of Coasters, Roller Skates, and Similar Devices Restricted. - No person upon roller skates or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except.while crossing a street on a crosswalk and when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street while set aside as a play street. Sec. 31. Public Employees to Obey Traffic Regulations. - The Pro- visions of this ordinance shall apply to the driver of any vehicle owned by or used in the service of the United States Government, this state, county, or city, and it shall be unlawful for any said driver to violate any of the provisions of this ordinance. Sec. 32. Exemptions to Authorized Emergency Vehicles. - The driver of an authorized emergency vehicle, when responding to an emergency call or when in pursuit of an actual or suspected violator of the law or when responding to, but not returning from, a fire alarm, may exercise the following privileges, but subject to the conditions herein stated: (a) Park or stand, irrespective of the provisions of this Ordinance. (b) Proceed past a red or stop signal or stop sign, but only after slowing -down as may be necessary for safe operation. (c) Exceed the speed limits so long as he does not endanger life or property. (d) Disregard regulations governing direction of movement or turning -in specified direction. Sec. 33. Limitations on Authorized Emergency Vehicles. - The exemptions herein granted to an authorized emergency vehicle shall apply only when the driver of any said vehicle while in motion sounds audible signal by bell, siren, or exhaust whistle as may be reasonable necessary, and when the vehicle is equipped with at least one lighted lamp displaying a red light visible under normal atmospheric conditions from a distance 5 of five hundred feet to the front of such vehicle. Provided, however, that an authorized emergency vehicle operated as a police vehicle need not be equipped with or display a red light visible from in front of the vehicle. The foregoing provisions shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provision protect the driver from the consequences of any reckless disregard on his part for the safety of others. Sec. 34, Operation of Vehicles on Approach of Authorized Emergency Vehicles. - Upon the immediate approach of an emergency vehicle equipped with at least one lighted lamp exhibiting red light visible under normal atmospheric conditions from a distance of five hundred feet to the front of such vehicle other than a police vehicle when operated as an emergency vehicle and when the driver is giving audible signal by siren, exhaust whistle, or bell, the driver of every other vehicle shall yield the right of way and shall immediately drive to a position parallel to, and as close as possible to, the righthand edge or curb of the roadway clear of any intersection and shall stop and remain in such position until the emergency vehicle has passed. This section shall not operate to relieve the driver of an emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway. Sec. 35. Immediate Notice of Accident. - The driver of a vehicle involved in an accident resulting in injury to or death of any person or property damage to an apparent extent of fifty dollars ($50) or more, shall immediately by the quickest means of communication give notice of such accident to the Police Department. Sec. 36. Written Reports of Accidents. - The driver of a vehicle which is in any manner involved in an accident resulting in bodily injury to or death of any person or total property damage to an apparent extent of fifty dollars ($50) or more shall, within five (5) days after such accident, forward -a written report of such accident to the Police Depart- ment, or a copy of any report he is required to forward to the State. The provisions of this section shall not be applicable when the accident has been investigated at the scene by a Police officer while such driver was present thereat. Sec. 37, When Driver Unable to Report. - Whenever the driver of a vehicle is physically incapable of giving immediate notice of an accident as required herein and there is another occupant in the vehicle at the time of the accident capable of doing so, such occupant shall give, or cause to be given, the notice herein required. Whenever the driver is physically incapable of making a written report of an accident as is herein required and such driver is not the owner of the vehicle, then the owner of the vehicle involved in such accident shall within five (5) days after learning of the accident make such report not made by the driver. Sec. 38. Leaving the Scene of Accident. - No person driving a vehicle, knowing that an injury has been caused to a person or damage has been caused to a person or damage has been caused to property, arising out of the operation of said vehicle, shall leave the place of said injury, damage or accident without stopping and giving his name, residence, in- cluding city and street number, motor vehicle number and chauffeur's or registered operator's number, if any, to the injured party or to the police officer, or if no police officer is in the vicinity, then to the nearest police officer or judicial officer. �, r � ARTICLE III. TRAFFIC - CONTROL DEVICES Sec. 39. Authority to Install Traffic - control Devices. - The traffic engineer shall place and maintain traffic - control signs, signals, and devices when and as required under the traffic ordinances. He may place and maintain such additional traffic - control devices as he may deem necessary to regulate traffic under the ordinances of this city or under state law, or to guide or warn traffic. Sec. 40. Manual and Specifications for Traffic - control Devices. - Traffic control signs, signals and devices shall conform to the manual and specifications approved by the State Highway Commission. All signs and signals required hereunder for a particular purpose shall so far as practicable be uniform as to type and location throughout the city. Sec. 41. Obedience to Traffic - control Devices. - The driver of any vehicle shall obey the instructions of any traffic - control device appli- cable thereto placed in accordance with the ordinances of this city, unless otherwise directed by a police officer. Sec. 42. When Traffic Devices Required for Enforcement Purposes. - No provision of this ordinance for which signs are required shall be enforced against an alleged violation if at the time and place of the alleged violation an official sign is not in proper position and sufficient- ly legible to be seen by an ordinarily observant person. Whenever a particular section does not state that signs are required, such section shall be effective even though no signs are erected or in place. Sec. 43. Traffic - control Signal Legend. - Whenever traffic is controlled by traffic- control signals exhibiting the words %o", "Caution ", or "Stop ", or exhibiting different colored lights successively -one at a time; or with arrows, the following colors only shall be used and said terms and light shall indicate and apply to drivers of vehicles and pedestrians as follows: (a) Green alone or "Go ". Vehicular traffic facing the signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right of way to other vehicles and to pedestrians law- fully within the intersection or an adjacent crosswalk at the time such signal is exhibited. Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk. (b) Yellow alone or "Caution" when shown following the green or "Go" signal. Vehicular traffic facing the signal is thereby warned that the red or "Stop" signal will be exhibited immediately thereafter and such vehicular traffic shall not enter or cross the intersection when the red or "Stop" signal is exhibited. Pedestrians facing such signal are insufficient time to cross the roadway, to cross shall yield the right of way to 7 thereby advised that there is and any pedestrian then starting all vehicles. (c) Red alone or "Stop ". Vehicular traffic facing the signal shall stop before entering the crosswalk on the near side of the intersection or if none, then before entering the intersection, and shall remain standing until green or "Go" is shown alone. No pedestrian facing such signal shall enter the roadway unless he can do so safely and without interfering with any vehicular traffic. (d) Red with green arrows. Vehicular traffic facing such signal may cautiously enter the inter- section only to make the movement indicated by such arrow but shall yield the right -of -way to pedestrians lawfully within a crosswalk and to other traffic lawfully using the intersection. No pedestrian facing such signal shall enter the roadway unless he can do so safely and without interfering with any vehicular traffic. (e) In the event an official traffic - control signal is erected and maintained at a place other than an intersection, the provisions of this section shall be applicable except as to those provisions which by their nature can have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking the stop shall be made at the signal. Sec. 44. Pedestrian - control Signals. - When ever special pedes- trian-control signals exhibiting the words "Walk" or "Wait" or "Don't Walk" are in place, such signals shall indicate as follows: (a) Walk: Pedestrians facing such signal may proceed across the roadway -in the.direction of such signal and shall be given the right of way by the drivers of all vehicles. (b) Wait or Don't Walk: No pedestrian shall start to cross the roadway -in the direction of such signal, but any pedestrian who has partially completed his crossing on the walk signal shall proceed to a sidewalk or safety zone while the wait signal is showing. Sec. 45. Flashing Signals. - Whenever an illuminated flashing sign is used in a traffic sign or signal it shall require obediency by vehicular traffic as follows: (a) Flashing red (stop) signal: When a red lens is illuminated with rapid intermittent - flashes, drives of vehicles shall stop; before entering the nearest crosswalk at any intersection or at a limit line when marked or, if none, then before entering the intersection and the right to proceed shall be subjectto the rules applicable after making a stop at a stop sign. (b) Flashing yellow (caution) signal: When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection'or past such signal only with caution. Sec. 46. Not to Apply at Grade Crossings. - The foregoing section shall not apply at railroad grade crossings. Conduct of drivers of vehicles approaching railroad grade crossings shall be governed by the rules hereinafter set forth specifically applicable thereto. Sec. 4 7. Display of unauthorized Signs, Signals, or Markings. - No person shall place, maintain, or display upon or in view of any highway any unauthorized sign, signal, marking or device which purports to be or is an imitation of or resembles an official traffic - control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic- control device or any railroad sign or signal. No person shall place or maintain nor shall any public authority permit upon any highway any traffic sign or signal bearing thereon any commercial advertising. Every such prohibited sign, signal, or marking is hereby declared to be a public nuisance and may be removed without notice. This section shall not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional information and of a type that cannot be mistaken for official signs. Sec. 48. Interference with Official Traffic- control Devices or Railroad Signs or Signals. - No person shall without lawful authority attempt to or in fact alter, deface, injure, knock down, or remove any official traffic-control device or any railroad sign or signal or any inscription, shield, or insignia thereon, or any other part thereof. Sec. 49. "Yield Right of Way" Signs. - (a) The driver of a vehicle approaching a y-bld sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions, or shall stop if necessary, and shall yield the right of way to any pedestrian legally crossing the roadway of which he is driving and to any vehicle in the intersection or approaching on another highway so closely as to constitute an immediate hazard. Said driver having so yielded may proceed, and the drivers of all other vehicles approaching the intersection shall yield to the vehicle so preceeding, provided, however, that a driver who enters a yield intersection without stopping and has or causes a collision with a pedestrian in a cross walk or a vehicle in the intersection shall prima facie be considered not to have yielded as required herein. The foregoing shall not relieve the drivers of other vehicles approaehing.the intersection at such distance as not to constitute an immediate hazard from the duty to drive with due care to avoid a collision. (b) The driver of a vehicle approaching a yield sign if required for safety to stop shall stop before entering the cross walk on the near side of the intersection or, in the event there is no crosswalk at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. ARTICLE IV. OPERATION OF VEHICLES Sec. 50. Vehicles to keep to Right. - All vehicles shall be driven on the right half of the roadway, except as follows: (a) When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement. (b) When placing a vehicle in position for and when such vehicle is lawfully making a left turn in compliance with this ordinance. V (c) When the right half of a roadway is closed to traffic while under construction or repair. (d) Upon a roadway designated by markings or signs for one -way traffic. (e) Upon a roadway divided into three marked lanes for traffic under the rules applicable thereon. I Sec. 51. Slow- moving Vehicles to Use Righthand Lane. - On streets having more than one lane of traffic in a single direction, any vehicle proceeding at less than the normal speed of traffic thereon shall be driven in the right -hand lane for traffic or as close as practicable to the right -hand edge or curb, except as otherwise herein provided. Sec. 52. Right of Way at Intersections. - The following rules shall govern right of way at intersections. (a) The driver of a vehicle approaching an intersection shall yield the right of way to a vehicle which has entered the intersection from a different street, provided there is no form of traffic - control at such intersection. (d) The driver of any vehicle shall stop as required by this section at the entrance to a through street and shall yield the right of way to other vehicles which have entered the intersection on the through street, or which are approaching so closely on the through street as to constitute an immediate hazard, but said driver having so yielded may proceed and the drivers of all other vehicles approaching the inter- section shall yield the right of way to the vehicle so proceeding. (e) The driver of a vehicle about to enter or cross a street from an alley or driveway shall stop before entering the crosswalk and yield the right of way to all vehicles approaching on said street. (f) The driver of a vehicle intending to make a left turn into an alley or driveway shall yield the right of way to any vehicle approaching from the opposite direction when the making of such left turn would create a traffic hazard. Sec. 52. Turns at Intersections. - The driver of a vehicle intending to turn at an intersection shall proceed as follows: 10 (a) Both the approach for a right turn and while making a right turn shall be made from that portion of the roadway as close as practicable to the right -hand curb or edge thereof. (b) Approach for a left turn shall be made in the portion of the right -half of the roadway nearest the center line thereof. After entering the intersection, the left turn shall be made so as to leave the intersection to the right of the center line of the street being entered, unless otherwise directed by markers, buttons, signs, or markings. Provided, however, that in making a left turn from a one -way street, the same shall be made from the left -hand lane of traffic. Sec. 54. Hand and Mechanical Signals. - No person shall stop or suddenly decrease the speed of or turn a vehicle from a direct course or move right or left upon a roadway; unless and until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided herein. (a) An operator or driver when stopping, or when decreasing the speed -of his vehicle, if the movement of other vehicles may reasonably be affected by such decreasing of speed, shall extend his arm at an angle below horizontal so that the same may be seen in the rear of his vehicle; (b) An operator or driver intending to right -shall extend his arm at an angle above same may be seen in front of and in the rear slow down and approach the intersecting highs to the right side of the highway along which turning; turn his vehicle to the horizontal so that the of his vehicle, and shall aay as near as practicable he is proceeding before (c) An operator or driver intending to turn his vehicle to the left shall extend his arm in a horizontal position so that the same may be seen in the rear of his vehicle, and shall slow down and approach the intersecting highway so that the left side of his vehicle shall be as near as practicable to the center line of the highway along which he is proceeding before turning; (d) The signals herein required shall be given either by means of the hand and arm or by a signal light or signal device in good mechanical condition. However, when a vehicle is so constructed or loaded that a hand and arm signal would not be visible both to the front and rear of such vehicle, then such signals shall be given by such light or device. A vehicle shall be considered so constructed or loaded that a hand and arm signal would not be visible both to the front and rear when the distance from the center of the top of the steering post to the left outside limit of the body, cab or load exceeds twenty -four inches, or when the distance from the center of the top of the steering post to the rear limit of the body or load thereon exceeds fourteen feet, which limit of fourteen feet shall apply to single vehicles or combinations of vehicles. The provisions of this sub division shall not apply to any trailer which does not interfere with a clear view of the hand signals of the operator or of the signaling devide upon the vehicle pulling said trailer. The provisions of this section as far as mechanical devices on vehicles so constructed that a hand and arm signal would not be visible both to the front and rear of such vehicle shall only be applicable vehicles, registered within this state and manufactured after the first day of July, 1954. 11 Sec. 55. Authority to Limit Turns. - The traffic engineer is authorized to determine those intersections at which drivers of vehicles shall not make right or left turns and shall place proper signs so direct- ing at intersections. Such regulation of turns may be limited to certain hours, at the discretion of the traffic engineer. No person shall make a right or left turn where same is prohibited by a sign duly placed. Sec. 56. U- Turns. - The driver of a vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a business district and shall not upon any other street so turn a vehicle unless such movement can be made in safety and without interfering with other traffic. Sec. 57. Limitations on Backing. - The driver of a vehicle shall not back the same into an intersection or over a crosswalk and shall in no event back a vehicle unless such movement can be made in safety. Sec. 58. Pulling From Curb. - The driver moving a vehicle from the curb or side of the street into the traffic lane shall yield the right of way to all vehicles which are in motion on said street. Sec. 59. Passing Other Vehicles. - The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to the limitations and exceptions hereinafter stated: (a) The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle. (b) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on audible signal and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. (c) No driver shall pass another vehicle at an intersection, except when such other vehicle is turning or pausing to make a turn in a direction which will not conflict with the passing vehicle. Sec. 60. Passing To the Right, When Permitted. - The driver of a motor vehicle may overtake and pass to the right of another vehicle only under the following conditions: (a) When the vehicle overtaken is making or about to make a left turn. - - (b) When the unobstructed pavement is of sufficient width for two or more -lines of vehicles in each direction. (c) Upon a one -way street. (d) Driving on roadways laned for traffic. Whenever any roadway has been divided into three or more clearly marked lanes for traffic, the following rules in addition to all others consistent herewith shall apply. (e) A vehicle shall be driven as nearly as practical entirely within a single lane and shall not be removed from such lane until the driver has first ascertained that such movement can be made with safety. 12 I (f) Upon a roadway which is divided into three lanes a vehicle shall not be driven in the center line except when overtaking and passing another vehicle where the roadway ahead is clearly visible and such center lane is clear of traffic within a safe distance, or in preparation for a left turn, or where such center lane is at the time allocated exclusively to traffic moving in the direction the vehicle is proceeding and is sign- posted to give notice of such allocation. (g) The driver of a motor vehicle may overtake and pass another vehicle upon the right only under the foregoing conditions when such movement may be made in safety. Sec. 61. Distance at which Vehicle Must Follow. - No driver of a vehicle shall follow another vehicle more closely than is reasonable safe and prudent, having due regard for the speed of such vehicle and the traffic upon and the condition of the street. Sec. 62. Entering Intersection. - No person shall enter an inter- section or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accomodate the vehicle he is operating without obstructing the passage of other vehicles or pedes- trians, notwithstanding any traffic - control indication to proceed. Sec. 63. Driving on Sidewalk or Parkway. - No person shall drive a vehicle on a sidewalk or parkway, except where same is crossed by a driveway. Sec. 64. Following Fire Apparatus. - No person shall drive a vehicle following any fire apparatus traveling in response to a fire alarm, closer than five hundred feet, nor shall he drive into or park such a vehicle within the block where fire apparatus has stopped in answer to a fire alarm. Sec. 65. Crossing Fire Hose. - No vehicle shall be driven over any unprotected hose of the fire department when laid down on any street or private driveway, without the consent of the fire department official in command. Sec. 66. Driving Through Funeral or Other Procession. - No person shall drive a vehicle between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required herein. Sec. 67. Drivers in a Procession. - Each driver in a funeral or other procession shall drive as near to the right -hand edge of the street as practical and shall follow the vehicle ahead as close as is practical and safe. Sec. 68. Funeral Procession to be Identified. - A funeral composed of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle a pennant or other identifying in- signia or by such other method as may be designated by the traffic division. Sec. 69. When permits Required for Parades and Processions. - No funeral procession, or parade containing pedestrians, animals, or five or more vehicles, excepting the armed forces of the United States or of this state, shall march or proceed along any street except in accordance with a permit issued by the Chief of Police and Traffic Engineer. -13- i (f) Upon a roadway which is divided into three lanes a vehicle shall not be driven in the center line except when overtaking and passing another vehicle where the roadway ahead is clearly visible and such center lane is clear of traffic within a safe distance, or in preparation for a left turn, or where such center lane is at the time allocated exclusively to traffic moving in the direction the vehicle is proceeding and is sign- posted to give notice of such allocation. Sec. 68. Sec. 69. When permits Required for Parades and Processions. - No funeral procession, or parade containing pedestrians, animals, or five or more vehicles, excepting the armed forces of the United States or of this state, shall march or proceed along any street except in accordance with a permit issued by the Chief of Police and Traffic Engineer. -13- Sec. 70. Driving Across Traffic Markings or Through Barricades. - No person shall drive a vehicle across freshly painted street markings, when the same are marked by flags or traffic cones, or remove or drive through barricades placed by the City in streets or alleys. Sec. 71. Opening Door of Vehicle. - No person shall open a door of a vehicle or remove from a vehicle a load or any part thereof into a line of moving traffic when such would impede the flow of traffic. Sec. 72. Careless and Reckless Driving. - No person shall drive a vehicle in such a manner as to indicate a willful or wanton disregard for the safety of person or property. Sec. 73. Driving under Influence of Intoxicating Liquor. - (a) No person shall operate a motor vehicle while under the influence of intoxicating liquor or while under the influence of drugs. . (b) PENALTY. -- Every person who is convicted of a violation of Section 73 herein shall be punished by imprisonment for not less than 24 hours, nor more than 30 days, and by a fine of not less than fifty dollars ($50.00), nor more than five hundred dollars ($500.00), and his privilege to operate a motor vehicle may be suspended for a period of not more than one (1) year. On a second or subsequent conviction for an offense committed within one (1) year of the first offense of a violation of this Act, he shall be punished by imprisionment for not less than ten days (10), nor more than one (1) year, and a fine of not less than two hundred and fifty dollars ($250.00), nor more than one thousand dollars ($1,000.00) and his privilege to operate a motor vehicle shall be revoked for one (1) year. Imprisonment as provided in this Section shall not be deemed to have begun until after conviction and sentencing of the defendant. ARTICLE V. Speed Sec. 74. Limits. - No person shall drive a vehicle at a speed in excess of thirty miles per hour within this City. Provided, however, that the traffic engineer is empowered to increase the speed limit up to 45 miles per hour on streets where, in his opinion, by reason of distance from the center of population, width and conditions of road- ways, and the amount of traffic thereon, a higher limit is reasonable and free from undue hazard. Adequate and clearly legible signs stating such increased speed limit shall be placed along all such streets and roadways. No person shall drive a vehicle at a speed in excess of the limits thereby designated. Sec. 75. Limits on Approach to Certain Intersections. - No person shall drive a vehicle at a speed in excess of twenty miles per hour within one hundred feet of intersections designated by the traffic engineer and plainly marked with such speed limits signs. Sec. 76. Limits in School Zones. - No person shall drive a vehicle at a speed in excess of twenty miles per hour upon any portion of a street adjoining a school, whenever children are present. Provided, however, that signs shall be placed so as to give notice of such speed limit. Sec. 77. Speed greater than Reasonable and Prudent. - No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions then existing. 14 Sec. 78. Minimum Speed. - (a) No person shall drive a-motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law. (b) Whenever the traffic engineer determines on the basis of an engineering and traffic investigation that slow speeds on any part of a street or highway consistently impede the normal and reasonable movement of traffic, the traffic engineer may determine and declare a minimum speed limit below which no person shall drive a vehicle except when necessary for safe operation or in compliance with law. ARTICLE VI Special Stops Required Sec. 79. Authority to Erect Stop Signs and Yield Right of Way Signs. - Whenever any ordinance designates and describes a through street it shall be the duty of the traffic engineer to place and maintain a stop sign or yield right of way sign on each and every street intersecting such through street or intersecting that portion thereof described and designated as such, unless traffic at any such intersection is controlled at all times by traffic-control signals. Provided, however, that at the intersection of two such through streets stop signs or yield right of way signs shall be erected at the approaches of either of said streets as may be determined by the traffic engineer upon the basis of traffic study. Sec. 80. Intersections where Stop Required. - The traffic engineer is authorized to determine and designate intersections where particular hazard exists upon other than through s treets and to determine whether vehicles shall stop at one or more entrances to any such stop intersec- tion, and shall erect a stop sign or yield right of way sign at every such place where a stop or yielding of right of way is required. Sec. 81. Signs to Conform to State and Federal Standards. - Every traffic control sign erected shall conform in so far as practicable to the design for uniform traffic- control devices currently approved by the Public Roads Administration of the United States government and shall be placed in accordance with the regulations approved by said Public Roads Administration, except where contrary tothe State manual and specifi- cations, in which event the latter shall control. Sec. 82. Stop or Yield Right of Way before Entering Through Streets. - No person shall drive a vehicle into a through street without first bringing such vehicle to a full stop at a stop sign or yielding the right of way at a yield right of way sign to vehicles on such through streets, except at those intersections at which an automatic traffic- control signal is in operation,. in which event the vehicles entering or traveling upon said through avenue or street shall be controlled by such signal. Where two through streets intersect and stop signs have been posted on both, the driver of the vehicle on the right, after complying with the stop sign, shall have the right to proceed first into the intersection. Sec. 83. (b) A crossing gate is lowered or when a flagman gives a signal of the approach of a train. (c) A train approaching within approximately 1,500 feet of the highway crossing omits a signal audible from such distance and such train, by reason of its speed or nearness to such crossing, is an immediate hazard. (d) An approaching train is plainly visible and is in hazardous proximity to such crossing. Sec. 84. Authority to Erect "Stop for Pedestrians in Crosswalk" Signs. - The traffic engineer is-hereby authorized to place and main- tain "Stop for Pedestrians in Crosswalk" signs at school croswalk locations, as determined upon the basis.of traffic study. ARTICLE VII Method of Parking Sec. 85. Standing or Parking Close to Curb. - No person shall stand or park a vehicle in a roadway other than parallel with the edge of roadway headed in the direction of lawful traffic movement and with the right hand wheels of the vehicle within twelve inches of the curb or edge of the roadway except where angle or diagonal parking is required. In the case of angle or diagonal parking, no person shall stand or park a vehicle other than with the front of such vehicle directed toward the front or curb of said angle or diagonal parking space. See. 86. Signs or Marking Indicating Angle Parking. - The traffic engineer shall determine upon what streets angle parking shall be permitted and shall mark or sign such streets. Such angle parking shall not be indicated upon any federal -aid or s tate highway within t he city unless the State Highway Commission has determined by resolution or order entered in its minutes that the roadway is of sufficient width to permit angle parking without interfering with the free movement of traffic. Sec. 87. Obedience to Angle - parking Signs or Markings. - Upon those streets which have been signed or marked by the traffic engineer for angle parking, no person shall park or stand a vehicle other than at the angle to the curb or the edge of the roadway indicated by such signs or markings. Sec. 88. Permit for Loading or Unloading at an Angle to the Curb. The traffic engineer is authorized to issue special permits to permit the backing of a vehicle to the curb for the purpose of loading or unloading merchandise or materials subject to the terms and conditions of such permit. Such permits may be issued either to the owner or lessee of real property or to the owner of the vehicle and shall grant to such person the privilege as therein stated and authorized herein. No person shall back a vehicle to the curb for the purpose of loading or unloading except according to the terms of such a permit. ARTICLE VIII Parking Prohibited in Specified Places 16 Sec. 89. Stopping, Standi, or Parking Prohibited: No Signs Required. - No person shall a�bp, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic - control device, in any of the following places: (a) On a sidewalk or parkway. (b) In front of a public or private driveway or within five feet thereof. (c) Within an intersection. (d) Within fifteen feet of a fire hydrant. (e) On a crosswalk or within twenty feet thereof. (f) Within thirty feet upon the approach to any flashing beacon, stop sign, yield right of way sign, or traffic- control signal located at the side of a roadway. (g) Between a safety zone and the adjacent curb or within thirty feet of points on the curb immediately opposite the ends of a safety zone, unless the traffic engineer has indicated a different length by signs or markings. (h) Within fifty feet of the nearest rail of a railroad crossing. (i) Within twenty feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy-five feet of said entrance when properly signposted. (j) Along or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic. (k) On the roadway side of any vehicle stopped or parked at the edge or curb of a street. (1) Upon any bridge, viaduct, overpass, underpass, or any other type of grade separation, and upon the approached to same. (m) In front of or within ten feet of a mailbox. (n) In front of any place of business assembly during the period of public assemblage therein, or of a principal exit or entrance to a school, hotel, theatre, hospital or public building. (o) To obstruct or impede traffic in any manner. Sec. 90. Parking not to Obstruct Traffic. - No person shall park any vehicle upon a street, alley, in such a manner or undersuch conditions as to leave available less than ten feet of the width of the roadway for free movement of vehicular traffic. Sec. 91. Parking in Alleys. - No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle 17 within an alley in such position as to block the driveway entrance to any abutting property. Sec. 92. Parking for Certain Purposes Prohibited. - No person shall park a vehicle upon any roadway for the principal purpose of: (a) Displaying such vehicle for sale or advertising. (b) Washing, greasing, or repairing such vehicle, except repairs necessitated by an emergency Sec. 93. Parking Prohibited on Narrow Streets. - The traffic engineer is hereby authorized to erect signs indicating no parking upon either or both sides of any street when such parking would in his opinion interfere with traffic or create a hazardous situation. When official signs prohibiting parking are erected upon streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign. Sec. 94. Standing or Parking on One -Way Roadways. - In the event a highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the left -hand side of such one -way roadway unless signs are erected to permit such standing or parking. The traffic engineer is authorized to determine when standing or parking may be permitted upon the left hand side of any such one way roadway and to erect signs giving notice thereof. Sec. 95. No stopping, Standing, or Parking Near Hazardous or Congested Places. - The traffic engineer is hereby authorized to determine and designate by proper signs places in which the stopping, standing, or parking of vehicles would create an especially hazardous condition or would cause unusual delay in traffic. When official signs are erected at hazardous or congested places as authorized herein no person shall stop, stand, or park a vehicle in any area so designated place. ARTICLE IX Stopping for Loading and Unloading Sec. 96. Traffic Engineer to Designate Curb Loading Places. - The traffic engineer is hereby authorized to determine the location of passenger and freight curb loading zones and shall place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this section shall be applicable. Sec. 97. Permits for Curb Loading Zones. - The traffic engineer shall not hereafter designate or sign any curb loading zone upon special request of any person unless such person makes application for a permit for such zone and for one sign to indicate each zone. (a) Any person, firm or corporation desiring passenger or loading and unloading zones may make application in writing to the traffic engineer and pay to the City of Little Rock, $70.00 per meter space, per year, based on the national average income per meter. M In the event such request is for a loading zone outside of the parking meter district then such person making the request shall pay to the City of Little Rock an anny,al fee of Two Dollars ($2.00) per foot per year for the purpose of covering the expense of the City in painting, designating with appropriate signs, and otherwise main- taining said limited parking, or unloading zones. Such payment shall be made to the City on or before the lst day of July of each and every year. (c) The person or persons who own the property adjacent to any zone designated by the traffic engineer shall not be required to pay said maintenance fee as required by this ordinance, provided such zone is designated by the traffic engineer for the convenience of the general public. Such zones shall be maintained and cared for at the expense of the City of Little Rock. (d) It is hereby declared to be unlawful for any person, firm, or corporation to paint the curb, sidewalk, or any part of the street of the City of Little Rock in any manner whatsoever, and it shall be unlawful for any person, firm or corporation to designate any part (of any street) of the City of Little Rock as being limited in any manner with respect to parking thereon. Sec. 98. Standing in Passenger Curb Loading Zone. - No person shall stop, stand, or park a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers in any place marked as a passenger curb loading zone during hours when the regulations applicable to such curb loading zone are effective, and then only for a period not to exceed three minutes. Sec. 99. Standing in Freight Curb Loading Zone. - No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pickup and loading of materials in any place marked as a freight curb loading zone during hours when the provisions applicable to such zones are in effect. In no case shall the stop for loading and unloading of materials exceed thirty minutes. Sec. 100. Traffic Engineer to Designate Public Carrier Stops and Stands. - The traffic engineer is hereby authorized to establish bus stops, bus stands, taxicab stands for other passenger common - carrier motor vehicles on the public streets in such places as he shall determine to be of the greatest benefit and convenience to the public, such bus stops, bus stands, taxicab stands, or other stands, so established, shall be designated by appropriate signs where deemed by the traffic engineer as necessary. Sec. 101. Stopping, standing, and Parking of Buses and Taxicabs. - The following rules shall govern the stopping, standing and parking of busbe and taxicabs: (a) Except in the operation of a charter or special bus, the operator of a bus shall not stop, stand or park any bus upon any street other than at a bus zone, or any other location commonly used,to take on and discharge pasengers. (b) Except in the operation of a charter or special bus, the operator of a bus. s izall not stop such vehicle upon any street at any place for the purpoL:c of loading or unloading passengers or their baggage other than at a Uus stop, bus stand, or passenger loading zone or any other location commonly used for discharging and picking up passengers. W] (c) The operator of a bus shall enter a bus stop, bus stand or passenger loading zone or other location where passengers are normally discharged or picked up in such manner that the bus, when stopped to load or unload passengers or baggage, shall be in a position as close to the curb as possible, so as not to impede unduly the movement of other vehicular traffic. (d) The operator of a taxicab shall not stand or park such vehicle upon any street at any place other than in a taxicab stand designated by the traffic engineer. This provision shall not prevent the operator of a taxicab from temporarily stopping in accordance with other stopping or parking regulations at any place for the purpose of and while actually engaged in the expedit:iou s loading or unloading of passengers. Sec. 102. Restricted Use of Bus and Taxicab Stands. - No person shall stop, stand, or park in a vehicle other than a bus in a bus stop or other than a taxicab in a taxicab stand when such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the pur- pose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone. Sec. 103. Traffic Engineer to Designate Hotel Loading Zones. - The Traffic Engineer shall establish and mark hotel zones to be used solely for the loading and unloading of passengers and baggage. Standing or parking in such hotel zones shall be limited to fifteen minutes. Sec. 104. Parking in Hotel Loading Zone. - No person shall park a vehicle in a hotel zone except for the purpose of taking and discharging passengers and baggage destined for said hotel. ARTICLE X Parking on Certain Streets Sec. 105. Application of Article. - The provisions of this article prohibiting the standing or parking of a vehicle shall apply at all times or at those times herein specified or as indicated on official signs, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic - control device. The provisions of this Article imposing a time limit on parking shall not relieve any person from the duty to observe other and more restrictive provisions pro- hibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times. Sec. 106. Parking Prohibited at All Times on Certain Streets. - When signs are erected on any street or part of street giving notice thereof, no person shall park a vehicle on the side or sides of any such street or part of street so designated for no parking. Sec. 107. Parking Prohibited During Certain Hours on Certain Streets - When signs are erected on any street or part of street in each block giving notice thereof, no person shall park a vehicle on any such street or part of street in each block so designated between the hours specifi- ed by the signs, except Sunday and Public Holidays. 20 Sec. 108. Stopping, Standing or Parking Prohibited During Certain Hours on Certain Streets. When signs are erected on any street or part of street in each block giving notice thereof, no person shall stop, stand, or park a vehicle on any such street or part of street in each block so designated between the hours specified by the signs, except on Sundays and Public Holidays. Sec. 109. Parking Time Limited on Certain Streets. - When signs are erected on any street or part of street in each block giving notice thereof, no persons shall park a vehicle on any such street or part of street in each block so designated for longer than one hour at any time between the hours of 8 :00 A.M. and 6 :00 P.M. of any day except Sundays and Public Holidays. Sec. 110. Parking Signs Required. - Whenever by any provision of this Ordinance a parking time limit is imposed or parking is prohibited on any street or part of street, it shall b e the duty of the Traffic Engineer to erect appropriate signs on such street or part of street giving notice thereof and no such regulations shall be effective unless said signs are erected and in place on the side or sides of the street or part of street where parking time is limited or prohibited at the time of any alleged offense. Sec. 111. Parking in Public Parks. - No persons shall park a vehicle in any street, roadway, driveway or parking area that is marked for parking, in any public park at any time or in any manner, except as designated by lines or markings upon the pavement or ground. No person shall park any vehicle in front of or across any driveway or entranceway or within five feet of any driveway or entrance -way to any picnic area or filter building located in any public park. Nor shall any person park a vehicle at any place within a public park whereby, by signs duly erected, parking is prohibited. Sec. 112. Parking of Common Carriers at Night Prohibited. - No person shall park a truck, tractor, or trailer with a capacity of 3/4 ton or larger, or the chassis thereof, on any street between the hours of 12:00 midnight and 6:00 A.M.; nor shall any person use any street for the purpose of repairing or reconditioning any such truck, trailer or any common carrier or any part thereof, except when such repairs shall be necessitated by an emergency. Sec. 113. Parking Restrictions During Certain Hours as Designated by Traffic Engineer. - The Traffic Engineer is hereby authorized to determine the location of two hour parking zones and to place and main- tain appropriate signs indicating the same and stating the hours during which said limitations are applicable, provided that the installation of such zones shall be subject to the following conditions. (a) All so- called "two hour" zones heretofore designated and marked are hereby designated as two hour parking zones. (b) No person shall park any vehicle in any two hour parking zone located in the City for longer than two hours at any time between t he hours so designated and if the hours are not designated then not longer than two hours at any time except on Sundays and holidays. All such two hour parking zones shall be designated by signs. ARTICLE XI Parking Meter Zones Sec. 114. Installation of Parking Meters. - The traffic engineer 21 shall install parking meters in the parking meter zones established as provided herein upon the curb immediately adjacent to each parking space. See. 115. Parking Meter Spaces. - The traffic engineer shall designate the parking space adjacent to each parking meter for which such meter is to be used by appropriate markings upon the curb or the pavement of the street. Parking meter spaces so designated shall be of appropriate length and width so as to be accessible from the traffic lanes of such street. No person shall park a vehicle in any such designated parking meter space during the restricted and regulated time applicable to the parking meter zone in which such meter is located so that any part of such vehicle oc- cupies more than one such space or protrudes beyond the marking designating such spaces, except that vehicle which is of a size too large to be parked within a single designated parking meter zone shall be permitted to occupy two adjoining parking meter spaces when coins shall have been deposited in the parking meter for such space. Sec. 116. Deposit of Coins and Time Limits. - The following rules shall govern time limits and deposit of coins in parking meters. (a) No person shall park a vehicle in any parking space upon a street alongside of and next to which a parking meter has been installed during the restricted and regulated time applicable to the parking meter zone in which such meter is located unless a coin or coins of the appropriate denomination as provided in this ordinance shall have been deposited therein, or shall have been previously deposited therein for an unexpired interval of time, and said meter has been placed in operation. (b) No person shall permit a vehicle within his control to be parked in any such parking meter space during the restricted and regulated time applicable to the parking meter zone in which such meter is located while the parking meter for such space indicates by signal that the lawful park- ing time in such space is expired. This provision shall not apply to the act of parking or the necessary time which is required to deposit immediately thereafter a coin or coins in such meter. (c) No person shall park a vehicle in any such parking meter space for a consecutive period of time longer than that limited period of time for which parking is lawfully permitted in the parking meter zone in which such meter is located, irrespective of the number of amounts of the coins deposited in such meter. (d) The provisions of this section shall not relieve any person from the duty to observe other and more restrictive provisions of this ordinance. Sec. 117. Use of Slugs Prohibited. - No person shall deposit or attempt to deposit in any parking meter any slug, button, or any other devise or substance as substitutes for coins of United States currency. Sec. 118. Tampering with Meter. - No person shall deface, injure, tam- per with, open or willfully break, destroy, or impair the usefulness of any parking meter. Sec. 119. Twelve- minute Zones. - The Traffic Engineer is hereby authorized to determine the location of twelve- minute parking zones and parking meter zones upon any and all streets within the jurisdiction of this City and to place and maintain appropriate signs and parking meters indicating the same and stating the hours during which said limitations 22 are applicable, provided that the installation of such zones shall be subject to the following conditions: (1) All "twelve - minute" zones heretofore designated and marked are hereby designated as twelve- minute parking zones. (2) No person shall park any vehicle in any twelve- minute parking zone - Located in parking meter zones, as the same now exist or may hereafter be established, for longer than twelve minutes at any time between the hours of 8 :00 A.M. and 6:00 P.M. on Monday through Saturday except on Sundays and holidays and only upon the deposit of a one cent coin of the United States for each six minutes in a parking meter located alongside such zone. Sec. 120. 30 Minute Zones. - The Traffic Engineer is hereby authorized to determine the location of thirty (30) minute parking zones and parking meter zones upon any and all streets within the jurisdiction of this City and place and maintain appropriate signs and parking meters indicating the same and stating the hours during which said limitations are applicable provided that the installation of such zones shall be subject to the following conditions: (1) All so- called "thirty (30) minute" zones heretofore designated and marked are hereby designated as thirty (30) minute parking zones. (2) No person shall park any vehicle in any thirty (30) minute parking zones located in parking meter zones, as the same now exist or may here- after be established, for more than thirty (30) minutes at anytime be- tween the hours of 8:00 A.M. and 6:00 P.M. on Monday through Saturday except on Sundays and Holidays and only upon the deposit of a one -cent coin of the United States for each six minutes or five cents for thirty (30) minutes in a parking meter located alongside such zone." See. 121. One Hour Zones - The Traffic Engineer is hereby authorized to determine the location of one (1) hour parking zones and parking meter zones upon any and all streets within the jurisdiction of this City and place and maintain appropriate signs and parking meters indicating the same and stating the hours during which said limitations are applicable provided that the installation of such zones shall be subject to the following conditions: (1) All so- called one (1) hour zones heretofore designated and marked are hereby designated as one (1) hour parking zones. (2) No person shall park any vehicle in any one (1) hour parking zone located in parking meter zones, as the same now exist or may hereafter be established, for more than one (1) hour at any time between the hours of 8 :00 A.M. and 6:00 P.M. on Monday through Saturday except on Sundays and Holidays and only upon the deposit of a one -cent coin of the United States for each twelve (12) minutes or five (5) cents for one (1) hour in a parking meter located alongside such zone. Sec. 122. Two Hour Zones. - The Traffic Engineer is hereby authorized to determine the location of two (2) hour parking zones and parking meter zones upon any and all streets within the jurisdiction of the City and place and maintain appropriate signs and parking meters indicating the same and stating the hours during which said limitations are applicable provided that the installation of such zones shall be subject to the following conditions: -23- (1) All so- called "two (2) hour" zones heretofore designated and marked are hereby designated as two (2) hour parking zones. (2) No person shall park any vehicle in any two (2) hour parking zone located in parking meter zones, as the same now exist or may here- after be established, for more than two (2) hours at any time between the hours of 8 :00 A.I. and 6 :00 P.M. on Monday through Saturday except on Sundays and Holidays and only upon the deposit of a one -cent coin of the United States for each twelve (12) minutes or five (5) .cents for one hour or ten (10) cants for each two hours in a parking meter located alongside such zone." Sec. 123. Meters installed in banking zones shall be covered during banking hours and uncovered for use at other times. The banks shall be required to pay the City of Little Rock for the metered zones during the time they are covered, based on the national average income of $70.00 per meter per year. Sec. 124. That a combination ticket and envelope shall be provided in the issuance of a violation for the convenience of the motorists who may place same in the penalty boxes attached to the parking meters for the payment of such violations. ARTICLE XII Rights and Duties of Pedestrians Sec. 125. Pedestrians' Right of way in Cross Walk. - When traffic - control signals are not in places or not in operation, the driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, but no pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle, which is so close that it is impossible for the driver to yield. Sec. 126. Passing of Stopped Vehicles. - Whenever any vehicle has been stopped at a marked crosswalk or at any intersection to permit a pedestrian to cross the roadway, it shall be unlawful for the driver of any other vehicle approaching from the rear to overtake and pass such stopped vehicle. Sec. 127. Pedestrian Not to Cross. - No pedestrian shall cross the roadway within a business district at any place other than a crosswalk, Outside the business districts any pedestrian crossing at a point other than a crosswalk shall yield the right of way to motor vehicles upon the roadway. Provided, however, that this section shall not relieve the driver of a motor vehicle from the duty to exercise due care under the circumstances for the safety of pedestrians. Sec. 128. Rights and Duties at Controlled Intersections. - At inter- sections where traffic is controlled, pedestrians shall not cross the roadway against a red signal and shall not cross at any place except in a crosswalk. A pedestrian crossing or starting across any such crosswalk -right of way over all vehicles, in- on a green signal shall have the cluding those making turns until such pedestrian has reached the opposite curb or a safety zone. -24- Sec. 129. To Use might Half of Crosswaltc. — Pedestrians shall move, whenever practicable, upon the right half of crosswalks. ,Sec. 130. To Cross at Right Angles. - No pedestrian shall cross a roadway other than by a route at right angles to the curb or by the shoriest route to the opposite curb, except in a crosswalk. Sec. 131. Walking Along Roadways. - Where sidewalks are provided no person shall walk along and upon an adjacent roadway. Sec. 132. Soliciting Rides. - No person shallstand in a roadway for the purpose of soliciting a ride from the driver of any private vehicle. ARTICLE XIII Bicycles Sec. 133. Traffic Regulations to Apply To Persons Riding Bicycles. - Every person riding a bicycle upon a roadway shall be granted all of the sights and shall be subject to all the duties applicable to the driver of a vehicle by the laws of this state declaring rules of the road appli- cable to vehicles or by the traffic ordinances of this city applicable to the driver of a vehicle, except as to special regulations in this Article and except as to those provisions of laws and ordinances which by their nature can have no application. Sec. 134. Obedience to Traffic- control Devices. - Any person operating a bicycle shall obey the instructions of official traffic - control signals, signs, and other control devices appliable to vehicles, unless otherwise directed by a police officer. Whenever authorized signs are erected in- dicating that no right or left or U -turn is permitted, no person operating a bicycle shall disobey the direction of any such sign, except where such person dismounts from the bicycle to make any such turn, in which event such person shall then obey the regulations applicable to pedestrians. Sec. 135. Manner of Riding. - A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto. No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. Sec. 136. Riding on Roadways and Bicycle Paths. - Every person opera- ting a bicycle upon a roadway shall ride as near as to the right -hand side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles. Whenever a usable path for bicycles has been provided adjacent to a roadway bicycle riders shall use such path and shall not use the roadway. Sec. 137. Speed. - No person shall operate a bicycle at a speed greater than is reasonable and prudent under the conditions then existing. Sec. emerging sidewalk right of area; ani vehicles 138. Emerging from an alley, or the sidwalk way to all ped i upon entering approaching on from Alley or Driveway. - The operator of a bicycle driveway, or building, shall upon approaching a area extending across the alley -way, yield the astrians approaching on said sidewalk or sidewalk the roadway shall yield the right of way to all said roadway. -25- Sec. 139. Clinging to Vehicles. - No person riding upon any bicycle shall attach the same or himself to any vehicle upon a roadway. Sec. 140. Carrying 'articles. - No person operating a bicycle shall carry any package, bundle, or article which prevents the rider from keeping at least one hand upon the handle bars. Sec. 141. Parking - No person shall park a bicycle upon a street other than upon the roadway against the curb or upon the sidewalk in a -rack to support the bicycle or against a building or at the curb, in such manner as to afford the least obstruction to pedestrian traffic. Sec. 142. Riding on Sidewalks. - No person shall ride a bicycle upon a sidewalk within a business district. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right of way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. Sec. 143. Lamps and Other Equipment on Bicycles. - Every bicycle when in use at night time shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least five hundred feet to the front and with a red reflector on the -rear of a type which shall be visible from all distances from fifty feet to three hundred feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehicle. A lamp emitting a red light to the rear may be used in addition to the red reflector. No person shall operate a bicycle unless it is equipped with a bell or other device capable of giving a signal for a distance of at least one hundred feet, except that a bicycle shall not be equipped with nor shall any person use upon • bicycle any siren or whistle. Every bicycle shall be equipped with • brake which will enable the operator to make the braked wheel skid on dry, level, clean payment. ARTICLE XIV Miscellaneous Provisions Sec. 144. Minimum Age for Drivers. - No person under the age of sixteen years shall drive a motor vehicle. Sec. 145. Equipment of Motor Vehicles. - No person shall drive a motor vehicle not complying with the following requirements as 'equip- ment. (a) Brakes: All motor vehicles, except motorcycles, shall be pro - vided at all times with two sets of adequate brakes, kept in good working order, and motorcycles shall be provided with one set of adequate brakes kept in good working order. (b) Signaling devices: Every motor vehicle shall be equipped with a horn, directed forward, or whistle in good working order, capable of emitting a sound adequate in quantity and volume to give warning of the approach of such vehicle to other users of the street and to ped- estrains. Such signaling de•vlce shall be used for warning purposes only and shall not be used for making any unnecessary noise, and no other sound - producing signaling device shall be used at any time. (c) Mirrors: All motor vehicles whichare so constructed or loaded that the driver cannot see the street behind such vehicle by looking -26- back or around the side of such vehicle shall be equipped with mirror so adjusted as to reveal the street behind and be visible from the drivers seat. (d) Muffler cutouts: Muffler cutouts shall not be used and no vehicle shall be driven in such manner or condition that excessive and unnecessary noises shall be made by its machinery, motor, signaling device or other parts, or by any improperly loaded cargo. The motors of all motor vehicles shall be fitted with properly attached mufflers of such capacity or con- struction as to quiet exhaust noises insofar as possible. Any cutout or opening in the exhaust pipe between the motor and the muffler on any motor vehicle shall be completely closed and disconnected from its operating lever, and shall be so arranged that it cannot a utomaticaliy open, or be opened while such vehicle is in motion. Sec. 146. Lights. - No person shall drive a vehicle during the period from one -half hour after sunset to one -half hour before sunrise without front and rear lights, which shall meet all the requirements of state law. Sec. 14 7. Projection on Vehicles. - All vehicles carrying poles or other objects which project more than five feet from the rear of such vehicle shall, during the period when lights are required by this Article, carry a red light at or near the rear end of the pole or other object so projecting. At other times a red flag or cloth not less than sixteen inches square shall be displayed at the end of such projections. Sec. 148. Traffic Engineer to Designate Crosswalks, Safety Zones, and Traffic Lanes. - The Traffic Engineer is authorized: (a) To designate and maintain by appropriate devices, marks, or lines upon the surface of the roadway, crosswalks at intersections where, in his opinion, there is particular danger to pedestrians crossing the roadway, and at such other places as he may deem necessary. (b) To establish safety zones of such kind and character and at such places as he may deem necessary for the protection of pedestrians. (c) To mark traffic lanes upon the roadway of any street where,, in his opinion, a regular alignment of traffic is desirable. Sec. 149. Traffic Engineer May Establish Play Streets. - The Traffic Engineer may declare any street or part thereof a play street. No person shall drive a vehicle upon any such street or portion thereof except drivers of vehicles having business or whose residences are within such area, and then any such driver shall exercise the greatest care. The Traffic Engineer shall appropriately mark all such streets or parts of streets. Sec. 150. Authority to Sign One -way Streets and Alleys. - The Traffic Engineer is hereby authorized to determine and designate one- way.streets and alleys, and the Traffic Engineer shall place and maintain signs giving notice thereof, and no such regulation shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite dire *tion is prohibited. Sec. 151. One -way Streets and Alleys. - Upon those streets and parts of streets and in those alleys designated one -way, vehicular traffic shall move only in the indicated direction when signs indicating same are duly placed. -27- Sec. 152. Authority to Restrict Direction of Movement on Streets During Certain Periods. The traffic engineer is authorized to determine and designate streets, parts of streets or specific lanes upon which vehicular traffic shall proceed in one direction during one period and the opposite direction during another period of the day and shall place and maintain appropriate markings, signs, barriers, or other devices to give notice thereof. The traffic engineer may erect signs temporarily designating lanes to be used by traffic moving in a particular direction, regardless of the center line of the roadway. It shall be unlawful for any person to operate any vehicle in violation of such markings, signs, barriers, or other devices so placed in accordance with this section. Sec. 153. Truck Routes.- The traffic engineer is authorized to determine and designate streets, parts of streets or specific lanes as truck routes and when so designated all sash trucks shall use routes to the closest point of their destination. Sec. 154. Riding on Motorcycles.- A person operating a motorcycle shall ride only upon the permanent'end regular seat attached thereto, and such operator shall not carry any other person uor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person, in which event a passenger may ride upon the permanent and regular seat if designed for two persons, or upon another seat to the rear of the operator. Sec. 155. Obstruction to Driver's View. - No person shall drive a vehicle when it is so loaded or when there are in the front seat such number of persons exceeding three as to obstruct the view of the driver to the front or sides of a vehicle or so as to interfere with the drivers control over the vehicle. No passenger in any vehicle shall ride in such position as to interfere with the view of the driver or with the driverfs control over the vehicle. Sec. 156. Boarding or Alighting from Vehicles. - No person shall board or alight from any vehicle while same is in motion. Sec. 157. Unlawful Riding. - No person shall ride on any vehicle upon any portion thereof not designed or intended for the use of passengers. This provision shall not apply to an employee engaged in the necessary discharge of a duty, or to persons riding within truck bodies in space intended for merchandise. See. 158. Railroad Trains Not to Block Streets. - It shall be unlawful for the directing officer or operator of any railroad train to direct the operation of or to operate the same in such a manner as to prevent the use of any street for purpose of travel for a period of time longer than five minutes. Sec. 159. Driving Through Safety Zones Prohibited. - No vehicle shall at any time be driven through or within a safety zone. Sec. 160. Throwing Things on Streets. - No person shall throw or place on any street any tacks, nails, wire, scrap metal, glass, crockery, sharp stones, or other substances injurious to the feet of persons or animals or to the tires of vehicles. Any person who has purposely or accidentally dropped any such substance upon the street shall immediately clear such street of the same. Sec. 161. Hauling Rubbish or Loose Material on Streets. - No vehicle shall be used to haul rubbish, trash, loose bottles, tin cans, brush, waste paper, loose dirt, rocks, or material of similar nature, upon the public streets without first having been equipped with the proper equipment, as herinafter set out, to prevent the load, or any part thereof, from falling, dropping or being blown off the vehicle while in motion. The bed and sidewalls thereof shall not drop through or from the vehicle. The vehicle shall not be loaded in such a manner that any part of the load extends above or over the sidewalls of the truckbed. When the vehicle is being used for carrying loose paper or other material that may be blown from the load, a tarpaulin or screen saver of sufficient mesh-shall be used to cover the load to preven its being blown from the vehicle while in motion. -28- t Sec. 152. Authority to Restrict Direction of Movement on Streets During Certain Periods. The traffic engineer is authorized to determine and designate streets, parts of streets or specific lanes upon which vehicular traffic shall proceed in one direction during one period and the opposite direction during another period of the day and shall place and maintain appropriate markings, signs, barriers, or other devices to give notice thereof. The traffic engineer may erect signs temporarily designating lanes to be used by traffic moving in a particular direction, regardless of the center line of the roadway. It shall be unlawful for any person to operate any vehicle in violation of such markings, signs, barriers, or other devices so placed in accordance with this section. Sec. 153. Truck Routes.- The traffic engineer is authorized to determine and designate streets, parts of streets or specific lanes as truck routes and when so designated all sash trucks shall use routes to the closest point of their destination. Sec. 154. Riding on Motorcycles.- A person operating a motorcycle shall ride only upon the permanent'end regular seat attached thereto, and such operator shall not carry any other person uor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person, in which event a passenger may ride upon the permanent and regular seat if designed for two persons, or upon another seat to the rear of the operator. Sec. 155. Obstruction to Driver's View. - No person shall drive a vehicle when it is so loaded or when there are in the front seat such number of persons exceeding three as to obstruct the view of the driver to the front or sides of a vehicle or so as to interfere with the drivers control over the vehicle. No passenger in any vehicle shall ride in such position as to interfere with the view of the driver or with the driverfs control over the vehicle. Sec. 156. Boarding or Alighting from Vehicles. - No person shall board or alight from any vehicle while same is in motion. Sec. 157. Unlawful Riding. - No person shall ride on any vehicle upon any portion thereof not designed or intended for the use of passengers. This provision shall not apply to an employee engaged in the necessary discharge of a duty, or to persons riding within truck bodies in space intended for merchandise. See. 158. Railroad Trains Not to Block Streets. - It shall be unlawful for the directing officer or operator of any railroad train to direct the operation of or to operate the same in such a manner as to prevent the use of any street for purpose of travel for a period of time longer than five minutes. Sec. 159. Driving Through Safety Zones Prohibited. - No vehicle shall at any time be driven through or within a safety zone. Sec. 160. Throwing Things on Streets. - No person shall throw or place on any street any tacks, nails, wire, scrap metal, glass, crockery, sharp stones, or other substances injurious to the feet of persons or animals or to the tires of vehicles. Any person who has purposely or accidentally dropped any such substance upon the street shall immediately clear such street of the same. Sec. 161. Hauling Rubbish or Loose Material on Streets. - No vehicle shall be used to haul rubbish, trash, loose bottles, tin cans, brush, waste paper, loose dirt, rocks, or material of similar nature, upon the public streets without first having been equipped with the proper equipment, as herinafter set out, to prevent the load, or any part thereof, from falling, dropping or being blown off the vehicle while in motion. The bed and sidewalls thereof shall not drop through or from the vehicle. The vehicle shall not be loaded in such a manner that any part of the load extends above or over the sidewalls of the truckbed. When the vehicle is being used for carrying loose paper or other material that may be blown from the load, a tarpaulin or screen saver of sufficient mesh-shall be used to cover the load to preven its being blown from the vehicle while in motion. -28- n Sec. 162. Window Signs and Stickers. - No person operating a motor vehicle in the City shall have affixed to the windshield or any of the windows thereof any sign, sticker, insignia, other obstruction or defects that limit visibility, except the City license sticker, or other sign, insignia or sticker required by any law or regulation, federal, state or city. Such city license shall be placed in the lower right -hand corner of the windshield and such other lawfully required sign, sticker or insignia shall be placed in such place and in such manner as not to obstruct the view of the driver. Provided, that stickers that do not occupy more than five per cent of the glass area may be affixed to the rear window in such manner and placb so as not to obstruct the view of the driver of such motor vehicle. Sec. 163. Dimming of Lights. - Every person operating a motor vehicle shall depress his headlights from a high beam to a low beam withim_five hundred feet when approaching another vehicle traveling in the opposite direction. Sec. 164. Growing of Shrubs, etc., Near Intersection. - No person shall permit any tree, shrub, hedge, flower, or other form of vegetation to grow within twenty -five feet of the intersection of the curb lines of two intersecting streets to a height in excess of three feet above the lowest grade of the two intersecting streets. Provided, however, that trees now growing in such places may grow above said heights if the limbs are trimmed to a minimum height of eight feet. Sec. 165. Unattended Motor Vehicles.. - No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition and removing the key; provided, however, that this shall not apply to local delivery trucks while in the process of making a delivery when the name of the owner of said truck is lettered thereon. It is further provided that when any motor vehicle is left standing upon any perceptible grade, the driver or operator shall, before leaving said motor vehicle, effectively set the brake thereon and turn the front wheels as to the curb or side of the street. .Sec. 166. Clinging to Vehicles. - No person riding upon any bicycle, coaster, roller skates, sled, or toy vehicle shall attach the same or himself to any vehicle upon a roadway. Sec. 167. Used Car Dealer Regulations. - All automobile dealers in Little Rock are required to furnish to the Police Department a list of all used cars sold by the dealer, setting forth such information as is prescribed by the Police Department. Sec. 168. Failure to Transfer State License. - Any person, purchasing a used car and failing to have license plates registered in his name, within a five days of date of bill of sale or whom shall give a fictitious address when having car registered, shall be guilty of a misdemeanor. Sec. 169. Garage Keepers to_Report Damaged Vehicles. - The person in charge of any garage or repair shop in Little Rock to with Is brought any motor vehicle which shows evidence of having been involved in a serious accident or struck by any bullet, shall report same to Police Headquarters within twenty -four hours after such motor vehicle is received, giving the engine number, registration number and the name and address of the owner or operator of such vehicle. Sec. 170. Avoiding Arrest. - It shall be unlawful for any person to turn off any lights on a motor vehicle for the purpose of avoiding arrest or identification. Sec. 171. All Night Parking Prohibited. - No person shall park a vehicle on any street outside of the congested district for a period of time longer than 30 minutes between the hours of 2 :00 A. M. and 6:00 A. M. of any day, except physicians on emergency calls. -29- Sec. 162. Zone of Quiet. - Whenever authorized signs are erected indicating a zone of quiet, no person operating a motor vehicle within any such zone shall sound the horn or other warning device of said vehicle except in an emergency. Sec. 173. Driving Through Filling Station. - It shall be unlawful for any person, after having driven a motor vehicle into any filling .station where gasoline is sold in this city, to leave the same without having first brought the said vehicle to a full stop. Article XV Penalties and Procedure on Arrest Sec. 171. Penalty. - It is a misdemeanor for any person to violate any of the provisions of this ordinance unless such violation is by this ordinance or other law of this State declared to be a felony. (a) Unless another penalty is in this ordinance or by the laws of this State provided, every person convicted of a misdemeanor for the violation of any provision of this ordinance shall be punished by a fine of not more than $500.00 or by imprisonment for not more than six months or by both such fine and imprisonment. Sec. 175. Forms and Records of Traffic Citations and Arrests. - The city shall provide books to include traffic citation forms for notifying alleged violators to appear gnd answer to charges of . violating traffic laws and ordinances in the Municipal Court. The officer in charge of traffic shall issue such books for the Chief of Police or his duly authorized agent and shall maintain a record of every book so issued. The Chief of Police shall be responsible for the issuance of such books to individual members of the police department. The Chief of Police shall maintain a record of every such book and each set of citations contained therein. Sec. 176. Procedure of Police Officers. - Except when authorized or directed under state law to immediately take a person before a Magistrate for the violation of any traffic laws, a police officer who halts a person for such violation other than for the purpose of giving him a warning or warning notice and who does not take such person into custody under arrest, shall take the name, address, the registration number of the motor vehicle involved, and such other pertinent information as may be necessary, and shall issue to him in writing on a form provided by the city a traffic citation containing a notice to answer to the charge against him in the Municipal Court at a time to be specified in said citation. Sec. 177. Disposition of Records of Traffic Citations, Warrants, and Complaints. - The following rules shall govern the disposition of traffic records; (a) Every police officer upn issuing a traffic citation to an alleged violator of any provision of the motor vehicle laws of this state or of any traffic ordinance shall deposit the original and a duplicate copy of the citation at the direction of the Chief of Police, who shall cause the original to be delivered to the Municipal Court and said duplicate dopy to the central records section of the police department. (b) Upon the filing of such original citation in the Municipal Court of this city as aforesaid, said citation may be disposed of only by trial in said court or by other official action, including forfeiture of bail or by payment of a fine to the traffic violations bureau of said court. -30- ` 1 (c) The Chief of Police shall also maintain or cause to be maintained in connection with every traffic citation issued by a member of the police department a record of the disposition of the charge by the Municipal Court or its traffic violations bureau. (d) The Chief of Police shall also maintain or cause to be maintained a record of all warrants issued by the Municipal Court on said traffic violation charges and which are delivered to the police department for service, and of the final disposition of all such warrants. (e) It shall be unlawful and official misconduct for any member of the police department or other officer or public employee to dispose of, alter, or deface a traffic citation or any copy thereof, or the record of the issuance or disposition of any traffic citation, complaint, or warrant in a manner other than as required in this section. Provided, however, that nothing in this section shall prevent the City Attorney from changing the charge in a citation. Sec. 178. Illegal Cancellation of Traffic Citations.- It shall be unlawful for any person to cancel or solicit the cancellation of any traffic citation in any manner other than as provided by this ordinance. Sec. 179. Audit of Records and Reports. - Every record of traffic citations, complaints thereon, and warrants issued therefor required in this Article shall be audited by the Director of Finance, who shall submit a report of such audit together with a summary thereof to the City Manager and Board of Directors. Such reports shall be public records. For the.purpose of this ordinance the Director of Finance or his duly authorized representatives shall have access at all times to all necessary records, files and papers of the Municipal Court, its traffic violations bureau, and the police department. Sec. 150. When Copy of Citation Shall be Deemed a Lawful Complaint. - In the event the form of citation provided herein includes information and is sworn to as required under the general laws of the state in respect to a complaint charging .commission of the offense alleged in said citation to have been committed, then such citation when filed with the Municipal Court shall be deemed to be a lawful complaint for the purpose of prosecution under this Ordinance. Sec. 181. Citation of Illegally Parked Vehicle. - Whenever any motor vehicle without driver is found parked or stopped in violation of any of the restrictions imposed by this ordinance, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a traffic citation, on a form provided by the city, for the driver or registered owner to answer the charge against him during the hours and at a place specified In the citation. Sec. 182. Failure to Comply With Traffic Citation Attached to Parked Vehicle. - If a violator of the restrictions on stopping, standing, or parking under this ordinance does not appear in response to a traffic citation affixed to such motor vehicle within the specified time of citation the Clerk of the Municipal Court shall send to the owner of the motor vehicle to which'traffic'citation was affixed a notice by mail informing him of the violation and warning him that in the event such notice is disregarded for a period of five days a warrant of arrest will be issued. Sec. 183. When Warrant to be Issued. - In the event any person fails to comply with a traffic citation given.to him or attached to a vehicle belonging to him or fails to make appearance pursuant to a summons directing an appearance in Municipal Court, or if any person fails or refuses to deposit'bail as'required and within the time permitted by ordinance, the Clerk of the Municipal Court shall secure and issue a warrant for his arrest. - 31- r .S •. ;a Sec. 184. Record of Traffic Cases, Report of Convictions to State Department of Motor Vehicles. - The Municipal Court shall keep or cause to be kept a record of every traffic complaint, traffic citation, or other legal form of traffic charge deposited with or presented to said Court, and shall keep a record of every official action by said Court in reference thereto, including but not limited to a record of every conviction, forfeiture amount of fine or forfeiture resulting from bail, judgment of acquittal, and the every said traffic complaint or citation deposited with or pre- sented to said Court. The Municipal Uourt shall make reports to the State Department of Revenue, Drivers License Registration Bureau, in accordance with state law. Sec. 185. Disposition of Traffic Fines and Forfeitures. - All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of this Chapter shall be paid over to the Department of Finance. Sec. 186. Authority to Impound Vehicles. - The police department is hereby authorized to remove a vehicle from a street or highway to the nearest garage or other place of safety, or to a garage designated or maintained by the police department, otherwise maintained by this city under the circumstances hereinafter enumerated. (a) When any vehicle is left unattended upon any bridge, viaduct, or causeway, or in any tunnel where such vehicle constitutes an obstruction to traffic. (b) When a vehicle upon a highway is so disabled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle are by reason of physical injury incapacitated to such an extent as to be unable to provide for its custody or removal. (e) When any vehicle is left unattended upon a street and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic; when any vehicle is left continuously and unattended upon any street for a period of more than forty -eight hours; and any time a vehicle is parked in a prohibited area that is so designated by signs or other official markings. (d) Whenever the police department removes a vehicle from a street under this section and does not know and is not able to ascertain from the registration records in the vehicle, the name and address of the owner thereof, such police department shall immediately give or cause to be given notice in writing to such owner of the fact of such removal and the reasons therefor and of the place to which such vehicle has been removed. (e) Whenever the police department removes a vehicle from a street under this section and does not know and is not able to ascertain the name of the owner, or for any other reason is unable to give the notice to the owner as hereinbefore provided, and in the event the vehicle is not returned to the owner within a period of three days, written report of such removal to the State Department whose duty it is to register motor vehicles. Such notice shall include a complete description of the vehicle, the date, time and place from which removed, the reasons for such removal, the name of the garage or place where the vehicle is stored. 32 Ir T T Sec. 187. All ordinances, sections, and /or parts of ordinances in conflict herewith are hereby repealed. Sec. 188. The repeal of ordinances conflicting herewith shall not affect the prosecution or punishment of any person for any violation of such repealed ordinances. Sec. 189. The Board of Directors hereby declares that should any sections, paragraph, sentence or work of this ordinance or of the ordinance hereby adopted be declared for any reason invalid, it-is the intent of the Board of Directors that it would have passed all other portions of this ordinance independent of the elimination herefrom of any portion as irlay be declared invalid. Sec. 190. It has been found and is declared by the Board of Directors of the City of Little Rock, Arkansas that grave traffic hazards exist in the City of Little Rock, endangering the lives and property of its citizens; that strengthened and more comprehensive traffic laws will materially reduce such traffic hazards. Therefore, an emergency is declared to exist, and this ordinance, being necessary for the pre- servation of the public peace, health and safety, shall be in full force and effect from and after its passage and approval.
