HomeMy WebLinkAbout11120ORDINANCE NO. 11s,120 AN ORDINANCE CONDEMNING CERTAIN PARCELS OF REAL PROPERTY FRONTING ON CANTRELL ROAD IN THE CITY OF LITTLE ROCK, ARKANSAS, TO BE USED FOR THE PURPOSE OF WIDENING AND PAVING SAID CANTRELL ROAD; DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION PROCEEDINGS AGAINST SAID PARCELS OF REAL PROPERTY; AND FOR OTHER PURPOSES. WHEREAS, in addition to the right -of -way heretofore dedicated, acquired, and /or condemned for the purpose of widening and paving Cantrell Road, such parcels of real property fronting on Cantrell Road right -of -way as are hereinafter described are needed for the purpose of widening and paving said Road; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. In addition to all right -of -way heretofore dedicated, acquired and /or condemned for the purpose of widening and paving Cantrell Road in the City of Little Rock, Arkansas, the following described parcels of real property situated in the City of Little Rock, Arkansas, are hereby condemned, and the City Attorney is hereby ordered and directed to file in the proper courts condemnation proceedings against said parcels of real property: A strip of ground along the south property line of Lot Six (6), Block Three (3), McGehee's Addition, being 6.75 feet in width along the East line of the lot and 4.25 feet in width along the west line of the lot; And a tract of land situated in the County of Pulaski, State of Arkansas, being part of Lot 6, Block 3, McGehee Addition to the City of Little Rock, Arkansas, and being a portion of a strip of right -of -way which is more particularly described as follows: Beginning at the intersection of the southerly right -of -way line of Cantrell Road and the westerly right -of -way line of Kavanaugh Boulevard, said point being adjacent to Station 439 422.3 on the centerline of Cantrell Road; thence 5.0 feet, more or less, south along the said westerly right -of -way line of Kavanaugh Boulevard to a point; thence deflect 135007' right and proceed 7.1 feet, more or less, northwesterly to a point on the southerly right -of -way line of Cantrell Road; thence deflect 135007' right and proceed 5.0 feet, more or less, easterly along said southerly right -of -way line of Cantrell Road to the point of beginning, and containing 12.5 square feet, more or less. The properties above described are owned by Opal J. Williams and are necessary to be utilized for the purpose of widening Cantrell Road in the City of Little Rock, Arkansas. 01067 -/7 F - S' r. 1 -2- SECTION 2. The City Attorney is directed to secure an Order allowing the City to take immediate possession of the properties de- scribed hereinabove upon its posting a bond or City of Little Rock check in the amount to be determined by the Court. The City Attorney is authorized to have posted on behalf of the City a bond or City of Little Rock check in the amount to be determined by the Court pending final determination of the condemnation proceedings. SECTION 3. All ordinances andparts of ordinances in conflict herewith are hereby repealed. SECTION 4. It has been found and determined that the safety of the citiznes of the City of Little Rock is jeopardized by reason of the narrow width of Cantrell Road and that the condemnation of these parcels of real property will enable the widening of said Cantrell Road so as to reduce said traffic hazard; now therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of public peace, health and safety shall be in full force and effect from and after its passage and approval.
