HomeMy WebLinkAbout11115ORDINANCE NO. 112115 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE STREET NOW CALLED BUCHANAN STREET (SHOWN IN THE PLAT AS STREET) EXTENDINGEFROM LEEVRNUEKTOO WOODL WNX AVENUE AND LYING BETWEEN BLOCKS 26 and 27 OF LINCOLN PARK ADDITION TO THE CITY OF LITTLE ROCK., ARKANSAS. WHEREAS, a petition was duly filed withthe Board of Directors of the City of Little Rock, Arkansas on the 15 day of June, 19609 asking the Board of Directors to vacate and abandon all of the street known as Buchanan Street, extending from Lee Avenue to Woodlawn Avenue and lying between Blocks 26 and 27 of Lincoln Park Addition to the City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing of record in Plat Book No. 1, page 63 of the records of Pulaski County, Arkansas, and filed for record August 26, 1907, subject, however, to any public easements in said street; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinbefore described, has heretofore been dedicated to the public use as a street, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the stt.eet to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: That part of Buchanan Street in the City of Little Rock extending from Lee Avenue to Woodlawn Avenue and lying between Blocks 26 and 27 of Lincoln Park Addition to the City of Little Rock, Arkansas. subject, however, to any public utility easements located in said street. SECTION 2, A copy of this Ordinances duly certified by the City Clerks shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3, This Ordinance shall take effect and be in force from and after its passage.
