y ►♦ ORDINANCE NO. 11,111 AN ORDINANCE TO REORGANIZE THE MUSEUM. OF FINE ARTS, CHANGE THE NAME THEREOF TO THE ARKANSAS ARTS CENTER, TO AUTHORIZE THE- ENLARGEMENT OF THE EXISTING MUSEUM BUILDING, TO ENCOURAGE THE DEVELOPMENT OF A BROADENED PROGRAM OF CULTURAL ACTIVITIES, AND FOR OTHER PURPOSES. WHEREAS, By Ordinance No. 5235, passed May 6, 1935, the o City - Council of Little Rock authorized the erection of a suitable kD 0i Museum of Fine Arts on the grounds of the Little Rock City Park, now known as Douglas MacArthur Park, and created a Board of Trustods -to o have the exclusive management and control of said museum; and >- A WHEREAS, By Ordinance No. 10576, passed July 8, 1957, the ro W ro City Council of Little Rock granted to the Board of Trustees of the a� Museum of Fine Arts full authority to solicit and receive funds to extend the Museum building and to equip such added facilities, and for other purposes, and to use and occupy such additional ground in J Douglas MacArthur Park adjoining the Museum building as might be necessary in order to build such extensions; and .WHEREAS, The Board of Trustees of the Museum of Fine =Artz- has available to it at this time sufficient funds to construct the contemplated and necessary additions to the Museum building, and the growth in this community of public interest in and support of the fine arts and cultural activities establishes a clear and urgent need for an expansion of the activities and facilities of the Museum of Fine Arts; NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, THAT: SECTION 1. The institution heretofore known and dpstgriated as the Museum of Fine Arts shall henceforth be known and designated as "The Arkansas Arts Center ". The Museum of Fine Arts shall continue to exist as a department within and under The Arkansas Arts Center and its Board of Trustees. SECTION. 2. The management an( ©ntrol of The Arkansas Arts Center and its cultural and educational programs is hereby vested in a Board of Trustees, which shall have not less than nine nor more than twenty -four members, to be appointed pursuant to the provisions of Act No. 99 of the Acts of 1929 as amended by Act No. 8 of the Acts of Arkansas of 1957, provided that the policy of the Board of Trustees of The Arkansas Arts Center shall not be inconsistent with the Ordinances of the City of Little Rock and the Statutes of the State of Arkansas. After the initial appointment of the Trustees to the said Board, Trustees shall thereafter be appointed to serve for a term of four years. The Mayor of the City of Little Rock and the President of the Fine Arts Club shall serve as ex- officio members of the Board of Trustees. The said Board may from time to time elect honorary life members as it deems expedient. SECTION 3. The said Trustees shall serve without pay or compensation in any form. The Board of Trustees shall annually elect from its membership to serve as its managing officers, a Chairman, a President, a Vice President, a Secretary and Treasurer, and such other officers as the members of the Board may deem necessary. The Board of Trustees shall render an annual report to the Board of Directors of the City of Little Rock. SECTION 4. The Board of Trustees of The Arkansas Arts Center is hereby granted full authority to proceed forthwith to plan, design, and have constructed and equipped additions to and modifications of the Museum of Fine Arts building in Douglas MacArthur Park and to use and occupy such additional ground adjoining the said Museum building as may be necessary to accommodate such additions. The said additions and modifications shall be so constructed as to present a harmonious architectural design when completed, The City of Little Rgek hai ;eby expressly exempts itself from any and all liability and expense which might arise by virtue of the construction and equipping of the facilities as above described, it being expressly understood that said construction and equipping are to be completed without any cost to the City of Little Rock; provided, nothing in this Ordinance is intended to:.'nor shall it be construed so as to relieve the City of its previous commitment for capital funds in the sum of $75,000.00 and such of the cost of maintenance of The Arkansas Arts Center as frorr' year to year the governmental body of the City of Little Rock may by Ordinance appropriate. SECTION 5. The Arkansas Arts Center building shall continue to be the home and meeting place of the Fine Arts Club of Arkansas at all times. In the event of the City of Little-Rock faillhg, for any reason, to provide necessary funds to pay for the maintenance of The Arkansas Arts Center, as herein provided, then, after the expiration of thirty days notice to the Board of Directors of the City of Little Rock that such failure has occurred, the maintenance of the said build- ing may be assumed and taken over by the Fine Arts Club of Arkansas. SECTION 6. No provisions of this Ordinance are intended nor :, shall they be so construed as to restrict or in any wise limit the authority of the Board of Trustees to accept, solicit, invest and expend funds separate and apart from its funds provided pursuant to the budget of the City 'of Little Rock SECTION 7. Ordinances No. 5235 and 10576 are hereby repealed. SECTION 8. Whereas the construction herein provided for is esstntia.l to the cultural and educational development of the citizens of the City of Little Rock, and any delay in empowering the Board of Trustees of The Arkansas Arts Center to proceed under this Ordinance will be a detriment to the public welfare, the same is found to be necessary for the immediate preservation of the public welfare, health and safety, and an emergency is declared to exist, and this Ordinance shall be in full force and effect from and after its passage and approval.
